In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a

Opinion Mon, Jan 24, 2000 Orengo's Crying Wolf, Fangs at his Throat By JOHN GITHONGO James Orengo, the Ford-
Kenya MP for Ugenya and Shem Ochuodho, the National Development Party of Kenya (NDP) MP for Rangwe, are in mortal
danger. Both leaders hail from the Luo community and have been locked in an acrimonious political tug-of-war with
Raila Odinga, who heads the NDP, apparently over Odinga's "co-operation" with the ruling party Kanu. Both, with their
contrarian views, have diminished Raila's stature as the political supremo of Luoland, thus denting his credibility as
someone who can bring a large solid bloc of support when negotiating with Moi politically.
It has also been the most violent. Several times in the past couple of years, Messrs Orengo and Ochuodho have
found themselves confronted by stone-wielding gangs of Raila supporters baying for their blood. Many of these
incidents have happened upcountry but have been unique for the violent intent of these gangs. A keen survival
instinct would appear to have saved Orengo from nasty injury or worse on a number of occasions.
In the second week of January, Jim Orengo and Shem Ochuodho were attacked outside parliament by a gang of
youths carrying knives, whips and stones. They had just left a meeting of the Stakeholders Support Group (SSG) – an
informal grouping of MPs and civil-society activists who are questioning the impending resumption of aid to Kenya by the
IMF. Wananchi and MPs who spoke to the press after witnessing the attack on Orengo and Ochuodho were shocked by its
viciousness and concurred that the aim appeared to be the murder of the two MPs.

the event live, a number of sideshows were going on. The Government side had managed to poach a small number of ODM MP’s and
were expecting a razor thin margin of victory. What they did not know is that ODM had not been asleep, and with the strategic genius of
Raila, had also managed to poach some Government MP’s to their side.

• Opposition 'Helped Plan' Ethnic-Based Violence in Rift Valley, Catholic Information Service for Africa (Nairobi), 25
January 2008, Eldoret: The horrific massacres, plunder and displacement of people in the Rift Valley was planned and
executed by the opposition, an independent investigation established. Human Rights Watch said opposition party officials
and local elders planned ethnic-based carnage. The organisation also collected accounts from Kalenjin men at
community meetings where local elders and ODM mobilizers urged Kalenjin residents to contribute money to
purchase of automatic weapons. Some communities have reportedly managed to obtain such weapons already.

Kibaki invites Raila for poll crisis talks Story by NATION Team Publication Date: 1/8/2008: President Kibaki has invited
ODM leader Raila Odinga to a meeting at State House, Nairobi, on Friday in an effort to restore peace and resolve the
political crisis sparked by the disputed presidential election result. However, late last night, Mr Odinga said through a
spokesman that he would only attend the meeting if it is part of the negotiation process that Ghanian president John
Kuffuor is expected to spearhead. Others invited to Friday’s meeting are: John Cardinal Njue of the Catholic Church,
Archbishop Benjamin Nzimbi of the Anglican Church, Bishop Silas Yego of the Africa Inland Church, Prof El
Bussaidy Chairman of the Supreme Council of Kenya Muslims (Supkem) and Supkem’s secretary-general Aden
Wachu.Others are the chairman of the NCCK, Bishop Joseph Wabukhala and secretary-general Canon Peter
Karanja, Bishop Arthur Kitonga of Redeemed Gospel Church and Bishop Boniface Adoyo of the Nairobi

•Kenyans rejected prime minister role in referendum on constitutional amendment in 2005:
(1) Demanded by UK, US, Germany and EU (and hate leaflets). C. Rice threat to impose a solution on Kenya.
(2) Kenyans wanted the ability to impeach their members of parliament.
(3) Kenyans wanted devolution of power to the Member of Parliament (MP) level to place control within reach of
ordinary citizens and limit collusion as orchestrated by odinga in 2002 resulting in MPs tax-free salaries of
$169,525 per year.

compensation from the British government for injuries caused by ordinances left in their area and raping of their
women by UK military soldiers are in a tussle to reclaim army training land. They complained that the UK military had
been encroaching on their land despite having set aside 90,000 acres for training range, which they are urging
for regazettement. The pastoralists said that they had been pressurized to give out their land as they did with the
Samburu National Reserve and they fear they would be rendered squatters in their own land.

Elijah Marima Sempeta, murdered in 2005, publicly questioned why Magadi Soda Company (now Tata Chemicals)
continued to monopolise exploitation of soda ash in Lake Magadi. Sempeta’s grouse was that the 222,788 acres it was
on had been hived off from formerly Maasai land. There is evidence that other communities —Kalenjin, Kisii, Kikuyu and
Luhya — came into the picture after the Maasai. First to make such an application was the East African Syndicate (a
South African company), which applied for 320,000 acres in then Naivasha in 1902. Lord Delamere also applied for
100,000 acres of the best most favoured grazing grounds of the Maasai between lakes Nakuru and Naivasha.
