Committee noted that the proposals of sand dredging, stone quary etc are received from
different districts.
It is also brought to the notice of the Committee that the application form submitted by the
above proponents as per EIA Notificaiton, 2006 are not duly filled and without any required
information such as lease deed, project cost, available reserves, ecology of the region, details of
minerals extracted, impact on environment, mitigation management plan, a large scale layout plan
showing the site with approach roads etc. A prefeasibility report is also required along with the
statutory clearance from concerned authorities. These applications are usually submitted
individually without any consideration for other nmearby proposed activities. The Committee
deliberated on all issues related to environment, including air, water, land, soil, ecology and
biodiversity and social aspects.
The committee is of the opinion that although there may be different mining activities
having area less than 5 ha for individual proposal, cumulative impacts of all activities, including
sand dredging, stone quarying etc., on the environment of that area has to be considered. This
cannot be done if the proposal appraised individually. Therefore, in the interest of environment
protection and speedy disposal of the applications, the competent authority (say District
Collector), who finally grants or renews the lease of such proposals shall submit periodically the
proposals showing all the proposed activity on one map, with details like reserves of minor
minerals, overall extraction done in recent time, management and monitoringof extraction and
addressing all issues related to environmental impact. This may be done through an accrediated
consultant.
Thus the Committee recommends following suggestions for orderly and quicker disposal of
such applications received:
1. The information furnished in Form-I shall be duly certified by the District Collector or the
competent authority nominated by the District Collector. Information in Form 1 shall have
all details listed above.
2. The applications shall be channellised through the Collector/ Mining Officer with NOC.
3. Environmental impacts due to existing activities and proposed activities shall be
incorporated into the combined proposal.
4. Information regarding any illegal mining and abandoned mining shall also be provided to
Environment Department as they very much impact the environment.
5. The application shall contain prefeasibility report, large site plan, layout plan etc as
indicated above.
6. However, each case will be taken up for appraisal separately..

Minutes of the 58th meeting of the SEAC held on 1st to 4th August, 2012
SEAC noted the Hon HighCourt decision dated 28 June 2012 in Public Interest Litigation no.115
of 2010 with Civil Application no.143 of 2010 and Civil Aplication no.87 of 2012. As per the
Honble High Courts decision, SEAC decided to appraise the project afresh only after PP
submitting the application in the prescribed format as per EIA Notification, 2006.

Minutes of the 58th meeting of the SEAC held on 1st to 4th August, 2012
Item No. 1
Subject: TOR for the proposed 19.8 MW Bagasse Based Cogen Power & Sugar
Modernization Unit (5000 TCD to 7500 TCD) at Venunagar, at Post Gursale413304, Tal. Pandharpur, Distt.Solapur by M/s. Shri Vithal Sahakari Sakhar
Karkhana Ltd.
(SEAC 2010/ CR-849/TC-2)
Decision:
The case was discussed for grant of ToR for Bagasse Based Cogen Power & Sugar
Modernization Unit (5000 TCD to 7500 TCD). SEAC also noted that this is a proposal for an
expansion of the existing 14 MW bagassae based power plant to 33.8 MW capacity. As per
Clause 2(ii) of the EIA Notification, 2006 Expansion and modernization of existing projects or
activities listed in the Schedule to this notification with addition of capacity beyond this limit
specified for the concerned sector, that is, projects or activities which cross the threshold limits
given in the Schedule, after expansion or modernization will be classified as A Category.
Considering this, SEAC decided that the expansion of Cogen power plant falls under Category
A and in the jurisdiction of MoEF. The proposed expansion of the sugar plant is interlinked
with the Cogen power plant hence PP is advised to approach MoEF for EC for both expansions of
sugar and cogeneration plants.

Decision:
The case was discussed on the basis of the presentation made and documents submitted by the
proponent. All issues related to environment, including air, water, land, soil, ecology and
biodiversity and social aspects were discussed. The PP is directed to comply with the following
observations:
1. The Committee noted that the existing right of way is limited to 9 m, however there is
proposed DP road of 24 m width. It is not clear when the DP road will be built and the
project cannotbe considered until the 24 m DP road is constructed. However PP has
agreed to undertake that, in case there is any delay in construction of DP road, PP
would construct the same at his own cost, without which OC may not be issued.
2. Deduction of 9 m road in netplot area and additional deduction of some part of 24m
road shall be clarified with a detailed note and supporting documents.
3. Relocate STP and underground water tank/s to a suitable location close to building.
4. Staircase width shall be at least 1.5 m.
5. Submit a detailed note and flowchart on water budget calculations.
6. Provide minimum 9 m road width of internal roads for ease in fire tender movement
and submit the revised drawings.
7. Design appropriate Rain Water Harvesting system and Storm Water Drainage system
as per the hydrogeological and geotechnical study data and conditions and submit the
details with large lay out drawings.
8. Draw up a sustainable model with appropriate EMP, as the proposed EMP budget is
inadequate.

Decision:
SEAC discussed the issues raised in the previous meeting. It is noted that PP has obtained NA
permission only for 48,000 m2 out of total plot area of 1,13,530 m2. The project location is in the
rural area and NA is a prerequisite before the commencement of the project. The PP informed that
the revenue authorities had instructed them to obtain EC for the entire project in order to obtain
NA permission for the rest of the plot area. SEAC is of the opinion that prior EC is not
precondition for NA permission. Process of NA conversion involves land use change and NA also
prescribes the zoning and FSI applicability. Therefore, PP is advised to phase the project on the
basis of currently available NA plot or obtain NA permission for the entire plot.
Detailed appraisal of the project will be done after the submission of the above said data.

Effluent from the factory will be collected in the Collection
tank by gravity drains. The Collection tank has aeration grids
provided for the proper mixing of the waste water.
From this chamber effluent will enter into Oil & Grease Trap
where oil will be separated from the effluent.
Oil free effluent will be then collected in to primary tank.
From Primary tank effluent will be taken into Neutralization
Chamber of 7.5 m3 capacity where pH of the effluent will be
check. If pH of the effluent is alkaline then HCl will be added
in the effluent for neutralization. If pH of the effluent is acidic
then NaOH will be added in the effluent for neutralization.
Alum will be added into the effluent for coagulation of
suspended solids which will lead in the formation of flock in
the effluent.
This effluent will be then taken into Primary Settling tank for
Sludge Settling.
Settled Sludge in the Primary Settling tank and Secondary
settling tank will be removed & sent to Press Filter. Filtrate of

Decision:
The case was discussed on the basis of the presentation made and documents submitted by
the proponent. All issues related to environment, including air, water, land, soil, ecology and
biodiversity and social aspects were discussed. The Committee noted that the EIA report
submitted contained many inconsistencies and errors. The Consultant/ PP shall ensure that the
revised EIA Report, which is in the revision of the earlier version, is free from inconsistencies and
errors. The figures in the EIA report are without any titles or references in the text. Therefore, the
Committee could not assess the EIA report properly. It was also noted that the plant layout
submitted was a sketch rather than an engineering drawing. The Consultant has already been
warned a few times to take care of such mistakes as such practices waste time of the entire
committee. The PP is directed to comply with the following observations:

biodiversity and social aspects were discussed. The proposal is for residential project as Phase-I in
a commercial zone with plot area of 73,417.86 m2.
It was noted that the project partially falls in the flying funnel of the airport and is located
about 1.5 km from the airport. However, the PP has received permission for 48 m building height
from the Airport authority.
The PP is directed to comply with the following observations:
1. PP is considering an FSI of 2 interpreting the statement N-2.7 (C) from NMC-DCR. This
FSI is applicable for a mixed project of residential and commercial. However, Phase-I is
only for residential. Therefore, the applicability of assumed FSI may be questionable. PP
may get a clarification on this matter from a competent authority.
2. Submit an undertaking to construt the proposed DP roads of 18 m and 30 m width on their
own cost. In case these are not constructed by planning authorities within the scheduled time
scale. If not EC will not be issued until DP roads are constructed.
3. Submit an undertaking to provide adequate RG for the planned commercial project in PhaseII as the PP has already provided full RG in the present residential project.
4. Submit the consent for water supply from a competent authority indicating the required
quantity.
5. PP has proposed a pond for storing 5 million ltr treated wastewater during rainy season.
However, considering the safety and water quality aspects, it is desirable to dispense off the
provision of pond and PP is advised to construct a sewage line up to the existing municipal
sewage line. Details of the same shall be submitted.
6. Relocate the UG tank for domestic water away from the UG tank for treated waste water /
flushing water.
7. Submit RWH calculations withhydrogeological and geotechnical details.
8. Provide cutouts in the building length for ease of fire engine movement. The obstructions
coming in fire tender movement such as STP, Power house shall be shifted suitably.
9. Submit details of compliance to ECBC / BEE guidelines.
10. Submit the ventilation and lightening scheme for the basements.
11. Superstructure staircase shall not be directly taken into basements.
12. Refuge area shall be strategically located so as to be accessable to all tenements.
13. Septic tank and soak pit to club house shall be avoided and the wastewater shall be treated in
the STP proposed.
14. Submit details of car parking proposed.
15. Total 550 nos of trees to be planted along periphery of plot as well as in the central
landscaping area.
16. Submit the consent for water supply from a competent authority.

approved in 2010 and most of the construction work was carried out during 2011. The Committee
noted that the PP / Consultant had not submitted the above said fact in the documents submitted,
including Form-I, but revealed it only during the presentation. Environment Department may look
into matter for the aforesaid violation and take necessary action for the misrepresentation of the
data and violation.
.
It was also noted that the PP has not obtained the consent for water supply from a
competent authority and no sewerage facility is available catering to the project. The right of way
to the plot is 12 m, whereas the height of the building is 36 m, which does not comply with the

found in many other cases. This violation may be noted by the Environment Department and
necessary action may be taken.
The PP is directed to comply with the following observations:

Decision:
The case was discussed on the basis of the presentation made and documents submitted by
the proponent. All issues related to environment, including air, water, land, soil, ecology and
biodiversity and social aspects were discussed.
PP stated that the construction work has already been initiated and Buildings A, B C and D
have been built. PP stated that he has handed over the amenity space to the Collector in lieu of
which additional FSI is claimed and the total built up area now exceeds 20,000 m2 and hence
applied for EC.
The Committee noted that the current approach road is 5 m wide and there is a proposed
DP road of 18 m width. The maximum height of the building is 37.25 m, therefore, the project
cannot be considered in light of MoEF OM dated 7.02.2012, until the DP road of 18 m width
is constructed. The PP has not obtained the consents for water supply and drainage facility
from competent authorities. In view of the nonavailability of the major prerequisites, SEAC
decided to recommend rejection of the proposal for Environmental Clearance

Decision:
In this case, PP informed SEAC in its 55th meeting that he has also applied for an expansion of
steel manufacturing from 3 MTPA to 5 MTPA capacity and CPP of 300 MW based on blast
furnace gas. Considering this, SEAC, in its previous meeting, advised PP to seek clarification
from MoEF whether the proposal for 50 MW and 300 MW power plant and the expansion of steel
plant have to be combined into one or not. PP has not submitted the clarification from MoEF in
response to Circular dated 22nd March, 2010. After delebration the Committee decided that the
project falls into Category A and the two proposals are interlinked. Therefore, PP is advised to
approach MoEF for EC.

Decision:
The PP had not submited the documents and the case was discussed on the basis of the
presentation made. The Committee noted that the Phase-I and Phase-II are completed and
apparently some portions of land have been conveyed to tenents. Form-I submitted by the PP
contained information only pertaining to Phase-III,. Cnsidering the expansion project of MHADA
plot, overall information regarding Phase-I and Phase-II are required. It was also noted that the
ground coverage Phase-III is 45.86% and the open space is less that 10%, which is grossely
inadequate for the entire project Phase I, II and III.
The PP is directed to comply with the following observations:
1. The access to the plot is 12 m DP road from 30 m highway and 24 m DP road on the other
side. The highest building in the proposal is of 50 m; for this atleast 24 m right of way is
required. Therefore PP shall furnish data regarding the right of way to their plot.
2. Submit DCR extract applicable to the provision of open space for Phase-I, II and III.
3. Submit revised Form-I, as there are discrepancies between the documents presented during
the presentation and Form-I.
4. The copies of standing orders of Govt. about mass housing and terms of conveyance deeds
as applicable may be furnished.
5. The DP plan submitted indicated that an adjoing plot also belonging to MHADA; this may
be clarified by furnishing a clear large scale DP applicable to the whole area in
consideration.
Site visit by SEAC may be made during its visit to Pune to assess the site conditions, if needed.
Full appraisal of the project will be done after the submission of the above said points.

Decision:
The case was discussed on the basis of the presentation made and documents submitted by
the proponent. The PP has submitted EIA report during presentation. It was noted that currently
10 m wide road exists; however, there are proposed DP roads of 30 m and 36 m on the sides of
the plot. The building has a setback for the proposed 36 m road widening. This needs clarification
with respect to the the time scale involved to complete the roads. Considering the building height
of 41 m, the PP has obtained NOC from CFO. The status regarding the disposal of treated sewage
by the ULB is not clear; hence it is not desirable to increase the pollution load. The location and
area of solid waste management facility are not rationally designed.
PP is directed to comply with the following preliminary observations:
1. Submit the consent for water supply and drainage system from a competent authority
indicating the time frame.
2. Submit hydrogeological and geotechnical design details and calculations of RWH system.
3. Relocate domestic water tank away from treated waste water tank.
4. Submit technical details of solid waste management facility w.r.t. collection, storage,
treatment and disposal.
5. Submit details of compliance to ECBC guidelines for the entire project.
6. More trees / more species of trees to be planted and shown on the landscape plan. Tree
cluster in and around the green areas 1,2 and 3 to be shown in the plan.
PP has submitted EIA report and the Committee requires time to study it. For a construction
project full details as per Form 1A are required. These may also be submitted
Full appraisal of the project will be done after the submission of the above details.

Decision:
The case was discussed on the basis of the presentation made and documents submitted by
the proponent. All issues related to environment, including air, water, land, ecology and
biodiversity and social aspects were discussed. It was noted that almost entire construction is
completed.
The original application was submitted on 16.02.2011 and it appears that PP has already
initiated construction although Form-I did not disclose anything about the construction initiated.
However, the revised Form-I, submitted during the appraisal, disclosed details of construction
completed. The Environment Department shall look into the violation and misrepresentation of
the information and take necessary action.
The PP is directed to comply with the following observations:
1. There is 9 m public road which PP has agreed to widen to 15 m at his own cost. An
undertaking regarding the same may be submitted.
2. Although PP has paid charges for water supply and drainage system, the consents for both
are yet awaited. PP shall submit the same.
3. Provide additional staircases for the buildings exceeding 50 m height.
4. Submit the details of compliance to ECBC/ BEE guidelines for the entire project. Solar
water heating system may be considered as a part of ECBC compliance.
5. Relocate domestic water tank away from STP and treated waste water tank.
6. Draw up a sustainable model with appropriate EMP, as the proposed EMP budget is
inadequate.

Decision:
The case was discussed on the basis of the presentation made and documents submitted by the
proponent. All issues related to environment, including air, water, land, soil, ecology and
biodiversity and social aspects were discussed. It was noted that both PP and Consultant were not
able to provide project details w.r.t water budget, treated waste water charastreristics, compliance
of norms pertaining to O&M of incinerator and such other data required to establish the current
status of compliance of the conditions prescribed by MPCB. Therefore, PP is advised to submit
the aforementioned data and approach SEAC with a draft ToR.
