CASE SUMMARY:
PROCEDURAL POSTURE: Appellant sought review
of the order of the United States District Court for the
Central District of California that dismissed his
complaint against defendant, the Federal Reserve Bank
of San Francisco, under the Federal Tort Claims Act, 28
U.S.C.S. 1346(b), for lack of subject matter
jurisdiction.
OVERVIEW: Appellant was injured by a vehicle owned
and operated by Los Angeles branch of the Federal
Reserve Bank of San Francisco. Appellant sued in
district court alleging jurisdiction under the Federal Tort
Claims Act (FTCA), 28 U.S.C.S. 1346(b). The United
States, defendant, moved to dismiss for lack of subject
matter jurisdiction. Lower court dismissed, holding that
Federal Reserve Bank was not a federal agency within
meaning of FTCA and that it lacked subject matter
jurisdiction. Appellant sought review of dismissal. Court
affirmed. Court noted a critical factor for determining
whether an entity was a federal agency within meaning
of FTCA was existence of federal government control
over detailed physical performance and day to day
