VEHICLE SALES AGREEMENT

FOR THE SALE OF A USED MOTOR VEHICLE

THIS VEHICLE SALES AGREEMENT is made this day 16 of DECEMBER, 2014
by and
among LIZA ANAK MINAH (NRIC: 840528-13-5790) (hereinafter known
as "Seller") and TAN KAH HUI (NRIC: 940318-01-6580) (hereinafter
known as "Purchaser"). Purchaser and Seller shall collectively be known
herein as "the Parties".
BACKGROUND
WHEREAS, Seller desires to sell the vehicle described below, known herein as
the "Acquired Vehicle", under the terms and conditions set forth below;
WHEREAS, Purchaser desires to purchase the Acquired Vehicle offered for
sale by Seller under the terms and conditions set forth below; and, therefore,
TERMS AND CONDITIONS
IN CONSIDERATION of the mutual promises and other valuable consideration
exchanged by the Parties as set forth herein, the Parties, intending to be
legally bound, HEREBY AGREE AS FOLLOWS:
1.

Sale and purchase

The Seller hereby sells to the Purchaser who hereby purchases upon
the terms and conditions hereinafter set forth the motor vehicle
described in the following schedule and hereinafter referred to as the
Acquired Vehicle

2.

Price and manner of payment

a. Purchase Price.
The total purchase price to be paid by Buyer to Seller for the
Acquired Vehicle is Ringgit Malaysia Ten Thousand only (RM
10,000.00).
b. Mode of Payment
The payment are to be made by Purchaser to Seller in cash; online
banking electronic transferor; bank in transfer or through another
instrument acceptable to Seller.

3.

Insurance
The Purchaser shall at his own expense cause the Vehicle to be
comprehensively insured with an insurance company approved by the
Seller for at least an amount equal to the purchase price and shall
notify the said insurance company of the Sellers interest in the
Vehicle.

4.

Risk and Benefit

The risk in the Vehicle shall forthwith pass to the Purchaser who shall
remain to pay the full balance of the purchase price despite any
damage to or depreciation, loss or destruction of the Vehicle from ever
cause arising. The risk and benefit will pass from the Seller to the
Purchaser upon delivery of the motor vehicle.

5.

Restriction of purchasers rights

The Purchaser shall not sell, cede, assign, transfer of pledge the
Vehicle or allow it to become subject to any lien of whatsoever nature
or deliver possession thereof to any other person while any portion of
the purchase price remains unpaid.

6.

No warranties
This vehicle is sold "AS IS", and Seller does not in any way, expressly
or impliedly, give any warranties to Purchaser. Seller expressly
disclaims any implied warranties of merchantability or of fitness for a
particular purpose. The vehicle is sold AS IS. Seller makes no
warranties about the condition of the vehicle.

The Purchaser hereby agrees that no warranties or representations

have been given or made as to the state, condition or fitness of the
Vehicle which he takes with all fault and agrees to accept all risks of
whatsoever nature.
7.

Inspection
The Purchaser hereby acknowledge that the Vehicle is second hand,
that he has inspected it and has satisfied himself that it is in good
order and condition.

8.

Roadworthy certificate
The Seller shall take the necessary steps to render the Vehicle fit for a
roadworthy certificate and shall deliver such certificate to the
Purchaser prior to delivery of the Vehicle.

9.

Registration
The Seller shall sign such forms and deliver to the Purchaser such
documents as may be necessary to enable the Purchaser to register
the Vehicle in his name.

10.

Condition
This sale is conditional upon the Purchaser fully paid the said amount
to purchase the motor vehicle within seven (7) days of signature of
this agreement.
