COMMITTEE REPORT ON ITEM NO. 845

MOA: WORLD MISSION COMMUNITY MINDANAO INC.
CENTER FOR ALTERNATIVE RECOVERY EDUCATION (CARE)
AND BARANGAY LEON GARCIA, DAVAO CITY RELATIVE TO
THE SERVICES AND SCHOLARSHIP PROGRAM OFFERED BY
THE FIRST PARTY WHICH WILL BENEFIT THE PEOPLE
WITHIN THE BARANGAY.
Background
1. This Pertains To The MOA: World Mission Community Mindanao Inc. Center For
Alternative Recovery Education (Care) And Barangay Leon Garcia, Davao City
Relative To The Services And Scholarship Program Offered By The First Party
Which Will Benefit The People Within The Barangay;
2. This Memorandum of Agreement is entered into and between:
World Mission Community Mindanao Inc. Center for Alternative Recovery
Education (Care), represented by their Chairman Mr. Yunseop Lee, Mrs. Mihyang
Kim, Member and Mr. Jerald R. Villagonzalo, Secretary, all of legal age, Korean
Citizen and a resident of SK Apt, 204-801, Iocheon Kkengkido, South Korea, and
Bagong Lupa, Port Area Manila, Philippines, herein referred to as the First Party;
and
Barangay Leon Garcia, Davao City, represented by its Honorable Barangay
Captain Rolando Cagay Ponsa, and his Barangay Counsels Hon. Lita C. Empis,
Hon. Alvin L. Vibora, Hon. Samuel B. Rosauro, Hon. Tommy S. Rica, Hon. Mauro R.
Ignacio, Hon. Joel B. Crisanto and Hon. Anthony L. Gillo, all of legal ages, Filipino
and a resident of Barangay Leon Garcia Agdao, Davao City, Philippines, herein
referred to as the Second Party;
Highlights
3. The First Party is the Non-Profit Corporation duly organized and existence under
the law of the Philippines, which was established on August 4, 2014, at Davao
City, Philippines;
4. The First Party Non-Profit Corporation, is offering a services and scholarship
program to the Second Party Barangay Leon Garcia, Davao City, which benefited
the people within the barangay;
5. The Second Party Barangay is willing to accept their intention and offer, subject
with the following provision thereof;
a. That the First Party, World Mission Community Inc. (CARE) is offering
their intention to the people of the Barangay Leon Garcia, Davao City
by way of developing the importance and recognizes the improvement

needed in the education of youth for their future and enhance life
opportunities and developing family values by way of scholarship;
b. That the First Party, Corporation, request to the Second Party,
Barangay to secure an area within the barangay with the size of (120)
square meter, only to established a multi-purpose building for the use
of two (2) class rooms for day care and a Senior Citizen Office and to
utilized all utilities connection such us Water and Electricity;
c.
d. That the First Party, Corporation shall handle the monthly salary of the
two (2) teacher assign in the day care program with the monthly salary
of PHP=7,000.00 to 8,000.00/month, as well as the monthly allowance
of the staff in the office of the senior citizen in the barangay; and
further with the free tuition fee for every student enrolled in Day Care
Program of the Corporation;
e.
f. That the Second Party, Barangay is willing to accept all the intention in
the above provision including the worship schedule of the World
Mission Community Mindanao, Inc., incept only as provided that the
First Party, World Mission Community Mindanao Inc. is not allowed to
display their name in the above established building within the
barangay;
g. That the Second Party, Barangay will secure all necessary means for
the safety of all the official and staff of the First Party, World Mission
Community, except only as provided by law that the First Party, World
Mission Community in its official and staff commit a crime within the
community of Barangay Leon Garcia that affect the credibility of the
barangay is subject for the disciplinary action under the law of the
Philippines and within the judicial jurisdiction of the law as provided;
NOW THEREFORE, for and consideration of the foregoing premises,
The First Party and the Second Party shall accept any and all violations
and conditions of this agreement and shall subject the guilty party to
the payment of damage aside form costs of suit and attorneys fees.
That this agreement shall be binding not only to the parties hereto but
also to their heirs, successors and assigns;

Recommendation
6. This Committee recommends to grant this Memorandum of Agreement entered
into and between World Mission Community Mindanao Inc. Center for Alternative
Recovery Education (Care), represented by their Chairman Mr. Yunseop Lee, Mrs.
Mihyang Kim, Member and Mr. Jerald R. Villagonzalo, Secretary, all of legal age,
Korean Citizen and a resident of SK Apt, 204-801, Iocheon Kkengkido, South
Korea, and Bagong Lupa, Port Area Manila, Philippines, herein referred to as the
First Party and Barangay Leon Garcia, Davao City, represented by its Honorable
Barangay Captain Rolando Cagay Ponsa, and his Barangay Counsels Hon. Lita
C. Empis, Hon. Alvin L. Vibora, Hon. Samuel B. Rosauro, Hon. Tommy S. Rica,

ages, Filipino and a resident of Barangay Leon Garcia Agdao, Davao City,
Philippines, herein referred to as the Second Party.

Will Benefit The People Within The Barangay;
NOW THEREFORE, be it resolved as it is hereby resolved that a Resolution be
passed granting this Memorandum of Agreement is entered into and between World
Mission Community Mindanao Inc. Center for Alternative Recovery Education (Care),
represented by their Chairman Mr. Yunseop Lee, Mrs. Mihyang Kim, Member and Mr.
Jerald R. Villagonzalo, Secretary, all of legal age, Korean Citizen and a resident of SK
Apt, 204-801, Iocheon Kkengkido, South Korea, and Bagong Lupa, Port Area Manila,
Philippines, herein referred to as the First Party and Barangay Leon Garcia, Davao
City, represented by its Honorable Barangay Captain Rolando Cagay Ponsa, and his
Barangay Counsels Hon. Lita C. Empis, Hon. Alvin L. Vibora, Hon. Samuel B.
Rosauro, Hon. Tommy S. Rica, Hon. Mauro R. Ignacio, Hon. Joel B. Crisanto and Hon.
Anthony L. Gillo, all of legal ages, Filipino and a resident of Barangay Leon Garcia
Agdao, Davao City, Philippines, herein referred to as the Second Party.
RESOLVED FURTHER, that copies of this Resolution be furnished to the Office of
the Secretary to the Sangguniang Panlungsod, City Planning and Development
Office, City Legal Office, City Mayors Office, and all other offices/departments
concerned, for their information and guidance.
