Topic: Possible Philippine Visa Options (other than tourist) or Residency Status Option for a

The following are the Options:


(By reason of marriage to a Filipino citizen)
1/ 13A or NON- QUOTA IMMIGRANT VISA BY MARRIAGE (PROBATIONARY)
This visa is only available for those foreigners who are married to a Filipino citizen and the
application is made by the Filipino citizen, requesting that their spouse be given permanent
resident status. About 2 weeks after filing the application form, the couple will be called in to the
Bureau of Immigration (BI) for an interview to assess the integrity and validity of their
marriage. If successful, the 13a visa will be granted about 2 months later.
The application can be made either in the Philippines, or via the Embassy/Consulate in the
foreign spouses country, but both parties must be present.
If the application is made in the Philippines, the 13a visa issued is probationary and the couple
needs to return about 9 months after the date of grant for another interview where, if successful,
the spouses visa will be made permanent.
If the application is made overseas, the spouse will be required to undergo a medical
examination, however once granted the visa is immediately permanent and no second
interview is required.
To qualify for this visa, the applicant must prove that:

He contracted a valid marriage with a Philippine citizen.

The marriage is recognized as valid under existing Philippine laws.

There is no record of any derogatory information against him in any local or foreign law
enforcement agency.

He is not afflicted with any dangerous, contagious or loathsome disease.

He has sufficient financial capacity to support a family and will not become a public
burden.

He was allowed entry into the Philippines and was authorized by Immigration authorities to
stay.
NOTE: This visa is only available to citizens of a country which grants permanent residence and
immigration privileges to Philippine citizens.

Secure the CGAF from either at the Public Information and Assistance Unit (PIAU) at BI G/F
Main Office or from the official BI Website.

2.

Submit the documents for pre-screening to the Central Receiving Unit (CRU) or to the
frontline officer or staff of other Immigration Offices able to process this transaction.

3.

Get the Order of Payment Slip (OPS).

4.

Pay the required fees.

5.

Submit copy of Official Receipt.

6.

Attend hearing. Please refer to the Official Receipt for the schedule and venue of the
hearing and Image and Fingerprint Capturing.

7.

Proceed to Image and Fingerprint Capturing Counter of the Alien Registration Division
(ARD) and submit requirements for ACR I-Card application

If ACR I-Card is approved, claim ACR I-Card.

2/ THE BALIKBAYAN VISA


The following Persons are eligible under the Balikbayan Visa:
a. A Balikbayan, who may be either one of the following:
i. A Filipino citizen who has been continuously out of the Philippines for a period of at least one
(1) year;
ii. A Filipino overseas worker;
iii. A former Filipino citizen and his family who had been naturalized in a foreign country and
comes or returns to the Philippines.
b. Immediate family members (spouse and children) of the Balikbayan, who are nationals of
countries falling under EO 408, travelling together with the Balikbayan.
Former Filipinos and their immediate family members (spouse and children) who are visarequired nationals (nationals of countries NOT listed under EO 408) are entitled to the Balikbayan
Privilege. To avail of this, they must secure entry visas prior to their travel to the Philippines.
Those who are admitted as Balikbayans are given an initial stay of one (1) year. They may extend
their stay for another one (1), two (2) or six (6) months provided that they present their valid
passport and filled out the visa extension form and submit it to the Visa Extension Section in the
BI Main Office or any BI Offices nationwide. An additional requirement will be ask for Balikbayans
who have stayed in the Philippines after thirty six (36) months.
However, a foreign national spouse and/or child of a Balikbayan may only be given the said
privilege if he/she is traveling with his/her Balikbayan spouse or parent.
3/ PERMANENT RESIDENT VISA (PROBATIONARY) OF A SOUTH KOREAN NATIONAL
MARRIED TO A FILIPINO CITIZEN UNDER MEMORANDUM ORDER NO. MCL-08-003
This is for those Korean national who is married to a Filipino citizen in the interest of reciprocity.
This is done in the BIs main office.
Applicant should bring the following:

The following are the steps for application:

4/ PERMANENT RESIDENT VISA (PROBATIONARY) OF A CHINESE NATIONAL MARRIED
TO A FILIPINO CITIZEN UNDER MEMORANDUM ORDER NO. MCL-07-021

This is for a Chinese National married to Filipino citizens. This is granted in the interest of
reciprocity. This may be applied with the BI main office.

Applicant should bring the following:

5/ TEMPORARY RESIDENT VISA (TRV) FOR FIVE (5) YEARS OF AN INDIAN NATIONAL
MARRIED TO A FILIPINO CITIZEN UNDER MEMORANDUM ORDER NO. ADD-01-038
*Pursuant to Immigration Administrative Order No. SBM-2014-006, the passports of applicants
are required to be surrendered to the Bureau during the pendency of the application and shall be
returned to the applicant via courier service delivery upon proper disposition of the same. Any
request for pull-out of a required document (e.g. passport, birth/marriage certificate) during the
pendency of the application shall be deemed to be an act of abandonment of the existing
application. Consequently, the application shall be dismissed and all payments made with
reference to the application shall not be subject to refund.
This Visa is for Indian Nationals who is married to a Philippine citizen as well as their children.
Application for this shall be made with the BI Main Office.
Applicant should bring the following:

3. Additional Information on Applicant's children (if needed)

The following are the steps for application:


1. Secure the CGAF and checklist of documentary requirements from either at the Public
Information and Assistance Unit (PIAU) at G/F BI Main Office or from the official BI Website.
2. Submit the filled-up application form, applicants passport and complete requirements to the
Central Receiving Unit (CRU).
3. Get the Order of Payment Slip (OPS).
4. Pay the visa application fees to Cashier.
5. Get the Official Receipt (OR) from the Cashier.
6. Pay the courier fees to Courier located at G/F BI Main Office.
7. Get the courier pouch with thermal label indicating applicants name, address and bill
number.
8. Submit the original Official Receipt and courier pouch to CRU. The applicants passport and
courier pouch will be indorsed to the Office of the Executive Director (OED) pending the
disposition of the application. Then, CRU will indorse the visa application documents except
passport and courier pouch to the Legal Division for distribution to hearing officers and the
ACR I-Card application documents to the Alien Registration Division (ARD).
9. Attend the Hearing. Proceed to ARD for biometrics capturing.
10.Once ACR I-Card is approved, ARD will transmit it to OED.
11. If the visa application is approved, OED will implement the visa into passport of the
applicant. Then the courier will deliver the Approval Order, passport and ACR I-Card to the
applicant. On the other hand, if it is denied, the courier will deliver the Denial Order and
passport to the applicant.

This is a newly created visa option designed to encourage foreign investment and local
employment in the Philippines. The main requirement for qualification is the full time

9/ THE QUOTA VISA
This a visa granted at
the discretion of the
Commissioner to a

Nationals of countries which have diplomatic relations with the Philippines and grant the Filipinos
the same immigration privileges under the principle of reciprocity, which shall not be in excess of
fifty (50) of any one nationality or without nationality for any one calendar year, may apply for

SPECIAL NON-IMMIGRANT VISA UNDER E.O. 226, AS AMENDED BY R.A. 8756

This visa is for foreign personnel or executives of regional or area headquarters and regional
operating headquarters or multinational companies. Application for this shall be made with the BI
main office, or other authorized offices xviii.

PRE-ARRANGED EMPLOYEE VISA (COMMERCIAL)

This Visa is for foreign nationals who are proceeding to Philippines to engage in any lawful
occupation, whether for wages or salary or other forms of compensation Application shall be
made with the BI main office, or other authorized offices.

The following are the steps for application:

1.

Secure the CGAF from either at the Public Information and Assistance Unit (PIAU) at BI G/F
Main Office or from the official BI Website.

2.

Submit the documents for pre-screening to the Central Receiving Unit (CRU) or to the
frontline officer or staff of other Immigration Offices able to process this transaction.

3.

Pay the required fees.

4.

Submit copy of Official Receipt.

5.

Attend hearing.

6.

Proceed to Image and Fingerprint Capturing Counter of the Alien Registration Division
(ARD) and submit requirements for ACR I-Card application

7.

Check website if visa application is already approved.

8.

If approved, submit passport for visa implementation.

9.

If ACR I-Card is approved, claim ACR I-Card.
