THE UNITED STATES= MOTION FOR PSYCHIATRIC OR PSYCHOLOGICAL

EXAMINATION OF DEFENDANT
The United States of America, by and through United States Attorney Kenneth
Magidson, and Ruben R. Perez and Joe Magliolo, Assistant United States Attorneys for the
Southern District of Texas, and Saeed Mody, by and through Jocelyn Samuels, Acting Attorney
General for the Civil Rights Division for the Department of Justice, moves this Court for an
order that a psychiatric or psychological examination of the defendant be conducted, and that a
SEALED psychiatric or psychological report be filed with the court.
I.
On July 28, 2014, notice of the defense of insanity was filed by the defense. Pursuant to
Title 18, United States Code, Section 4242 (a), upon the filing of a notice as provided in Rule
12.2 of the Federal Rules of Criminal Procedure, that the defendant intends to rely on the defense
of insanity, the court, upon motion of the attorney for the Government, shall order that a
psychiatric or psychological examination of the defendant be conducted, and that a psychiatric or
psychological report be filed with the court, pursuant to the provisions of sections 4247(b) and
(c).

II.
The United States would further move this Honorable Court to SEAL the psychiatric or
psychological report filed with this court.
III.
The United States has conferred with George Parnham, attorney for Defendant Barrett, by
telephone and he does not oppose this motion.

OF DEFENDANT

For the reasons cited in the Government's Motion for Psychiatric or Psychological
Examination of the Defendant, the Court has determined that said Motion possesses merit and
should be GRANTED.

It is, therefore,

ORDERED that a psychiatric or psychological examination of the defendant be

conducted, and that a SEALED psychiatric or psychological report be filed with the court.
IT IS FURTHER ORDERED that copies of the psychiatric or psychological report be
provided to attorneys for the Government, attorneys for the Defendant, and law enforcement
personnel associated with this case.
