DRAFT ORDINANCE NO.

________

REGULATING THE DISTRIBUTION AND SALE OF LIVESTOCK AND FOWL
SLAUGHTERED/BUTCHERED FOR PUBLIC CONSUMPTION, INCLUDING MEAT
AND POULTRY PRODUCTS AND PROVIDING PENALTIES FOR VIOLATION
THEREOF AND FOR OTHER PURPOSES.


WHEREAS, it is the avowed policy of the City Government of Dagupan to protect the
health, safety, interest of its people and promote their general welfare. Towards this end, it is
imperative to enact measures for the protection of the people against any deception, unfair and
unconscionable acts or practices in the sale of adulterated, mislabeled, substandard, unsafe, and
spoiled meat and poultry products by any individual;

WHEREFORE, on motion of Councilor ________________________, and duly
seconded by Councilor ___________________________, be it ordained by the Sangguniang
Panlungsod of the City of Dagupan in regular session assembled;


SECTION 1. TITLE. This ordinance shall be known as the ANTI HOT-MEAT ORDINANCE
OF DAGUPAN CITY.

SECTION 2. OBJECTIVES. This ordinance is enacted pursuant to the following objectives:

a. To strengthen the post-abattoir inspection in the City;
b. To prevent the proliferation of meat or meat products of unknown origin that has not
passed the required inspection, including undocumented, illegally shipped carcass or
meat parts coming from other countries as defined in Chapter XII of Republic Act
No. 9296;
c. To eradicate the entry of meat, poultry and its by-products without the necessary
inspection having been conducted by proper authorities;
d. To protect the health and safety of the public against meat-borne diseases;
e. To deter the entry of smuggled meat products that not only pose hazard to health but
likewise ensure that proper fees have been paid to the City Government;
f. To ensure that the meat, poultry and its by-products offered to the public are not
adulterated, misrepresented, mislabeled, substandard, unwholesome or unsafe for
consumption as provided for under the Consumer Act of the Philippines (R.A. 7394);
g. To safeguard the health of our livestock from contracting dreaded animal diseases
from contaminated animals; and
h. To make Dagupan City a HOT-MEAT FREE CITY.

SECTION 3. SCOPE AND COVERAGE. This ordinance shall be enforced within the
territorial jurisdiction of the City of Dagupan.

SECTION 4. DEFINITION OF TERMS. For the purpose of this ordinance, the following
words shall be defined as follows, to wit:

a. Adulteration the process of adding improper substances to meat and poultry
products making it impure and inferior for preservation.
b. Ante-Mortem Inspection inspection of live animals prior to its slaughter to detect
the presence of animal diseases, such as, but not limited to anthrax, hog cholera, foot
and mouth disease, and others, that may warrant the immediate condemnation of such
infected or contaminated live animals.
c. Drug residue the remaining substances such as drugs in the tissues and organs of
animals after being used as prophylactic or therapeutic treatment.
d. Hot-meat The carcass or parts of carcass of food animals which were slaughtered in
unregistered/unaccredited meat establishments, and have not undergone the required
inspection. It also includes undocumented, illegally shipped, unregistered carcass,
parts of carcass and meat products coming from other countries.
e. Meat inspection is the lawful action undertaken by a meat inspector or meat control
officer from the National Meat Inspection Commission or the Local Government Unit
to ensure the safety of meat and poultry and its by-products for consumption.
f. Meat Inspection Certificate a document that certifies the meat safe for human
consumption. Other relevant information contained in this document are, the
implementing Local Government Unit concerned, name of the establishment, type of
meat, weight of the meat, name of the owner/dealer, destination, meat stall number,
name of the meat vendor (for commercial purposes), conveyance used, its plate
number, date when the certificate was issued, signature of the
owner/dealer/authorized representative, and signature of the meat control officer/meat
inspector.
g. Meat-borne disease disease that can develop after consumption of contaminated
meat.
h. Meat Product Inspection Certificate a document that certifies the safety of meat
products for human consumption. Other information relevant to the Meat Inspection
Certificate is true to the Meat Product Inspection Certificate.
i. Mislabeled applies to any carcass, part thereof of meat or meat products, poultry
and poultry products under its labeling which is false or misleading.
j. Label, Labeling means the display of written, printed or graphic matter on any
consumer products, its immediate containers, tag, literature or other suitable materials
affixed thereto for the purpose of giving information as to the identity, component,
ingredients, attributes, directions for use, specifications and such other information as
may be required by law or regulations.
k. Misrepresentation an act of giving false and untrue information on the sale of meat,
poultry and its by-products.
l. Meat Control Officer a veterinarian from the National Meat Inspection Commission
who is properly trained and duly appointed by the Secretary of Agriculture in
accordance with law.
m. Meat Inspector a person appointed by the Department of Agriculture or the Local
Government Units concerned to perform meat inspection and other related functions
as prescribed by law.
n. Post Mortem Inspection inspection done within the slaughterhouse or abattoir
premises to ensure that the carcass and internal organs of slaughtered animals are fit
for human consumption.
o. Post Abattoir Inspection inspection conducted in markets and other places, such as,
but not limited to food establishments, malls, talipapas, litsunan.

SECTION 5. MEAT INSPECTION. All slaughtered livestock and fowls for consumption and
their meat products that are being sold in the market and other places within the City of
Dagupan, shall be subjected to inspection and examination by the City Veterinarian or his duly
authorized representative, Meat Control Officer or Meat Inspector before its distribution and
sale.


SECTION 6. MEAT INSPECTION CERTIFICATE. Upon inspection and if found safe for
consumption, meat of livestock, fowls, carcasses and its organs shall be stamped with the words
Inspected and Passed prior to the issuance of a Meat Inspection Certificate.

SECTION 7. MEAT PRODUCT INSPECTION CERTIFICATE. All meat, poultry and its
by-products, prior to release from processing plants and other meat processing establishments
shall be properly inspected by the City Veterinarian or his duly authorized representative before
a Meat Product Inspection Certificate will be issued.

SECTION 8. CERTIFICATE OF MEAT INSPECTION (COMI). A Certificate of Meat
Inspection shall be issued for purposes of domestic transport of imported meat and its by-
products. The certificate shall indicate the product details, product description, production date
and expiry date. Transport details shall indicate the destination/recipient date of transport which
shall be valid for three (3) days from the date of inspection of the products until its destination.

SECTION 9. VALIDITY OF MEAT INSPECTION CERTIFICATE AND PRODUCT
INSPECTION CERTIFICATE. The Meat Inspection and Meat Product Inspection Certificates
shall only be valid within twenty-four (24) hours upon its issuance.

SECTION 10. RE-INSPECTION OF MEAT AND MEAT PRODUCTS. Meat and poultry
and its by-products that originate from places other than the City of Dagupan shall be subject to
re-inspection and revalidation to determine the veracity of the issued meat inspection and meat
product inspection certificates.

SECTION 11. ACCREDITATION OF SLAUGHTERHOUSES AND MEAT
PROCESSORS. Only meat and poultry and its by-products that originate from category triple
AAA and double AA slaughterhouses and meat processing plants are allowed to sell and
distribute the same within the City of Dagupan.

11.1. Triple AAA those slaughterhouses and meat processing plants that have
adequate facilities and operational procedures to slaughter livestock and fowls for sale in
any domestic or international market;
11.2. Double AA those slaughterhouses and meat processing plants that have
adequate facilities and operational procedures to slaughter livestock and fowls suitable
for sale in any market, local or national;
11.3. A those slaughterhouses and meat processing plants that have facilities and
procedures with minimum adequacy to slaughter livestock and fowls suitable for
distribution and sale only within the city or municipality where the slaughterhouse is
located.

SECTION 12. CONVEYANCE. All transport vehicles, vans and other forms of conveyance for
meat, poultry and its by-products shall be accredited by the City of Dagupan for meat products
sold within the city, and by the National Meat Inspection Commission for meat products
conveyed outside the city.

SECTION 13. CONDEMNATION. Meat, poultry and its by-products shall be condemned
under any of the following conditions:

a. Unclear, unsafe, injurious, dangerous and unwholesome;
b. Under the advanced stage of decomposition;
c. Expired meat inspection and meat product inspection certificates;
d. Sale of meat and poultry by-products after its expiration date;
e. Presence of abnormal color or odor;
f. Contaminated or those found to contain toxins or hazardous substances; and
g. Presence of lesions as a result of diseases, such as, but not limited to pale, soft,
exudative carcasses due to cirrhosis of the liver, pus, and hemorrhages.

SECTION 14. CONFISCATION. Meat, poultry and its by-products shall be confiscated under
any of the following conditions:

a. Absence of Meat or Meat Product Inspection Certificates;
b. Tampered Meat or Meat Product Inspection Certificates;
c. Those originating from unaccredited slaughterhouses and/or processing plants;
d. Those that are misrepresented, mislabeled and/or adulterated;
e. Unauthorized replacement of packaging materials; and
f. Those with expired COMI.

To ensure the safety of the public, livestock meat products and poultry products shall be
handled in a sanitary and hygienic manner to avoid contamination so as not to be subject to
confiscation or condemnation.

SECTION 15. DISPOSITION. Confiscated meat, poultry and its by-products, upon
certification from proper authorities, that the same is still safe for consumption, shall be donated
to charitable institutions, otherwise, the same shall be condemned.

SECTION 16. PENALTIES.

a. It shall be unlawful for any person, firm, corporation, partnership any of its agents or
employees to offer, directly or indirectly to any inspector authorized by law, any sum
of money or things of value with intent to influence such inspector to render acts
violative of the Meat Inspection Law;
b. Any official (inspector) or employee, who in the performance of official duties,
directly or indirectly accepts any gift, sum of money, or things of value, from any
person, firm, corporation, partnership or any of its agents or employees, to render acts
violative of official functions shall be subject to administrative sanctions depending
on the gravity of the offense;
c. It shall be unlawful for any person who cause the slaughter animals without the
conduct of ante-mortem and post-mortem inspection by proper authorities as
mandated by law; or who shall store, transport, sell or dispose food carcasses, organs
of livestock, meat or poultry and its by-products without inspection; or who shall
contravene or violate any provision of this ordinance; or who shall forge, counterfeit,
alter, deface or destroy any certificate and other documents issued pursuant to this
ordinance, shall be liable and shall suffer the corresponding penalty as follows:

Offense : Fine of P10,000.00 or 10 days imprisonment or both at the
discretion of the court;

nd
Offense : Fine of P25,000.00 or 10 days imprisonment or both at the
discretion of the court;
3
rd
Offense and subsequent offenses : Fine of P50,000.00 or 30 days imprisonment or
both at the discretion of the court and revocation of business
license.
d. Vehicles used in the transport of carcasses, organs of livestock, meat, poultry and its
by-products in violation of the preceding paragraph shall be impounded and shall
only be released upon the payment of the required impounding fees.

SECTION 17. ENFORCEMENT. The City Mayor, City Veterinarian, City Legal Officer
and the City Agriculture Officer shall promulgate rules and regulations and cause the creation of
a Task Force as may be deemed necessary for the effective implementation of this ordinance.

SECTION 18. REPEALING CLAUSE. Any ordinance or provision thereof that is
inconsistent with this ordinance is hereby repealed or modified accordingly.

SECTION 19. SEPARABILITY CLAUSE. If any provision of this ordinance is declared
unconstitutional or invalid, the other provisions not so affected shall remain in force and effect.

SECTION 20. EFFECTIVITY. This Ordinance shall take effect upon its approval and
upon compliance with Book IV, Title I, Section 511 (a) of R.A. 7160 otherwise known as the
Local Government Code of 1991.
