COMPLAINT AFFIDAVIT
The UNDERSIGNED COMPLAINANT respectfully states:
I, LITO V. LEGITIMAS, of legal age, Filipino, married and a resident of
Brgy. Capoocan, Calbayog City, after having been duly sworn to in accordance
with law, hereby files Administrative Complaints against:
PSINSP AARON RAEMON A. ELAGO, of legal age, Filipino, presently
assigned with Intelligence Unit PPSC Calbayog City or Catbalogan City, for
GRAVE MISCONDUCT and SERIOUS DISHONESTY, committed as follows:
1. That in his Joint Affidavit of Arrest executed on June 7, 2013 and
subscribed and sworn on June 18, 2013 before Atty. Jennylyn D.
Sumagang-Durmiendo, PSINSP Elago attested that I was the driver of
one (1) Hino truck, green color, bearing plate number RHA 668 and
engine number H07D-A44042 owned by Jesus delos Reyes;
2. That the said truck was allegedly intercepted and confiscated on May 22,
2013 at Brgy. Carmen, Calbayog City, because it was allegedly loaded
with illegally sawed lawaan trees by virtue of an intelligence driven
operation by the unit of PSINSP Elago and others;
3. That in the same Joint Affidavit of Arrest, he further attested that I
intentionally bumped the unmarked gray Mitsubishi Adventure with
plate number ZPZ 796, used by the police authorities; PSINSP Elago
further attested that I fled from the authorities;
4. That it was physically impossible for me to have done the said acts
because I was, more or less 649 Kilometers away, in Manila at the time
that the alleged arrest/confiscation occurred;
5. That the attestations of PSINSP Aaron Raemon A. Elago was the
distortion of the truth in a matter of fact that is relevant to him for the
reason that he knew of me because I personally delivered several monies,
termed as SOP and a laptop computer to him from Rebecca T. Delos
Reyes for some unknown transaction between them;
6. And this is the sole reason why I was named in the Joint Affidavit of
Arrest even if I was nowhere near the place of the incident;
7. That the attestation of PSINSP Aaron Raemon A. Elago in the abovementioned Joint Affidavit is malicious, wrongful and improper act,
motivated by premeditated and intentional purpose.
Thus the said acts and attestations of PSINSP Aaron Raemon A. Elago is
an administrative offense as contemplated in NAPOLCOM Memorandum
Circular 2002-010. Furthermore, that said attestation of PSINSP Aarom
Raemon A. Elago is prejudicial and wholly damaging to my reputation as a law
abiding citizen.

I, LITO V. LEGITIMAS, of legal age, Filipino, married and a resident of
Brgy. Capoocan, Calbayog City, after having been duly sworn to in accordance
with law, depose and say that:
1. I am the Complainant against PSINSP Aaron Raemon A. Elago of
the Intelligence Unit PPSC, for the Administrative Offenses of
GRAVE MISCONDUCT and SERIOUS DISHONESTY;
2. That I caused the preparation of the foregoing complaint;
3. I have read the contents thereof and the facts stated therein are
true and correct of my personal knowledge and/or on the basis of
copies of documents and records in my possession;
4. I have not commenced any other action or proceeding involving the
same issues in the Supreme Court, the Court of Appeals, or any
other tribunal or agency;
5. To the best of my knowledge and belief, no such action or
proceeding is pending in the Supreme Court, the Court of Appeals,
or any other tribunal or agency;
6. If I should thereafter learn that a similar action or proceeding has
been filed or is pending before the Supreme Court, the Court of
Appeals, or any other tribunal or agency, I undertake to report that
fact within five (5) days thereto to this Honorable Office
