MUNICIPAL RESOLUTION NO. 05-2013

EXTENDING THE PERIOD OF RENEWAL OF TRICYCLE
FRANCHISES UNTIL FEBRUARY 28, 2013, WITHOUT THE
IMPOSITION OF PENALTIES/SURCHARGES.

WHEREAS,
the
granting of extension of the period for the renewal of
tricycle franchises until February 28, 2013 is grounded on
the premise that the period for such renewal is due to end
on January 31, 2013 and yet some of their members are
still having difficulties in raising the much needed money
for the payment of their fees and dues;
WHEREAS,
it is the mandate of this august body to regulate the
operation of tricycles and grant franchises for the
operation thereof within the jurisdiction of the
municipality, subject to the guidelines of the Department
of Transportation and Communications, and in view
thereof, providing for such extension of period of renewal
until February 28, 2012, without imposing any
penalty/surcharge, is gleaned by this august body as just
and reasonable;
WHEREAS,
taking into consideration the difficult times that our
tricycle franchise operators are undergoing and yet,

without hesitation, continuously and unabatedly provide

basic transportation service for the benefit of our
constituents in terms of the transport of goods and
passengers, such extension is considerably or liberally
understandable;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled, to grant as it
hereby grants the extension of the period of renewal of
tricycle franchises until February 28, 2013, without the
imposition of penalties/surcharges.
RESOLVED FURTHER, that after the lapse of the period of
extension, failure of tricycle franchise operators to renew
their respective franchises shall be subject to the usual
process of cancellation.
RESOLVED FURTHERMORE, that a copy of this resolution be
furnished the different Paradas of the municipality, the
Task Force Kaayusan and the Municipal Treasurer, for
their information and appropriate action.
APPROVED UNANIMOUSLY, on motion of Councilor Juris L.
Villareal and duly seconded by the members present this
11th day of February, 2013 during their 6th Regular
Session.
