MUMBAI: As the nation cheers with Anna Hazare, the CBI is still waiting for a go-ahead from
central agencies so that it can initiate criminal proceedings against 300-odd high-ranking
officials. These include a vice-chancellor, half-a-dozen additional and deputy commissioners with
the income tax department, top officials of Bharat Petroleum Corporation Ltd to name a few. As
per the Prevention of Corruption Act, the CBI has to obtain permission from the competent
authority to launch criminal proceedings against an official.
"Special reports were submitted to various bodies between January 2009 and August 2010, but as
of June 30, 2011, there has been no response. Most of the people we have named are still in
service,'' a senior official told TOI. "Around 35 officials are based in Maharashtra, and in a large
number of cases, the headquarters of the sanctioning authority, too, is in the state.''

For instance, the CBI booked 11 high-ranking BPCL officials in March 2009 from different
centres across the country and submitted a report to the director of vigilance, BPCL, Mumbai, on
August 20, 2010. But it has not accorded sanction to investigators. The central agency had booked
two senior deputy directors of the Pune-based Central Institute of Road Transport on charges of
corruption last year and sought permission from the director to launch criminal proceedings
against erring officials, but the proposal is gathering dust.
In May 2010, the CBI had booked over half-a-dozen senior officials with the Nagpur-based
Western CoalFields Ltd on charges of corruption. A proposal was submitted to the Chairman, Coal
India Ltd, Kolkata, seeking permission to initiate criminal proceedings against them.
In the case of a Pune-based vice-chancellor associated with Indian Institute of Science, the CBI
had registered a case against him on August 31, 2009 and submitted a proposal to the IIS on
December 2, 2010. But officials are still waiting for an answer.
"Even if the CBI books corrupt officials, there is a huge delay in granting permission to launch
criminal proceedings. The accused can take advantage of the situation: He gets time to pressurize
complainant and also intimidate him so that the case is withdrawn," said a senior IPS official,
adding that the Centre should withdraw the provision for sanctioning permission or allot a fixed
time-frame of six months.
