Sub: Appeal to arrange to recover the free space of the General Common Areas which I
purchased from the West Bengal Housing Board and the same free space has been
encroached by the Bidisha Co-operative Housing Society Ltd. with the help of the Co-
operation Directorate, Hooghly Range Office and pursued by the Office of the Inspector of
Co-operative Societies, Serampore Circle.
Dear Sir,
I have already made several written complaints to you that the free space of General
Common Area of Bidisha Co-operative, which I have purchased from the West Bengal
Housing Board, has been encroached by the Bidisha Co-operative Housing Society Ltd. with
the help of the Co-operation Directorate, Hooghly Range Office and pursued by the Office of
the Inspector of Co-operative Societies, Serampore Circle.
Encroachment has been made by -
1.
addition of material structure at the free space of General Common Areas of
Bidisha Co-operative for using the same as Cycle-Stand.
2.
addition of material structure at the free space of General Common Areas of
Bidisha Co-operative through purchase an old &used go-down from the West
Bengal Housing Board, for using the same as Community Hall.
The aforesaid activities and practices are illegal and offence as per-

provisions of the Sale Deed.
The concerned authority did not take any legal action even after issuing your letter vide
memo no. 2794-Coop/A/3P-5/10 on dated 24.07.2012. Thus, the concerned authority has
ignored your letter. This is a proof of biasness of the concerned authority to the offenders.
Free space of General Common Area of Bidisha has not been recovered till the date by
removing the material structures. The offenders are scot-free due to non-cooperation of the
concerned authority.
Three years has been passed away, but the free space has not been recovered for which I
paid my hard-earned money.
Considering the gravity of the offence and the biasness of the concerned authority to the
offenders once again, I request you to look into the matter and do the needful at the
earliest and help me to recover the free space by removing the illegal material structures
from the free space of General Common Areas of Bidisha.

1(7) The Association of Apartment Owners shall, subject to any
covenants, conditions or restrictions if any agreement, have the right, to
be exercised by the Manager or the Board of Managers on behalf of the
Association with such assistance as the Manager or the Board of Managers,
as the case may be, considers necessary, to transfer ownership, by sale
or by lease for thirty years or more, of any buildings of apartment owned
or deemed to be owned as common areas and facilities by the Association
and occupied by any tenant or any other person not being an owner:
Provided that no such transfer shall be made by the Association to
any person, other than an existing tenant or an occupier, not being an
owner, without the consent of all the apartment owners.
6. Each apartment owner shall comply strictly with the bye-laws
and with the covenants, conditions and restrictions set forth in the
Declaration. Failure to comply with any of the same shall be a ground
for an action to recover damages or for other relief or reliefs at the
instance of the Manager or the Board of Managers on behalf of the
Association of Apartment Owners or, in a proper case, by an aggrieved
apartment owner.
7. No apartment owner shall do any work which would be prejudicial
to the soundness or safety of the property or would reduce the value
thereof or impair any easement or hereditament 2[or shall add any material
structure or excavate any additional basement or cellar without first
obtaining the consent, in writing, of all other apartment owners]

8. During the period the property remains subject to this Act, no
encumbrance of any nature shall be created against the property. During
such period an encumbrance may, however, be created only against each
apartment and the percentage of undivided interest in the common areas
and facilities appurtenant to such apartment, in the same manner as in
relation to any other separate parcel of property subject to individual
ownership.
9. The common profits of the property shall be distributed among,
and the common expenses shall be charged to, the apartment owners
according to the percentage of the undivided interest in the common
areas and facilities.

(Amendment) Act, 1992 (West Ben.Act XXI of 1992).

house or flat by
member in

operative society,
(2)
Amember of a Co-operative housing society shall not be entitled to any title
or interest in any plot of land or house or apartment in a building until he has made
such payment as may be prescribed towards the cost of such plot or land or construction
of such house or apartment or both, as the case may be, to the Co-operative housing
society.
(3)
Aplot of land or a house or an apartment in a building (including the undivided
interest in the common areas and facilities) shall constitute a heritable and transferable
immovable property within the meaning of any lawfor the time being in force:
Provided that notwithstanding anything contained in any other lawfor the time
being in force. such heritable and transferable immovable property shall not be
partitioned or sub-divided for the purpose whatsoever:
Provided further that notwithstanding anything contained elsewhere in this Act or
in any other lawfor the time being in force, an heir who is a nominee in respect of
a share and interest in a flat or house or plot in a Co-operative housing society shall
be eligible to be admitted as a member of the Co-operative housing society irrespective
of the fact whether he owns any property by his own right or inheritance or by
marriage provided he declares. that he has requirement for such residential
accommodation:
Provided also that membership of a person in a Co-operative housing society shall
not cease if the member himself or any member of his family becomes owner of any
land, house or flat through inheritance and if he still continues to have genuine need
of accommodation in the project of the society.
(4)
Every member of a Co-operative housing society shall be entitled to an
undivided interest in the common areas and facilities pertaining to the plot of land
or house or apartment allotted to him.
(5)
Every member of a Co-operative housing society in whose favour a plot of
land or a house or an apartment in a building has been allotted shall have the right
to use the common areas and facilities as aforesaid for the purpose for which they
are intended without interfering with or encroaching upon the lawful rights of other
members in whose favour similar allotment has been made.
(6)
The work relating to the maintenance, repair and replacement of the common
areas and facilities (including additions or improvements thereto) shall be carried out
in accordance with the by-laws of the Co-operative housing society and the building
rules of the concerned municipality, notified area authority or competent authority,
as the case may be, and the costs thereof shall be apportioned amongst the members
of the Co-operative housing society in such manner as may be prescribed.
93. (1) No member of a housing Co-operative society shall, except under the
following circumstances, be allowed to let out his house or flat allotted in his favour
by the housing Co-operative society
(a) where the member is transferred to his employer to any other place which
is not agglomerated with the area of the housing Co-operative;
(b) where the member is under the condition of his service compelled to stay
outside such as in office quarters:
(c) where the member is compelled to reside elsewhere due to reasons of his
business or profession:
(d) where the member is compelled to reside elsewhere under such other
circumstances as the board may approve.
(2) (a) No member of the housing Co-operative society shall allowany of his
relatives besides the members of his family to reside in his house or flat
without prior consent of the housing Co-operative society;

BETWEEN WEST BENGAL HOUSING BOARD, a statutory Body Corporate constituted under the
West Bengal Housing Board Act, (Act.XXXII of 1972) having its office at No.105, S.N.Banerjee
Road, Kolkata-700014, in the city of Kolkata the vendor hereinafter referred to as "THE BOARD"
(which expression shall unless excluded by or repugnant to the subject or context mean and include
its successor or successors in interest) OF THE FIRST PART AND THE BIDISHA CO-
OPERATIVE HOUSING SOCIETY LTD (Registration No. 6 HG Dated 10-6-2004 of ARCS
HOOGHLY) having its office at Management Building, Bidisha Housing Project, Konnagar, Phase-
II, P.O.Konnagar, Dist.Hooghly hereinafter referred to as "THE PURCHASER" (which expression
shall unless excluded by or repugnant to the subject or context mean &include the successor in
interest or assigns of the said Society) of THE SECOND PART.
WHEREAS
1. The West Bengal Housing Board has taken possession from the State Govt.a parcel of land
measuring 4.09 acres in Mouza Konnagar, J.L No 7, P.S.Uttarpara, District Hooghly under
jurisdiction of Konnagar Municipality having premises nos.134/1, 134/1/A and 134/2 C.S.Mukherjee
Road.Subsequently the said land was transferred by the Housing Department, Govt.of West
Bengal to the West Bengal Housing Board under Section 29(1) of West Bengal Housing Board Act
1972 vide notification No.1173-HI/1L-26/91 Dated 10-11-2000and Corrigendum Notification No.
134-HI/1L-26/91 dated 9-2-2001.
The West Bengal Housing Board has also got another parcel of land measuring 1.977 acres by
direct purchase, contiguous to the aforesaid land, also in Mouza Konnagar, J.L No.7, P.S.
Uttarpara, District Hooghly vide Deed No.11434 dated 10-7-1990 in volume no.1 which was
registered at the office of the Additional Registrar of Assurance, Kolkata.This land is also under
Konnagar Municipality and having premises no.133and134 C.S.Mukherjee Road.

Both the allottee(s) and the Purchaser has/have taken inspection of the building plan and
the said flat(s and have satisfied themselves as to the construction thereof and the condition
and description of all fixtures and fittings Installed and/or provided therein and also as to the
amenities and facilities appertaining to the said flat and as to the nature, scope and extent of
benefit or interest in the common areas and facilities/amenities within the said Estate more fully
described in the Third Schedule hereunder written, The peaceful possession of the said vacant
flat shall be obtained by the allottee member(s) as well as the Purchaser after execution and
registration of
deed.

The Allottee(s) has/have become a member of the BIDISHACO-OPERATIVEHOUSING
SOCIETY LIMITED and both the Allottee member(s) and the said Society requested the Vendor
that the said flat be conveyed in favour of the said Society (the Purchaser) and that the
allottee member(s) shall be entitled to perpetual ;right of possession of the said flat by virtue
of his /her's/ their's membership of the said Society which will be governed by the West Bengal
Co-operative Societies Act 1983 as amended from time to time, West Bengal Co-operative
Societies Rules 1987 and the registered bye-laws of the society.
7. The Purchaser and the Allottee member(s) as well have agreed to the condition that no repair
or rectification work of any defect of any flat would be undertaken by the Board after its delivery of
possession to the Purchaser and the Allottee member(s).
8, The Purchaser and the Allottee member(s) as well have further agreed to the matter that no
complaint regarding design, lay-out, accommodation specification, fittings and fixtures etc. and
regarding amenities provided in the flats or in the estate shall be entertained by the Board after this
sale or transaction.

NOW THIS INDENTURE WITNESSETH that in consideration of the purchaser agreeing to
observeand perform the terms and conditions herein mentioned and to which the allottee(s)
was/were a party(ies) and in consideration of the payment made by the Allottee(s) as hereinbefore
recited and in consideration of the joint application made by the Allottee(s) and the purchaser as
hereinbefore recited to convey the said flat to the purchaser ,the Board doth hereby sell, grant,
convey and transfer unto the purchaser all that the said flat more fully described and mentioned in
the Second Schedule hereunder written together with proportionate undivided interest or share in
the common areas and facilities according to the nature, scope and extent as defined under the
West Bengal Apartment Ownership Act,1972 and subject to the rules and bye laws framed under
the said Act and/or to be framed hereinafter for the sake of brevity collectively referred to as the flat
TO HAVE AND TO HOLD the said flat hereby sold, conveyed and transferred unto the Purchaser
absolutely and for ever subject to the provision of the obligations in perpetuity of the Society to
observe and perform all the terms and conditions for management, administration and maintenance
of the said common areas and facilities/amenities provided for the purchaser of the flats only in the
said Estate as mentioned in the Third Schedule hereinafter by the said Co- operative Society
formed by the allottees/purchasers of flat of the said Project.
I. The purchaser and the allottee-member(s) shall jointly and severally doth hereby covenant with
the Board as follows:-
a)
The purchaser and the allottee(s) shall jointly and severally carry and performthe obligations and
duties imposed and/or to be imposed on the purchaser and the allottee(s) under the provision of the
West Bengal Apartment Ownership Act,1972(as amended) and the rules and/or bye-laws framed
and/or to be framed there under and/or by the Co-operative Housing Society meant for looking after
the management, administration and maintenance of the general common areas and
facilities/amenities which shall be applicable to all the allotteestallottee-member(s) of the said
Housing Project.
b)
The purchaser and/or the allottee(s) shall pay municipal taxes, charges, levies and Impositions
payable by the purchaser and/or the allottee-member(s) as owner and/or the occupier of the said
flat as and when becomes due and payable and shall in addition thereto also pay all other liabilities,
charges for repairs, maintenance and replacements payable by the purchaser or the allottee-
member(s) under the provisions of the West Bengal Apartment Ownership Act, 1972 (as amended)
. and the rules and/or bye-laws framed and to be framed there under and/or as may be imposed as
maintenance and management charges by the Co-operative Housing Society meant for looking
after the management, administration and maintenance of the general common areas and
facilities/amenities along with other allottee-member(s)/purchasers in the said Project.
c) The general common areas and facilities provided for the purchasers of flat in the estate
mentioned in the Third Schedule hereto shall at all time be held by the purchaser and/or allottee-
member(s) along with other purchasers of flat in the said project and shall be used and enjoyed by
themin common amongst themselves and neither the allottee/occupier nor any other
purchaser of any flat in the aforesaid estate shall any time be entitled on any ground whatsoever to
make partition' or division thereof or to claimto have exclusive right in any manner whatsoever

to any portion of such general common areas and facilities/amenities and that the purchaser along
with the other purchasers of different flats in the aforesaid estate shall use the said general common
areas and fac.ilities/amenities for the purpose for which they are entitled to without hindering or
encroaching upon the lawful rights of other purchasers and occupiers of other flats in the said
Project
d)
The Board shall not pay the maintenance charges etc.for any vacant flat in the said project as
the common areas and facilities/amenities pertaining to the said project have already been handed
over to the said Co-operative Society.
e)
The proportionate undivided interest of the Society in the common areas and facilities/amenities
shall not be transferable except along with the said flat hereby sold to the Society and shall be
deemed to be conveyed or encumbered with the said flat even though the same is not expressly
mentioned in any conveyance or instrument of transfer.
f)
The purchaser and/or the allottee-member(s) shall not allow the flat to be so used as to cause
annoyance or inconvenience to the owners/occupiers of the adjoining or neighboring flats/buildings
and also shall not allow it to be used for any unhygienic, unlawful or immoral purposes subversive
to the Government established by law in India.
The expression 'PURCHASER" wherever it appears in these presents if the context so
requires shall be read as the 'PURCHASERS" and shall mean and include its respective
successors, legal representatives and permitted assigns.

Internal brick built drains are provided to collect
the Bathroom/ kitchen waste, storm water from
the buildings including compound and finally
disposed it to the nearest municipal drain
through above internal drainage net work of the
Project.
Sewerage from toilet of flats to be collected in
septic tank through H C I lines and connecting S
W line with necessary inspection pits for
treatment and thereafter the treated effluent will
be discharged to nearest internal drains through
chlorination chamber for ultimate discharge to
municipal drain.
Potable water will be supplied by KMWSA/ Local
Body through their one no.connecting water
meter to the Board's three nos.semi
underground R CC water reservoirs located at
different position of the housing Project
connected with underground water grid lines.
The water charges/ taxes for the supply of water
from KMWSA/ Local Body to the Bidisha Co-
operative Housing Society Ltd will have to be
borne by the allottees and/or Bidisha Co-
operative Society lid as per bills to be raised by
KMWSA/ Local Body from time to time as per
their rules.
For getting supply of water from KMWSA an
agreement has signed between the Bidisha Co
operative Housing Society and KMWSA and the
said Society will be solely responsible to meet
up water charges bills to KMWSA/ Local Body
directly from the date of taking over charges of
common areas and facilities from the Board.
Water will be lifted from the semi underground
reservoir to the roof top tanks provided over
each Block by Centrifugal Pump and internal
underground G I line net work and rising mains.
VVater from roof top tank will be distributed to
flats through the G I distribution lines net work.

Three nos.Semi Underground RCC water
reservoirs with Pump Houses having total
capacity of 245 Kilo liters(approx).
b)
Two nos.PVC roof top water tank provided on
each building having capacity of each tank of
4000 liters (approx)

allottee will have to apply individually to CESC
Ltd at its local office.
Atwo-storied Management Office provided
excepting Electrical Transformer Rooms in the
ground floor.

work on HT cable line running through the
common road of Bidisha and Police Housing
Project.
Percentage of individual interest in the common areas and facilities appertaining to each apartment
and its owners for all purpose including equal voting shall be guided by the norms laid down in the
bye laws of the Co-operative Society.
