I , Patrick - Richard : Potter , am not a persona designate nom de guerre or a CORPORATE
NAME FOR PROFIT , or employee of the " STATE OF NEVADA " or the “ UNITED STATES ” .
I am a good and Lawful Christian , MAN on the land at or in the geographical Nevada Republic ,
a private un-enfranchised individual and a neutral party with all unalienable rights reserved , to
include , but not limited to , the rights to life , liberty , property , the right of avoidance arid all other
rights and freedoms granted by GOD , and contained within the protections of " The Constitution
for the United States of America " and " The Constitution for the State Of Nevada ". I Patrick-
Richard: Potter am a common people ( singular ) of the sovereignty preceding the United States
which authorized the Declaration of Independence for The United States , anno Domini 1776 as
evidenced therein the Preamble of the Constitution for the united-States of America - 1787, and
which authorized the formation of the aforementioned country and state and their governments . I
am also a Common People of Nevada not subject to the admiralty - maritime , statutory-
legislative , commercial-contractual and/or equity - venue and jurisdiction thereof the STATE OF
NEVADA , absent proof of claim thereto . I am the secured party creditor of POTTER
PATRICK , PATRICK RICHARD POTTER , PATRICK POTTER and all other versions of said
fiction ( as set forth therein all Las Vegas Metropolitan Police Department - Temporary Custody
Record(s) , in the upper left hand corner under ‘ Intake Name - AKA , ALIAS , ETC. ’ in relation to
CCDC I .D . # 1506532 . [Also see True Name , same line on the right thereof .] ) , see U.C.C. - 1
filing with DEAN HELLER - SECRETARY OF STATE - NEVADA # 0103112 - March 5,2001 a.d.,
and I am conditionally accepting all offers without prejudice .
NOTICE IS HEREBY GIVEN.

Waiver of tort
I hereby declare Do Not Trespass on my body , my unalienable God given Rights , my
private property , my labor , document of limitation upon Government known as The Bill of Rights
or the Constitutional rule of the Law . Waiver of tort . " The election , by an injured or aggrieved
party , for purposes of redress to treat the facts as establishing an implied contract , which he may
enforce , instead of an injury by fraud or wrong , for the committing of which he may demand
damage , compensatory or exemplary , " is hereby created . Definition in Blacks Law Dictionary -
6th edition .

 Every Senator , Representative , Judicial Officer and uniform service is subject to an Oath of
Office contractual obligation , the performance of Office of public Trust under the United States
which is or should be secured by an Official Bond of surety to uphold , support , protect and defend
the Constitution for the United States of America , Constitution for Nevada and the Laws of same ,
and each has further sworn to the said Oath to follow the Constitutional Rule of the Law . Any
person who shall falsely take the said oath shall be deemed guilty of perjury , Conspiracy against
rights , Deprivation of rights under color of law ; and on conviction in addition to the penalties
now prescribe for that offence , shall be deprived of his/her office , and rendered incapable
forever after of holding any office or place under the United States . 5 U.S.C. § 8312 .
If any person , employee or officer of the court known to me as Sworn Officers Of The
LAW, shall choose to proceed to injure or aggrieve , violate , trespass or forcible trespass upon me
, my rights , or my private property by ACTIONS CONTRARY TO , or INFRINGING -
TRESPASSING on my GOD GIVEN , CONSTITUTIONALLY PROTECTED RIGHTS and or
to act willfully and under color of Law to deprive me of my rights protected by said Constitutions
, the implied contract noticed herein as " Waiver of Tort ", at my option , is in full force and
effect . By such acts and/or actions , all actors offer, and are subject to , the following contracted to
terms . " An implied contract is one , the existence and terms of which are manifested by conduct .
The Constitution for the United States of America clearly states at Article I Section 10 , " No State
shall . . . pass any . . . Law impairing the Obligation of Contracts ." By proceeding beyond this notice ,
actors knowingly , willingly and intentionally offer and agree to become subject to the terms of
this NOTICE OF Waiver of Tort .
1. For each injury , damage , violation of rights , uncompensated for labor and/or trespass it is offered
and agreed by said actors that payment will be made upon demand in the amount of $l00,000 (one
hundred thousand) dollars per day so long as the injury , damage , violation of rights ,
uncompensated for labor and/or trespass remains , continues and/or persists and/or , at my option , I
will proceed to remedy via commercially and/or bring suit under Tort Laws - 18 U.S.C § 241,
242 . 18 U.S.C.§ 1621. 5 U.S.C. § 8312. 5 U.S.C. § 3331 and/or under NRS 282.010 - 282.060 , also ,
2. After seven days , if trespass persists , it is offered and agreed by said actors that payment will
be made upon demand in the amount of $250,000 (two hundred and fifty thousand) dollars , per
injury and/or violation of rights and/or trespass , per day , and/or labor claim thereto ,
$ 2,000,000.00 for each arrest , and/or labor claim thereto ,
$ 1,000,000.00 for each day of involuntary servitude , and/or labor claim thereto ,
$ 1,000,000.00 for each court appearance , and/or labor claim thereto , and/or -
I shall proceed to remedy as set forth herein .
3. If physical injury or damage to me or my private property or death occurs , it is offered and
agreed by all actors that payment will be made upon demand in the amount of $10,000,000 ( ten
million ) dollars payable to me , my Heirs or Assigns , as per and including above .
4. This contract shall be enforceable against all actors by all lawful means and is agreed to be an
immediate consentual lien without assignment against the assets , wages , bond(s) and property , for
benefit of the injured and/or aggrieved party - Patrick - Richard : Potter . All persons , employees and
or officers of the court , uniformed officers and/or attorneys are hereby given timely Fair Warning
Notice [ see ; U.S. -v- Lanier ] sufficient to warn any reasonable and prudent person not to injure ,

aggrieve , trespass on me , my rights , my private property or to act willfully and under color of
Law to deprive me of my rights protected by the aforementioned Constitution(s) . Proceeding
beyond this notice will show Acceptance of the Contract and supply evidence of your intent to
implement said contract and affix said consentual lien(s) without assignment and under Tort Laws ,
at the option of myself - Patrick - Richard : Potter .

Implied Waiver - [ Black’’s Revised 4th Ed. p 1752 ] A waiver is implied where one party has pursued such
a course of conduct with reference to the other party as to evidence an intention to waive his rights or the
advantage to which he may be entitled , or where the conduct pursued is inconsistent with any other honest

intention than an intention of such waiver , provided that the other party concerned has been induced by
such conduct to act upon the belief that there has been a waiver , and has incurred trouble or expense
thereby . [ Astritch v. German American Ins. Co., C.C.A.Pa., 131 F. 20 , 65 C.C.A. 251 ; Roumage v.
Insurance Co., 13 N.J.L. 124. ]
To make out a case of implied "waiver " of a legal right , there must be a clear , unequivocal and decisive
act of the party showing such purpose , or acts amounting to an estoppel on his part . [ Rosenthal v. New
York Life Ins. Co., C.C.A.Mo., 99 F.2d 578, 579. ]
Waiver of Tort - [ Black’’s Revised 4th Ed. p. 1752 ] The election , by an injured party, for purposes of

Implied Contracts - [ Black’’s 4th p.395 as follows ; ] " An implied contract is one not created or evidenced
by the explicit agreement of the parties , but inferred by the law , as a matter of reason and justice from their
acts or conduct , the circumstances surrounding the transaction making it a reasonable , or even a necessary ,
assumption that a contract existed between them by " tacit " understanding , and in some circumstances
even against his will and design . " ( emphasis added )
Contract - [ Black’’s Law Dictionary- Revised 4th Edition , p.394 ] a contract is defined as follows;
"CONTRACT. A promissory agreement between two or more persons that creates, modifies , or destroys a
legal relation ."
Written Contract - [ Black’’s Revised 4th p.397 ] of , a written contract is defined as follows ; "Written
Contract - A ‘‘written contract’’ is one which in all terms is in writing.", or nothing more than a promissory
agreement " in writing " !
Constructive Contracts - [ Blacks 4th p. 394 ] as follows: "Constructive Contracts are such as arising when
the law prescribes the rights and liabilities of persons who have not in reality entered into a contract at all ,
but between whom circumstances make it just that one should have a right , and the other be subject to a
liability , similar to the rights and liabilities in cases of express contract . " ( emphasis added )
Quasi Contracts - [ Black’’s 4th p.396 as follows ; ] " Quasi Contracts . In the civil law. A contractual
relation arising out of transactions between the parties which gives them mutual rights and obligations, but
do not involve a specific and express convention between them ." " The lawful and purely voluntary acts of
a man , from which there results any obligation whatever to a third person, and sometimes a reciprocal
obligation between the parties."(emphasis added)
CONSTITUTION OF THE UNITED STATES - ARTICLE 1, SECTION 10. " No state shall pass any
law impairing the obligation of contract ."
