BACKGROUND INFORMATION.
I started a Non-Profit mentoring program for At-Risk Rural and Inner City youth in
March 2014 called PARIS Angels which stands for Pairing At-risk Rural and Inner-city
Students with Angels. A few mentors and I held our first meeting on March 26th 2014 after
extensively recruiting over 200 students and non-students to join our effort at combatting
juvenile delinquency here in Southern West Virginia. The meeting took place on the Campus of
Concord University in Athens, WV where most of us were students.
We were approached on March 27th 2014 to cease all of our activities, we declined and I
was immediately arrested as the President of the organization to effectively end the program. I
have been burdened with this malicious prosecution for over eight (8) months and during this
time, we have had to go to the West Virginia Supreme Court of Appeals at least 8 times
including once for failure to release me on a fully posted bond, once to disqualify the Prosecutor
for sending falsified orders to the West Virginia Supreme Court of Appeals and once for the
violation of my right to a speedy trial.
THE ARREST
On March 27th, 2014, the Complainant was informed that Kendra Boggess, Marjie
Flanigan, and Rick Dillon wanted me gone from campus because of the Non-Profit program we
started. On March 28th, 2014, Kendra Boggess sent Dawn Smith a Concord University Police
Officer, to my wifes house to cajole her into making a complaint that I allegedly sexually
assaulted her on some unknown day in November 2013, even though my wife and I had been
separated since October 2013, and Dawn Smith knew my wife is mentally ill with Bipolar
Disorder.
On March 31st, 2014, the Complainant was arrested on a warrant issued the same day by
Magistrate Flanigan, authorized by Prosecutor Scott Ash and sworn to by Charlie Lowe. The
probable cause statement was falsified in that Charlie Lowe stated in it that:
1) He took the statement on March 21st 2014, even though the first day the allegation
was made was on March 28th 2014, and this was expressly disproved by the Court
Record;
2) He saw bruises and bite marks in March 2014 of an incident that allegedly happened
in November 2013 a five month period, which was also disproved by the official
Court Record.
Magistrate Flanigan knew that his wife was a friend of mine and my Law Professor and
Should not have used this warrant as a way of punishing me for being a friend of his wife. He
should have disqualified himself. Scott Ash authorized the warrant without any kind of
investigation whatsoever even though he knew that I was a Volunteer Firefighter, a McNair
Scholarship student and Mentor to At-Risk Youth. This would not have happened if there was a
Caucasian man involved.
CONCLUSION.
The Complainant has been discriminated against based on his race, ethnicity, nationality,
and religion. This action by the State actors amounted to unlawful termination since the
Complainant was employed at Concord University as a Tutor and as a Teaching Assistant at the
time of his arrest and should be investigated.
This treatment by the State actors only happened because the Complainant founded a
Non-Profit to combat the extremely high delinquency rate of Southern West Virginia youth.
These illegal actions are even more shocking given the positions of public trust that these
officials occupy.
The complainant respectfully implores you to investigate these matters. The complainant
was subsequently expelled in abstentia without any kind of due process whatsoever.
