PROCEEDINGS 9665 OF 2007, 9263 AND 10222 OF 2008 AND 3731 AND 3766 OF 2009
1. I refer to the fourteen letters that I received from the Legal Services Commissioner's Office last Wednesday
23 September 2009. Thirteen of these letters listed you as the relevant contact officer.
2. I have already responded to Ms Marles (both as Legal Services Comissioner and as chief executive of the
Legal Services Board) by letter dated 24 September 2009 as regards three of those fourteen letters. I shall
forward a copy of that letter to you by separate facsimile as you are listed as
3. As to the other 11 letters, each of these is in a standard format, including the notations 'PA Let03' in your
reference line.
a. Please explain to me why, since my initial complaint against Ms Marles in January of this year, your
Office continues to fail to apply whistleblowers protection proccedures which it is lawfuly required to
do?
b. Please explain to me why these 14 letters do not constitute a fifth set of unlawful reprisal actions
contrary to mandatory whistleblower protection laws which apply to your Office?
c. Each letter:
i. notes that I have during the course of this year (and in some instances, over the past 18
months) filed extensive complaint materials with your Office;
ii. requests that I summarise and restate my complaints for you as you lack the capacity to
understand these complaints [I encourage you to read the Victorian State Ombudsman's

report on his investigation of the 95 complaints against your Office for similar lack of
competencies – as per his pithy report in his Annual Report for 2008-09].
iii. requests that I fill in 11 standard forms containing information which (as your letters note) you
already have in respect of my complaints;
iv. specifies that I must respond with all of this repeated information within 16 days – a tall task
even apart from the fact that it took these letters (all but one dated 11 September 2009) some
12 of those days just to come into my possession (for reasons not just of sloth in your mailing,
but also due to 'firebomb and snailmail' problems as I described in my letter to your office of
30 May 2009.
4. Clearly, your thirteen letters are weak attempts to find an excuse not to investigate my complaints. I needn't
voice any more clearly, I would hope, my concerns about bias, lack of independence and lack of
competence indicating your office's determination not to exercise its regulatory powers and duties for the
purposes of protecting the public from rogue barristers and solicitors. Not just the Victorian State
Ombudsman, but the State and Federal Attorney-Generals too have made similar comments about the
deficiencies of the Victorian Legal Services Commissioner, and the defiiciencies amongst barristers and
solicitors in this State, which your office has allowed because of its anti-regulatory and pro-protectionist
stance towards such rogues. In this regard, paragarph 4 of youdr 'PA Lett03' series of letters continues to
wrongly assert that an incorrect 1993 unreported decision of a single supreme court judge Delahunty v
Howell and Mann takes precedence of section 6.3.2 and indeed the entirity of the 2004 Act of parliament
known as the Legal Practice Act 2004. Old judge law prevails over new parliamentary laws? Just where
exactly did you, let alone Ms Marles study law let alone pass any of the required examinations.
5. I am in the process of finalising an Affidavit which will outline in greater detail my complaint about Ms Marles.
I shall provide this to you before the end of this week. My affidavit, including relevant passages of
comments by another single supreme court judge as recently as December 2008 and Febrruary 2009
confirms that the Victorian parliament has the powers to pass laws (say the Legal Practice Act 2004) that
prevail over old judge made laws (say Delahunty v Howell and Mann). Those comments, by Justice Kaye
during the course of Cressy v Johnson (parts 1, 2 and 3) also demonstrates the mischief caused by your
misdirections as per paragraph 4 of your 'Lett03' that concerns relating to current proceedings must be, and
can only be, raised during the course of those proceedings.
6. I shall also provide to you this week a pithy summary of the more heinous crimes committed by Graeme
Devries of the Victorian bar, a criminal of the bar who totally epitomises the 'sharks with wigs' label that
unfortunately dogs all members of the Australian legal profession, because of his gross misconduct and the
because of the gross misconduct of lip-service regulators like your office.
7. I shall respond to the other ten letters from your office as soon as practicable.

8. In the meantime, I look forward (joke) to receiving contact from your designated welfare officer and
confirmation that my complaints will be independently heard (joke) in accordance with whistleblower
protection laws binding on your organisation.
9. I suggest that once those steps have been completed, it might be of assistance to you [without detracting
from your organisation's lega l obligation to carry out investigations] if I meet with you (whether in person or
by telephone) and I can perhaps talk you through the extensive complaint materials so that you might begin
to understand them.
