PETITION
COMES NOW, petitioner, BONG NAVARRO, by and through the undersigned counsel,
and unto this Honorable Court, respectfully alleges:

1. That petitioner is of legal age, Filipino, single, and now a resident of Carig Sur
Tuguegarao, Cagayan; while respondent is impleaded in her capacity as the incumbent
Municipal Civil Registrar of Tuguegarao, Cagayan, with office address

Municipal

Hall, Tuguegarao City where she maybe served with court processes;
2. That the fact of birth of the petitioner, BONG NAVARRO is duly registered in the
Registry Books of Live birth of the Local Civil Registrars evidenced by his
Authenticated Certificate of Live Birth, issued by the National Statistics Office,
photocopy of which is hereto attached and marked as Annex A, of this petition;
3. That as appearing in Annex A, the date of birth and gender of petitioner were
erroneously registered therein on October 27 1985, which should correctly be registered
as October 07,1985, as utilized by him in almost all of his pertinent documents hereto
presented, consisting of her SECONDARY STUDENTS PERMANENT RECORD,
CERTIFICATE OF BAPTISM, HIGHSCHOOL ID, VOTERS ID, SCHOOL ID,
marked as Annexes B, C, D, E and F, respectively, clearly reflecting therein
that the date of birth and gender of Bong Navarro must be corrected accordingly;

4. That it was also appearing in Annex A, GENDER, sex item of petitioner was
registered as FEMALE, which is erroneous, the same should correctly be registered
therein as MALE, the latter being his true and correct gender, and to prove the same,
attached hereto and marked as Annex G is the Certification issued by Dra. Pat
Ricka, Municipal Health Officer of the Municipal Health Office of Tuguegarao City,
certifying therein that the gender of petitioner is MALE and not FEMALE, hence,
such error must also be corrected accordingly;
5. That such discrepancy greatly affects the personal data of petitioner, and in order to avoid
confusion and to remedy the problem, herein petitioner, BONG NAVARRO, humbly
desires for the correction of his erroneous birth date and erroneous gender registered in
his Authenticated Birth Certificate (Annex A) from October 27,1985 to
October 07,1985 and from FEMALE to MALE;

WHEREFORE, after due trial, it is respectfully prayed of this Honorable Court, that an
order be issued:
Directing the Local Civil Registrar of Tuguegarao City to cause to be made the
correction of the erroneous birth date of petitioner, as appearing in his
Authenticated Certificate of Live Birth (Annex A) from October 27, 1985 to
October 07, 1985, and his erroneous gender, from FEMALE to MALE, as
petitioned herein, upon payment of the fees required/prescribed by law in the
premises.

Cagayan after first having duly sworn to in accordance with law depose and say:

3. The contents therein are true and correct to the best of my personal knowledge
and based on authentic documents.
4. I hereby certify that I have not commenced any action or proceeding involving the
same issue in any tribunal or agency, to the best of my own knowledge, no such
action or proceeding is pending in any other tribunal or agency and should I
thereafter learn that a similar action or proceeding has been filed or is pending in
Court, I will undertake to report such fact within five (5) days therefrom to the
court wherein this Petition and this certification have been filed.
