ATTY FINCH: And good morning, Your Honor.

For the record, Attorney Kevin Finch. I

represent Sam Sorrentino.

THE COURT: All right.

And it looks like at the end of the Court

24

hearing on June 4th, the Court found the plaintiff --

25

no, the defendant, in contempt and ordered her to pay

26

a one thousand dollar fine today.

27

And you advised the clerk that you have those

monies today?

MS. SORRENTINO: Yes.

I thought that you said that I was supposed to

bring you proof of everything that I filed, which I

did, and also evidence that -- or evidence that I was

going to an organization to seek help because you

felt that the --

THE COURT: All right.

MS. SORRENTINO: -- motions -- there was a -- it

was a sign of mental illness of filing so many

motions.

THE COURT: Not mental illness but some sort


of -- some type of mental health issue.
But I did indicate that if you had brought some

15

sort of proof that youre attempting to curb this

16

type of behavior -- let me back up, maam.

The -- the repetitive nature of these filings

18

indicates to me several things. One; its just you

19

want to antagonize the other party. Two; that its --

20

it appeared to me that it was almost so compulsive

21

that it might be indicative of some type of

22

mental health issue, and that if you felt and -- and

23

if you wanted to bring to me proof that you are at

24

least attempting to curb this type of behavior on

25

that by seeking counseling, I would consider that and

26

consider vacating it. So if you want to show me

27

something -- let me emphasize. I dont want to see

detailed reports that shouldnt be part of a record

but something that shows that youre at least

attending and seeking assistance from the therapist.

I would certainly review.

MS. SORRENTINO: Okay.

Ive -- here you go.

THE COURT: All right.

Have you seen that?

ATTY FINCH: Ive not seen it, Your Honor.

ATTY FINCH: Your Honor, Ill -- Ill point out,

Your Honor, that letter in no way addresses the

concerns that Your Honor raised the last time we were

19

in court.

And theres -- the clerk advises me that

according to Edison theres been another filing or

another request?

ATTY FINCH: There was a filing, I believe, the


day after we were present before Your Honor.

THE COURT: Did you get a copy of that?

ATTY FINCH: I did get a copy of it, Your Honor.

THE COURT: And it was an attempt to file a
motion with the Court?
ATTY FINCH: It was a request for Ms. Sorrentino
to file an additional motion.
MS. SORRENTINO: I brought it with me if youd

like to read it. Mr. Sorrentino keeps -- continues to

fail to pay educational support.

ATTY FINCH: Your Honor, my client wholeheartedly

disputes that allegation and well deal with the

matter if, in fact, it is -- if it is granted by

Judge Turner.

MS. SORRENTINO: Im ready to address it now if


youd like though.
ATTY FINCH: Your Honor, its not on the docket
today, Your Honor.

MS. SORRENTINO: Okay.

THE COURT: I cant, I cant. Besides, that would

19

be a different Court. If its a support order thats

20

family support magistrate.

You -- isnt that what you just said?

ATTY FINCH: Yes, Your Honor.

THE COURT: I was --

ATTY FINCH: I believe its --

THE COURT: Its a support matter, that comes out

of the family support magistrate.


MS. SORRENTINO: Isnt the permission supposed to

be through Judge Turner though?


THE COURT: Oh, the permission; yes. But --

and -- and I dont know whats happening with that

but any kind of support matter would be through the

family support magistrate, all right.

Maam, Im not finding this sufficient. This

shows that you had domestic violence counseling and I

understand some of those skills that you might have

learned regarding treatment there, you can maybe pass

over and carry to todays date, but the only thing I

see here is some evidence of that there was a

12

one-time visit on June 7th.

In light of that, Im going to order you to pay

14

the one thousand dollar fine to the clerks office

15

forthwith.

MS. SORRENTINO: Okay.

THE COURT: All right.

MS. SORRENTINO: Your Honor --

THE COURT: Go ahead.

MS. SORRENTINO: -- she said that she would --

she thought that --

THE COURT: Whos she?

MS. SORRENTINO: The counselor.

THE COURT: Okay.

MS. SORRENTINO: She said that in looking at

all of my documents, it looks like I need help with

legal issues and that she would -- she would be able

to get me in and get some legal help because I dont

have any. So she said thats probably whats creating

the problem because I dont have any legal help.

So --

THE COURT: Well, to begin with what she says --

you cant tell me what she says; thats hearsay.

number two, it goes far beyond needing legal help at

this point in time.

MS. SORRENTINO: Okay.

THE COURT: There -- were way beyond the -needing legal assistance just to file motions.

MS. SORRENTINO: All right.

MS. SORRENTINO: Who does the check get made out

to?

THE COURT: Clerks office downstairs.

Was there anything other than the -- other than

ATTY FINCH: No, Your Honor.

I have two checks. One is made out to Attorney Finch

and one is made out to Mr. Sorrentino.

dont know why those checks would be issued to me or

to my client.

a thousand dollars.

Thats a thousand dollar fine to the

clerks office. It goes into the -- you pay -- its

paid to the clerks office. It is a contempt of Court

fine.

Nobody told me who to make it out to so I have

the checks made out one to Mr. Sorrentino, one to

21

Attorney Finch, and I didnt bring anything with me.

I didnt bring another check with me.

So I -- again,I dont have legal help and I had


no idea. I just thought that the -ATTY FINCH: Your Honor, this is just another
example of what Mrs. Sorrentino does.

check to me or to write a check to my client.


THE COURT: Why would you write out a check to
Mr. Finch?

ATTY FINCH: To either one of us, Your Honor.

MS. SORRENTINO: Then Ill -- Ill change it and

Ill put to the clerks office.

THE COURT: Okay.

MS. SORRENTINO: Okay.

THE COURT: All right.

Your Honor, we went down to the

clerks office.
Mrs. Sorrentino does not have the ability to

make the payment. She has checks from

21

other individuals that she cant possibly change the

22

names on.

THE COURT: All right.

ATTY FINCH: Theyre not her checks.

THE COURT: All right.

ATTY FINCH: Again, this is just another effort

of Mrs. Sorrentino to --

ATTY FINCH: -- delay this matter.

MS. SORRENTINO: Your Honor, its not an effort

to -- to do anything.
Nobody told me who to make the checks out to and

if you look in the record, nobody did. I didnt even

get a Court order but what I can do is if I -- I

can -- its still early. I can go and get another

check and be back before lunchtime.

THE COURT: What do you -- tell me precisely what


it is you have.
MS. SORRENTINO: I have two checks. Ones made

out to Saviero Sorrentino, ones made out to

Kevin Finch; Attorney Finch, because --

THE COURT: In the amount of what?

MS. SORRENTINO: One thousand dollars.

THE COURT: Each?

MS. SORRENTINO: Yes because what -- my daughter

19

is loaning me the money and she said who do I make

20

the check out to, and I said its either to dad or to

21

his attorney, I guess, because I didnt know. So she

22

made one out to both. So Im supposed to rip up the

23

one --

THE COURT: So youre -- these arent


your checks.

MS. SORRENTINO: These are -- this is money being

27

loaned to me because I dont have a thousand dollars.

THE COURT: But youre not -- youre not the


maker of the check?

MS. SORRENTINO: No. I dont -- I dont have --

THE COURT: All right.

Well, the order was clear on June 4th that if

she doesnt pay the one thousand dollar fine,

shes incarcerated in lieu of that.

So, marshals, take her into custody --

MS. SORRENTINO: How do I --

THE COURT: -- until she -- until she purges

herself of the one thousand dollar fine.

phone call downstairs, theyll allow you to make a

phone call at corrections.

Is there any way she can make a phone call --

can you make a phone call on her behalf to the

daughter?

MR. SORRENTINO: I dont -- I dont have any way
to reach my daughter by phone.

THE COURT: Well, he doesnt have a way to reach
her by phone.

THE COURT: Take her to -- you know what, you

THE COURT: I didnt create this situation,

THE COURT: Im stuck here. Im -- Im just the

one that has to enforce it. I ordered her a week ago

to come in with a pay of a thousand dollars. I gave

16

you the week as a courtesy more than anything to you.

I gave you a week in which to pay the fine, maam.

And you come in today without a fine payment. I dont

19

know what made you think that you can -- that the

20

check would be made payable to a different party.

If you can -- if you can provide Mr. Finch with

22

a phone number with which to reach your daughter --

23

because I dont think the marshals are able to give

24

you a phone call from downstairs, well do that. In

25

the meantime, youre in custody.

Shes got to be returned to court at some point


in time. Theres got to be someone doing arraignments

so if she -- if she doesnt post that one thousand

dollar fine by Friday, shes going to have to be

brought to the GA court at least for it to be heard

further on the arraignments docket.

THE CLERK: So on the 14th.

THE COURT: Yes.

THE CLERK: The review date.

THE COURT: Yes.

MS. SORRENTINO: I will have to call a friend and
