Sightings of Madeleine McCann (May 2008)

Request:  

1. How many alleged sightings of Madeleine McCann, the four year old who went missing in Portugal, have been reported in your area in the past 
year?
2. How many of these were formally investigated? 

Response by Sussex Police 
Section 1 of the Act places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1)(a) is to confirm or deny whether the
information specified in a request is held. The second duty at Section 1(1)(b) is to disclose information that has been confirmed as being held. Where
exemptions are replied upon Section 17 requires that we provide the applicant with a notice which: a) states that fact b) specifies the exemptions in 
question and c) states (if that would not otherwise be apparent) why the exemption applies. 

Sussex Police can neither confirm nor deny that we hold information relevant to your request as the duty in Section 1(1)(a) of the Freedom of 
Information Act 2000 does not apply, by virtue of the following exemptions: 

S30(3) Investigations
S40(5) Personal Information
S31(3) Law Enforcement 

We will not reveal detail relating to an investigation where such detail would be detrimental to an investigation. In this case, Madeleine McCann is still 
missing and the investigation ongoing. To release recorded sightings, if there have been any reported to police forces, throughout the United 
Kingdom would provide a geographical map of where the investigation is active and would seriously undermine the investigative process.  

Any disclosure under FOI is a release of information to the world in general and not merely to an individual applicant. Therefore, simply confirming or 
not that such information were held would publicly disclose geographical activity of a high profile international investigation.  

There is a requirement to consider whether there is any public interest which may overcome the harm in confirming or denying the existence of such 
information, which primarily hinges on investigations. It is rare that details of an investigation, as in this case confirmation of reported sightings of 
Madeleine, would be disclosed as law enforcement techniques would be compromised. 

As a separate example of where this harm could occur, the following fictional scenario is relevant. An FOI request, asking for confirmation of locations
in which drug dealing is prevalent within a force area would, if answered by confirming where these locations are, provide an awareness of where an 
offender feels it is safe to carry out drug deals as the perception would be that the police are not focusing on those areas. It could also undermine any 
covert investigations.

Therefore, at this time, the balance of the public interest favours maintaining our stance in being unable to confirm or deny that such information 
exists. 

No inference can be taken from this refusal that the information you have requested does or does not exist.
