There are many reason why Archbishop Apuron would want to remove andpubliclyhumilate
Msgr. JamesBenavente,andIdiscussmostoftheminthepages whichfollow.However,now
removed from the event by several months and given all that continues to happen, I now
believethefollowing:

Archbishop Apuron does not act on hisown.He actsonordersfromGiuseppeGennariniand

Fr. Pius Sammut. Given that both Gennarini andPiusknowthatArchbishopApuronstimeas
bishop of Guam is limited, whether it be due to health, age, or his removal, Gennarini has
movedtoassurethefutureofhisGuambasedpresbyterfactory.

In order to assure the future of the Redemptoris Mater Seminary in Guam, Gennarini needs
twothings:1)controloftheproperty,and2)controlofthebishop.

I believe he hasalready moved to gain control of the property by getting Archbishop Apuron
to assign control of the property to RMS under the guise that it is still owned by the
Archbishop. However, as I have demonstrated elsewhere, Archbishop Apuron, as per the
RMS Articles of Incorporation only controls 25% of RMS, whereas Gennarini and his wife
control50%ofit,andanotherneopriestcontrollingtheremaining25%.

Having assigned control of the property to RMS, a successor bishops hands are tied,
probably forever, since I believe Apuron has assigned the property to RMS forever or in
perpetuity.(You,dearvisitors,willhavetoascertainthatforyourselves.)

As for the control of the bishop, which has been easy to do with Archbishop Apuron,
controllingthenextbishopdependsontheirabilitytocontrolwhogetsthejob.

It is well known that Msgr. James Benavente has always been the most logical choice.
However, he is not neo and he is not friendly to the movement. Thus, he needed to be
eliminatedfromthepossiblecontenders.

There are many quieter waysArchbishop ApuroncouldhaveremovedMsgr.Jamesasrector

of the Cathedral if he wanted to. However, instead of the quiet normal way of doing these
things, Archbishop Apuron went to the media and blast Msgr. James publicly in a fullon
attempttodiscreditanddemeanhim.

This was obviously a response to an order from Giuseppe Gennarini. Archbishop Apuron
wouldnothavethoughtofgoingtothemediaonhisown.Thewholeuglyepisodewreakswith
aviciousnessthatnotevenArchbishopApuroniscapableof.

Make no mistake. The public trashingof Msgr. James Benavente andmostlikelyFr.Gofgian

as well, and everything else that has happened to both of them thereafter is absolutely the
result of a plan to get rid of the most likely candidates fortheofficeofbishopsothattheonly
possibilitieswillbeneos:AdrianandQuituguatheVG.

At 9:17 PM tonight, KUAM posted a story about

Benaventeasrector of the Cathedral.Hewasalsoremovedfromallhisotherministries

andarchdiocesanduties.

I just learned through another source that yesterday Archbishop Apuron had accused Msgr.
James of financial mismanagement. Msgr. James asked for a list of the charges and asked
fortimetoclearhisname.TheArchbishopagreed.

However, this morning, Msgr.David C. Quitugua,theVicarGeneral, and Fr.AdrianCristobal,

Chancellor, delivered a letter to Msgr. James removing him from his position as rector ofthe
Cathedralandhisotherduties.

It appears that Apuron needs a scapegoat. In 2012,afterApuron tried to give away the Old
Accion Hotel property tothe Neocatechumenal Way and was blocked bythe finance council
of which Msgr. James was amember, Apuron received a note from Rome directing an audit
onthearchdiocese.

The archdiocese'finances are in such a mess that Deacon DominicKim washeardtosayat

the recent meeting with the Apostolic Delegate that the archdiocese's finances were
"inauditable". And even though the projects overseen by Msgr. James weregiven a clean
bill of health by the Vaticanordered audit, Apuron is blaming Msgr. James for the
archdiocese'sfinancialwoes.

But of course this is all a big lie. Apuron is continuing his war against the nonneo priests,
which is exactly whatI predicted he would do after he agreed to "build bridges"attherecent
meetingwiththeApostolicDelegate.

Oh, and don't forget Apuron's insanejealousyof Msgr.James' close friendship withCardinal
Tagle.

The directory lists Archbishop Apuronasitspastor.HoweverArchbishop Apuronisthepastor

of the archdiocese of which the Cathedral is the central church. He is not thepastor of the
Aganaparish.Thatdutyisassignedtothe"rector".

However, according to canonist, Fr. Stuart MacDonald, JCL, it appears that Monsignor
BenaventeisNOTtherectorbutthepastor:

"Sometimes the priest who is given charge of theCathedraliscalledarector. It

seems to be an honourary title because he is the pastor of the Cathedral
parish...The cathedral church, besides being the seat ofthe bishop,canalsobe
a parish church...If the cathedral is also a parish, then, properly speaking, a
pastor is appointed to it. If the cathedral church is not a parish, then, properly
speaking,arectorisappointedtoit."

Dulce Nombre de Maria Cathedral is "also a parish church". Thus it is supposed tohave a
pastor,notarector.MacDonaldquotesCanon556toclarify:

Rectors of churches are understood here as priests to whom is committed the

care of some church which is neither parochialnorcapitularnorconnectedtoa
house of a religious community or society of apostolic life which celebrates
servicesinit.

The key words are "neither parochial". Parochial means "of or referring to a parish." The
Agana Cathedral is not onlylisted as a parish in the archdiocesan directory, italso functions
asaparishineveryway.

Thus, Monsignor Benavente's position at the cathedral,despitethemisnomer,cannotbe that

of a rector, but a pastor. And he, and NOT Archbishop Apuron, is the pastor of the Dulce
Nombre de Maria Cathedral parish, just as Monsignor Kevin Kostelnik is the pastor of the
Cathedral parish of the Archdiocese of Los Angeles and not Archbishop Jose Gomez, and
Monsignor John Talesfore is the pastor of the Cathedral parish of San Francisco and not
ArchbishopSalvatoreCordileone.

Also, Monsignor Benavente is the pastor not only becauseof this canonical technicality, but
also byvirtueof hisperformanceofparochialfunctionsintheAganaparishforthepasttwenty
years,functionsthatareotherwisenotpermittedtoarectorbyCanon558:

Without prejudice to the prescript of can. 262, a rector is not permitted to

perform the parochial functions mentioned in can. 530, nn. 16 in the church
entrusted to him unless the pastor consents or, if the matter warrants it,
delegates.

Here is the list of parochial functions which Can. 558 prohibits a rector from performing,
functions which Monsignor Benavente regularly performs, and performs thembecause his in
factthepastorNOTtherector:

1/theadministrationofbaptism

2/ the administration of the sacrament of confirmation to those who are in

dangerofdeath,accordingtothenormofcan.883,n.3

3/ the administration of Viaticum and of the anointing of the sick, without

prejudice to the prescript of can. 1003, 2 and 3, and the imparting of the
apostolicblessing

4/theassistanceatmarriagesandthenuptialblessing

5/theperformanceoffuneralrites

6/ the blessing of the baptismal font at Easter time, theleading of processions

outsidethechurch,andsolemnblessingsoutsidethechurch.

There are other dioceses whichseem to have made the same mistake as ours, assigning a
rector instead of a pastor to their Cathedral parishes. But, it is a mistake nonetheless, a
mistakewhichisclearlynotedintheNewCommentaryontheCodeofCanonLaw:

"The church entrusted to a rector may not be a parish church. In the United
States, the pastor of the cathedral is sometimes referred toasastherector,but
this is not a canonical term. In many countries the cathedral isnotaparishand
is entrusted to a rector inthesenseofthiscanon.However,intheUnitedStates
cathedrals areusuallyparishchurcheswellaschurchesforthediocese."(Beal,
John P., Coriden, James A., Green, Thomas J., The Canon Law Society of
America., [2000]. New Commentary on the Code of Canon Law. New York:
PaulistPress.Pg.735.)

Note: The Archbishop may argue that the Archdiocese of Agana is not part of the U.S.
conference. However, this doesn't matter, because it is his own directory thatliststheAgana
cathedralasaparish.

As pastor, Monsignor James has all the rights accorded to a pastor under Canon Law,
includingarighttotherequiredcanonicallyrequiredproceedingsfortheremovalofpastorsas
prescribed in Cann. 1740 1752, the same canons that Archbishop Apuron was forced to
complywithinhisremovalofFr.Paul.

The Archbishop will argue that he never formally installed Monsignor James as pastor and
only installed him as rector. But then that would mean that Archbishop Apuron has been
negligent inpermitting Monsignor James to performparochialfunctionswhich,asarector,he
wouldbeprohibitedbyCan.558fromperforming.

The fact is, of course, isthatthe Archbishopisnotconversant withCanonLawonthismatter

and it is not the fault of MonsignorJamesthathewas giventhewrongtitle.Formallyinstalled
or not, Monsignor James IS the de facto pastor of the Dulce Nombre de Maria Cathedral
parish.

And I stress IS because he CANNOT be removed by a mere letter of dismissal since

Archbishop Apuron is required to comply with the formal proceedings for the removal of a
pastorunderCann.17401752.

Thus, both the dismissal of Monsignor Benavente from the Agana Cathedral and the
appointmentof Msgr.David C. Quitugua as his replacement are both invalid andcanonically
illegal acts. And, Monsignor James Benavente, though he was illegally removed and
replaced,isstillthedefactopastoroftheAganaCathedralparish.

In order for Archbishop Apuron to justify his actions, he will have to discreditthe "de facto"
character of Monsignor Benavente' pastorship. This will be difficultfor him to do because in
addition totheadmissionofignoranceandnegligencealreadynoted,theArchbishop,himself,
isrelyingonadefactodesignationinhiscase againstFr.Paul,chargingthataSantaBarbara
parish volunteerwas ade facto employee eventwoyearsafterFr.Paulterminatedtheman's
actualemployment.


In short, Monsignor James Benavente has the same case as Fr. Paul. And he should
challenge the Archbishop as Fr. Paul has done. We hope hedoes. Meanwhile, many of us
are are finally fedup!WearesickofthisArchbishop'slawlessness.Wearesickofthiscruelty
and terrorizing of our priests. And we are sick of Archbishop Apuron's Neocrat masters
countingonGuamCatholicstoshutup,sitdown,andbehave.WEAREDONE!

MY RESPONSE TO THE PDN STORY: "CHURCH FINANCES IN

SHAMBLES"

Here'safewfactsfornow.NotthattheymattertoApuron.

The 7 million dollar debt was incurred in the building of the Saint Therese chapel and the
addition of the museum at the Cathedral. Both projects were approved by all the required
boards and councils and ultimately signed off on by Apuron,sinceHEistheonlypersonwho
candoso.

The loan is current and isamortizedover30years.Itisalsofairly recent.Andasanyonewith

a mortgage knows, the mortgagee makes little headway knocking down the principal for the
first several years. Apuron approved the projects with enthusiasm because they made him
lookgood.Therewillbemorefactstocome,butfornow:

1. A few weeks ago when the public demanded the publication of the diocesan financials,
Apuronwasplayinghideandseekbehindhisphony"let'smeet"invitation.

2. His press release here (referenced in the story) shows us that he not only has an audit
report,butitisanauditreportconductedbyamajoraccountingfirm.

3. Even if there is something wrong withMsgr.'sbooks,accordingtoApuron,theauditshows

that the rest of the diocese is healthy? Really? Then why didn't he just publish the audit
(conducted2yearsago)whenhewaspublicly asked todoso?Onewouldthinkthatgiventhe
criticismhewouldbeanxioustopublishtheauditbecauseitwouldmakehimselflookgood.

4. Msgr. James works financial miracles daily. The Aganaparishisthesmallestontheisland

simply because hardly anyone lives in Agana. Yet it is asked to pay the Archbishop's bills
every time he wants to have a personal party there. The power bill can run up to$1500 for
just a half day event.ApurongivestheCathedralnomoneytopaythisbill.Apuron'sownNeo
community meets at the Cathedral. Iftheyhadtopaywhatotherspaytocoverthepowerand
the use of the facilities, their bill would benearly$80,000ayear.They'vebeenmeetingthere
for over a decade multiple times a week. Yet, because Apuron himself is a member of the
Neo,theyhavepaidNOTHING.

Msgr. James, with the smallest congregation on the island finds a way to keep the largest
church on the island running in addition to paying for the massive construction projects that
theArchbishopsignedoffon.

5. Lastly, the Archbishop has run to the press to exonerate himself and condemn Msgr.
James when he has YET togive Msgr.James any evidence or proof ofthemismanagement
thatheaccuseshimof.Nowwhywouldthatbe?

The Archbishop has posted something called "Report from Deloitte and Touche" on its
website. The posting gives the average reader the impression that this is an official andfinal
report from D & T. It is not. It was a letter, datedJanuary8,2014,advisingtheArchbishopof
discrepancies that needed to be addressed as part of D & T's review of the Archdiocese's
finances.

As addressed today on the steps of the Cathedral, those discrepancies have already been
addressed, with only one to be addressed. In fact, in aletterdatedJune26,2014, onlyafew
weeks ago, Archbishop Apuron, in a letter to Msgr. James, recognized in writing that
"corrective action" had already been taken in order to prepare fortheJune30,2013financial
statements, andgave Msgr.JamestillAugust15,2014tosubmit thefinancialreportsfortheir
fiscalyearendingJune30,2014.Msgr.JameswasfiredonJuly25.

Just wondering after reading Diana's post....which I have copied and pasted here.It
was brought to my attention that Junglewatch claims to have three copies of the
Umatuna of last week, August 10th. Well, I also have one copy. The Umatuna was
withdrawn due to the fact that the report on finances was not complete, and much
worse things are coming out.Thatisthereasonwhyitwas recalledasfarasIknow.It
was also brought to my attention that the financial mess of the cathedral and the
cemeteries is much worse than we originally thought. More to come as soon as Ican
getmoreinformation.

I replied tothisinacomment,butlet'slookatit moreindepthhere.FirstDianaisFr.Edivaldo

(the pastor of ChalanPagoparish) and Holly Leon Guerrero (andnodoubtthereareothers).
Of course they are major neo's and they are seeing their empire collapsing around them so
we can expect them to become increasingly desperate. I really do hate to include Holly's
name, but until sheflatoutdeniesanyconnectionto"Diana"asMs.Blasdid,thenwehaveto
assumethatsheandEdivaldoareateam.

So we aretoldbyEdivaldoandHollythattheCathedralandtheCemeteryareevenmoreofa
mess. That wouldmeanthatDeloitteandToucheis inept.TheletterD&TsenttoArchbishop
Apuron on January 8, listed the discrepancies that needed to be addressed. Archbishop
Apuron used that letter to trash Msgr.Jameseventhough,aswenowknow,allbutoneissue
had been completely addressed even to the Archbishop's satisfaction as evidenced by his
letter to Msgr. James of June 26. And Msgr. James had until August 15 to address the
remainingissuebutwasfiredonJuly25.

That the chancery issaying that there is even more trash is to say that DeloitteandTouche
apparentlydidnotdoitsjobandthechanceryitselfhasfoundevenmorebadstuff.

So, let's say that they did. Let's say that Archbishop Apuron and his cronies have "much
worsestuffthatwillbecomingout",asEdivaldoandHollyclaim.Thenpleasetellus:

Whatsortofabishopwouldbe"comingout"atall?

 Whatsortof abishopwouldbe"comingout"withevidence ofmismanagementinorder

What sort of a bishop takes internal problems public without a single attempt to

What sort of a bishop goespublic with documentation that hewon't even show tothe
priestheisusingthedocumentationagainst?
What sort of a company manager would not want to handle his company's problems

What sort of a father would preferto smear his son in the press before tryingto work
thingsoutwithhisson?

We can only hope, if we are togive charity a chance, that Archbishop Apuronis severely ill
and must be immediately removed. Because if this is not the case, then we have abishop
whoisevilincarnate,andhewouldn'tbethefirstone.

As we now know, the first printing of the August 10 edition of the U Matuna, wasfrantically
retrieved and destroyed soon after it was made available for pickup around 4:PM, Friday,
August 8. We were told in a subsequent news story in the U Matuna the following weekthat
the reason for the scramble to retrieve the first printing and print a secondwas "because of
errors in the original print edition." Lies would be more like it. Lies the chancery thoughtthey
could(AGAIN)getawaywith.

Let'sreviewthetimeline:

July 31: The archbishop releases a statement to the media along with a seven month old
letter from an accounting firm detailing the accounting problems at the Catholic Cemeteries.
The archbishop's letter alleges financial mismanagement and is a response to the public
outrageoverhisambushfiringofMsgr.James.

August 6: The team of accountants tasked with addressing the concerns raised by the
accountingreviewholdapressconferenceand show evidencethatnotonlyhadtheconcerns
been addressed and all but one resolved, but that the archbishop had acknowledged the
progressinaletterdatedsixweeksprevious.

August 67: The chancery, again caught redhanded lying, fliesinto actionandmanufactures
a story for the Umatuna designed toprovokesympathyfor thearchbishop,castoppositionas
"hatespeech",anddiscreditthefinancialprofessionalswhospokeonAugust6.

August 8: It's4:PM,andthechancerybossesareuponthehillhavingavictoryparty,thinking
thatthey'vehitahomerunwiththeirhitpieceontheiropponents.

August 8, 4:09PM: A letter arrives. "OH $%##! BATTLE STATIONS, BATTLE STATIONS.
CALL OUT THE TROOPS. GET THOSE COPIES OF THE UMATUNA BACK NOW! MAN
THE PRESSES. DOWNLOAD SOME CUT AND PASTE STORY FROM THE CATHOLIC
NEWSSERVICEANDSLAPTOGETHERANOTHERPRINTING.DAMNIT.NOW!

Apparently, the archbishop and his fellas had no problem trashing men like Mr. Joe Rivera
and Mr. ArtIlagan,themenwhohadsaid"nothing couldbefurtherfromthetruth"inresponse
to the archbishop's allegations of financial mismanagement.Butthearchbishopandhisfellas
apparently felt differentaboutdealingwiththeauthoroftheletterwhicharrivedat4:09,Friday
afternoon.Wecan'texposethecontentsoftheletteryet,butuseyourimagination.

The retracted story is so full of lies that Ican'taddressthem all inonesitting,sowe'llhaveto

do this in parts. Here's the first. The text of the story is copied here for easy reading. My
comments are in red. A copy of the first part of the story from the original printing of the
August10UMatunaisatthebottom.

Archdiocesestatementreviewingfinancialconcerns

The Archdiocese of Agana wishes to reintroduce the July 29, 2014 statement
regarding the initial results of the Deloitte & Touche financial review on all the
financesoftheArchdiocese.

Really? The Archdiocese of Agana wishes..."??? Aren't WE the Archdiocese ofAgana? How
abouttheArchbishopoftheArchdioceseofAgana?

Numerous misrepresentationsarebeingcirculatedinthemediaandarecreating
uneasiness and confusion in the members of our Church. This is very
unhealthy. Some people have even voiced that they would like to oust our
Archbishop from his post, throwing insults and secondguessing the chief
shepherd:thisattitudeisnotcatholic.

Let's start with "numerous misrepresentations...being circulated in the media." The onlything
at this point circulating in the media, besides the archbishop's own above referenced press
statement, was what was said at the press conference held by Mr. Joe Rivera and Mr. Art
IlaganonAugust6.

At the conference, these men who had been tasked to address the concerns raised by the
financial review, hadstated that the archbishop's allegations were untrue and "notsupported

worked with them of ignorance, or worse, deliberately lying. Now who are you going to
believe? An archbishop that has been caught in lie after lie after lie, or these men whose

And really? "Second guessing the chief shepherd"? Not catholic? Really? Aside from all the
lies relativetothefiringofFr.Paul,thecanningofAaronQuitugua'svocation,thealienationof
the Yona property, and the smearing of Msgr. Benavente,may we remindyouthatour"chief
shepherd" was second guessed by Rome itself in 2012 in a letter from thenApostolic
Delegate, Archbishop Charles Balvo? And how about our "chief shepherd" himself publicly

Worship and the Sacraments? And you're going to tell us that our little inquiry is NOT

This hate speech can even drive people to violence and in fact some people

"numerous misrepresentations" was held on Wednesday, August 6. The Umatuna, at the

"misrepresentations" to slash the archbishop's tires, one would have had to see the news,
slash the bishops tires, give you time to write a story about it, and get the paper off to the

The facts are the following: after the adviceofCardinalFiloni,currentPrefectof

the Vatican Congregation for the Evangelization of Peoples, the Archdiocese
embarked in 2012 on an extensive auditof all its assets. In the past, already in
2005, we had tried to begin an auditing process but the administration of the
CathedralBasilicahadvehementlyrefusedtocooperate.

Thisishilarious.Therewasno"advice"fromRome.Itwasanorder,anorder promptedbythe
complaints ofthefiredfinancecouncilmemberswhohadobjectedtothearchbishop'sattempt
to illegally hand over a decamillion dollar asset to the control of the New Jersey syndicate

thenApostolic Delegate, Archbishop Charles Balvo, for his failure to produce financial
statements, once in 2011 and again in 2012. Balvo had stated in both letters that he had
"neverreceived"therequiredstatementsfromtheArchdioceseofAgana.

I published the2012letterfromArchbishopBalvo onmyblogonAugust6,thedaybeforethis

edition of theUmatuna went to print. Guess when Archbishop Balvo wasappointeddelegate

mud? Why is he hell bent on destroying this man and grinding every last memory of him

men do such things. Only men caught in irreversible lies lash out this insanely. However,in

asked to resign immediately and if he did not resign immediately, Archbishop Apuron
instructedhimto"supplyyourreasonsassoonaspossible".

Fr. Paul was not given theopportunityto"supply(his)reasons assoonaspossible",because

upon his return to the parish he found himselflockedoutofhisoffice,instructedtovacatehis
residence, strippedfromthe schedule of presiders, andon thefollowingday,"fired"aspastor
andreplacedbyaparochialadministrator.

In doing all this, Archbishop Apuron violated ALL the norms ofchurchlaw forthe removal of
pastors. Fr. PaulhadZEROopportunitytodisobeyevenifhe wantedto.Fr.Paul'sonlyaction
was to take recourse against these illegal actions by Archbishop Apuron through the
canonicalproceduresthatheisaccordedunderchurchlaw.

SoWHOisbeingdisobedient?

In the case ofMsgr. James, Msgr. James was summoned to the Archbishop's office, read a
list of charges, removed as rector of the Cathedral, removed as Director of the Catholic
Cemeteries, and dismissed as Director of the Archdiocesan Development Group which the
Archbishopdissolvedonthespot.

Msgr. James' only action was to ask for a copy of the charges. Archbishop Apuron denied
Msgr. James his request and instead published the charges twice inthe U Matunaandeven
sentthechargestothesecularmedia.

Like Fr. Paul, Msgr. James had no chance to disobey and did not disobey. He left the
Cathedral asordered.Hestillhasacanonicalrighttoappealhisremoval,butasyetthatdoes
notseemtohavehappenedformally.

SoWHOisbeingdisobedient?Whoisbeingpersecuted?

Neither of thesepriests have been givenanyformalopportunitytorespondtotheArchbishop

or his charges against them. Meanwhile, he has tried and hung them in a very public way,
even going beyond the initial charges and doing everything he can to besmirch their
charactersandreputations.

People have begun walking out of Masses where the Archbishop and these neopresbyters
launch into their little personal tirades about disobedient priests and the persecution of the
poorArchbishop.Theyknowit'salie,andatMassnoless.

Myfirstimpulseistoencourageyoutowalkoutandkeepwalkinguntilyoufindanotherparish
where the Holy Sacrifice of theMass is not prostituted in this way. However, I have a better
