Say youve been nabbed by police and
criminally charged whether for posses-
sion of pot, shoplifing, or perhaps a driving
ofence (were not talking murder or rob-
bery). Youre over 18 years old and its your
frst time. Is a criminal record a sure thing?
Maybe not.
A criminal defence lawyer may be able
to negotiate with the Crown prosecu-
tor and secure a guilty plea to a lesser,
non-criminal ofence (such as a motor
vehicle infraction in the case of a driving
ofence). Or a criminal defence lawyer
could win a not guilty verdict for you at
trial. In either case, youd avoid a criminal
record. But what if your lawyer tells you
neither of these options is likely?
Lets be clear you want to avoid a
criminal record if you can. Partly thats
because of the stigma attached. Nobody
likes being branded a criminal.
But a criminal record has other nega-
tive consequences. It may jeopardize
your current job and disqualify you from
holding certain jobs altogether (think
teacher, nurse or bank teller). And you
may have to disclose it when looking for
a job clearly it wont help you land one
in future.
Also, it may result in travel restrictions.
With a criminal record, you may not be
able to get into certain countries, like the
United States.
So what can you do to avoid a criminal
record?
Several options may be available, and
your lawyer will discuss these with you.
One option is alternative measures
sometimes known as diversion. Maybe
the Crown prosecutor can be persuaded
that in your particular circumstances
avoiding the criminal justice process is
appropriate. Youd have to admit your
guilt, take responsibility for what you did
and try to make amends to the commu-
nity. Typically this involves apologizing to
those hurt by your actions, returning or
paying for things that were taken, coun-
selling and/or doing community service.
But if the Crown agrees to diversion and
alternative measures, it sure beats a crimi-
nal trial and avoids a criminal record.
Another option is: If you plead (or are
found) guilty, the court might be persuad-
ed that an absolute discharge is justifed
in your case. Maybe you are young and
show remorse, and its clear to the court
the ofence was totally out of character.
Te court may lean against branding you
a criminal. So if youre lucky, you will, just
this once, get an absolute discharge and
no criminal record.
Yet another option is: If you plead
(or are found) guilty, the court might be
persuaded that a conditional discharge
is appropriate. You would have to abide
by a set of good behaviour conditions
similar to probation for a specifed time
period. If you live up to those conditions,
you will not have a criminal record. But
make no mistake if you trip up and
break the conditions, pronto, goodbye
conditional discharge, hello sentence and
criminal record.
In the case of either an absolute or condi-
tional discharge, you can honestly say that
youve never been convicted of a crime and
you dont have a criminal record.
If youre facing a criminal charge, even
one that seems minor, see a good crimi-
nal defence lawyer the consequences of
a conviction and criminal record can be
long-lasting and nasty.

Halloween At Te Vallican Whole
Slocan Valley Rec presents Halloween at the Vallican Whole
on Sunday, October 26. Join a crew of world-class sculptors,
professional storytellers and volunteers from Mt Sentinel for
a full day of Halloween activities for the whole family.
Starting at 10 am and continuing to 3 pm, local sculp-
tors David Ducharme and Peter Vogelaar will be hosting
a pumpkin carving event to remember. Bring your own
pumpkin or squash and learn tips and tricks to help you
achieve great results. Explore the possibilities of creating
beautiful works of art ranging from realistic faces to good
old fashioned Jack-o-lanterns. Some sculpting tools will
be available, but please bring your own if you have them.
Later on in the day, from 6 to 9 pm, a campfre will be blaz-
ing, and local storytellers Mary Mortimer and Jake Conkin
will be kicking of a round of tall tales, scary stories and music.
Everyone is welcome to share their favourite tales. Inside, well
screen a family friendly Halloween classic and serve popcorn
and hot chocolate. Choose your own adventure.

Lifelong Healthcare Series at the Co-op
Te Kootenay Co-op is hosting a new educational series
with local naturopath, Dr. Christi Hartman of Full Circle
Family Practise. Te series will focus on diabetes, heart
disease and osteoporosis in the fall/winter 2014 season.
We wanted to address some of the most preventable, yet
widespread, diseases afecting our community, says mar-
keting & outreach manager Jocelyn Carver.
Dr. Hartman will share factors that increase risk, basic
information about how these diseases develop in the body,
what is available for early detection as well as steps that
individuals can take to reduce the risk of developing these
conditions. Our classes show participants how they can
positively infuence their own long term health, says
Carver. Having a naturopath as the instructor adds a level
of expertise and experience to the classes that we are very
excited about.
Classes are $20 for Co-op members ($25 for non-mem-
bers) and include instruction, discussion, sampling and
light refreshments. Registration is now open at the Cus-
tomer Service desk or over the phone (250.354.4077 ext.
205). Classes take place at the following times:
Diabetes: Was held on Saturday, October 18.
Heart Disease: Saturday, November 8, 3-4:30 pm

The Waneta Expansion Project near Trail is one of the largest hydroelectric
projects currently under construction in British Columbia. When complete in
2015, it will generate 335 MW of clean, hydroelectric energy by sharing the water
from the existing dam. It will provide enough energy to power about 60,000
homes per year and will reduce greenhouse gas emissions by 400,000 tonnes,
the equivalent of taking 78,000 cars of the road.
Recent project milestones include completion of work on the runner, stator and
rotor for one unit, installation and commissioning of the gates, stoplogs and
sturgeon exclusion screens in the powerhouse, watering up and blasting in the
tailrace area (where the water will re-enter the Pend dOreille), and completion of
structural concrete work in the intake area.
Construction activities are currently focused on completion of the electrical and
mechanical work in the powerhouse, rotor and stator assembly and completion
for the remaining unit, preparation for watering up and blasting in the intake
area, and commencement of de-mobilization and reclamation work.
PROJECT HIGHLIGHTS
Currently over 400 people are working directly on the project, providing
60 apprenticeship opportunities. Equity hiring provisions are in place for
women, persons with disabilities, First Nations and/or visible minorities.
Regional spending on goods and services exceeds $200 million.
High standards of safety, quality and environmental protection.
A Community Impact Management Committee meets monthly to provide
ongoing support to encourage positive community impacts.
The projects socio-economic monitoring program shows substantial
economic and employment benefts to the region and a strong safety

The project is scheduled for completion in 2015.

Its a vital part of Nelsons identity as a community that
values its past, but Streetcar #23 may have never seen its
rebirth if not for the vision of a former Selkirk College
administrator who helped pluck the storied people-mover
from a pathway towards total disappearance.
In 1981, Bruce Meldrum was the principal at Selkirk
Colleges Silver King Campus and in his spare time took
on the role of president of the Nelson & District Chamber
of Commerce. When Meldrum caught wind of the rum-
blings to rescue the dilapidated streetcar from the back-
yard of a property on the North Shore of Kootenay Lake,
he quickly be-
came involved.

Sergei and Nikolai Saratovsky will play music by Moz-
art, Schubert, Mendelssohn and Tchaikovsky and will
conclude the concert with an arrangement of Carnival

Born in Karelia, Russia to musical parents, the Sara-
tovsky brothers began their musical studies at presti-
gious Russian music schools and have established inter-
national reputations as soloists as well as their specialty
of piano four hands.
Te Saratovsky Brothers concert is Friday, October
24, 7 pm at St. Andrews United Church. Admission is

industry and primary resources. Unemployment was
high and the future was uncertain in a community that
had witnessed the recent closure of its waterfront mill.
Meldrum and those behind the Streetcar #23 pro-
ject saw an opportunity to not only restore the vehicle,
but put people to work. In November, 1982 the streetcar
was moved to the Silver King Campus where it could
be safely housed while the restoration took place. Using
job creation programs from senior levels of government,
the group managed to secure funds to hire unemployed
workers to undertake the task.
In 1988, a grant was secured to construct a building that
would house the now refurbished streetcar on the corner
of Hall and Front streets. Te building was pre-fabricat-
ed on the Silver King Campus and then constructed on
the site. In February, 1988 Streetcar #23 was moved to the
new location where it was put on display for the public to
see. In the frst six weeks, more than 1,700 people came
through to check out the impressive restoration.
It took a few more years for community leaders to pre-
pare and raise funds for the waterfront route which Street-
car #23 currently runs. On July 1, 1992 the community
fnally realized the rebirth of a cherished piece of hist-
ory. On that opening day more than 800 people rode the
streetcar along Nelsons majestic shoreline.

Te Nelson Public Librarys outreach service to Slocan
Valley, mobile collection will return to Winlaw School
from 3 to 7 pm every third Tursday of the month in Oc-
tober and November 2014 and from January to June 2015.
Residents in Regional District Area H South can sign up
for Nelson Library memberships at no cost (a portion of
your property taxes helps subsidize the cost of library ser-
vices). Members are welcome to browse the mobile collec-
tion and to check out books, DVDs and CDs. Our know-
ledgeable librarian will also help you learn to use online

Rose Hodwitz grew up in a communal living environ-
ment and feels perfectly suited to the home-like, mixed-
age classrooms at the Whole School. She has worked as a
teacher, teachers assistant and support worker since 2003.
She is also a local potter.
Tese new teachers are joined by Jose Corrigan, the
schools new administrative coordinator. Jose, also a
trained mediator with an Masters degree in alternative
dispute resolution, has lived in the valley for over 14 years.
Anniah Lang continues to bring her expertise to the
Whole School using the Circle of Courage model a posi-
tive youth development model based on the universal
principle that to be emotionally healthy all youth need a
sense of generosity, independence, belonging and mastery.
Te Whole School combines attachment theory and
the Circle of Courage with multi-age, small classroom siz-
es to support each student to excel at their own pace, and
we have never turned a family away for lack of funds, said
Anniah Lang.
Te Whole School has a vision of sharing the Circle of Cour-
age philosophy with other related child and youth groups in
our community. Te school strives to create a nurturing and

Games Day Kicks of Curling In Kaslo
Te Kaslo Curling Club hosted a free, fun Games Day
and Open House on Saturday, October 4 to kick of the
2014-15 curling season. Guests worked up an appetite and
won cash prizes at the darts, Wii dance and egg race con-
tests before enjoying a BBQ and yummy desserts.
Our goal was to bring new faces into the club, so we
are very pleased that 25 non-members came out and we
were able to get 21 of them on the ice. Twelve courageous
souls delivered their very frst curling rock afer receiving
some instruction. Te draw to the button contest brought
even more people out and the non-members outscored
the club members, showing How hard can it be? Mona
Zilkie won the $100 draw to the pin, while Gerry Mc-
Mahon won $50 for second closest.
