This Memorandum of Agreement (hereinafter referred to as Agreement) is made and


entered into the City of Manila by and between:
POLYTECHNIC UNIVERSITY OF THE PHILIPPINES, a state university
with principal address at Anonas St., Sta. Mesa, Manila, represented by its
President, DR. EMANUEL C. DE GUZMAN, hereinafter referred to as
UNIVERSITY;

MEMORANDUM OF AGREEMENT

WHEREAS, the UNIVERSITY is a duly recognized higher education institution, which


offers Bachelor of Science in Information Technology (BSIT) and Bachelor of Science in
Computer Science (BSCS) degree programs under the College of Computer and
Information Sciences (CCIS).
WHEREAS, the curriculum for the BSIT and BSCS degrees in the UNIVERSITY
includes internship/practicum program for its students respectively, so as to afford them
experience in actual software development, network and database administration, technical
documentation, IT training, systems implementation, quality assurance, and web development,
thereby augmenting their formal training;
WHEREAS, the COMPANY supports this program of the UNIVERSITY and agrees to
accept and accommodate students enrolled in the BSIT Internship Program (500 Hours) and
BSCS Practicum Program (200 Hours), to expose them to actual learning experiences from
the industry;
WHEREAS, the UNIVERSITY and COMPANY shall endeavor to ensure that the
Internship/Practicum program will forge strong academic-industry linkage between them, and
that it will complement existing course curricula to match industry demand.

NOW THEREFORE, for and in consideration of the foregoing premises, the parties
hereby bind themselves to undertake this Agreement, under the following terms and conditions:
1. The duration of the program shall be equivalent to five hundred hours (500 hours) for
BSIT students and two hundred hours (200 hours) for BSCS students unless
otherwise agreed upon by the COMPANY and the UNIVERSITY;
2. The UNIVERSITY shall be responsible for briefing the on-the-job student trainees who
intend to conduct practicum exposure in the COMPANY as part of the UNIVERSITYs
curriculum;
3. The UNIVERSITY shall provide the on-the-job student trainee basic orientation on work
values, behavior, and discipline to ensure smooth cooperation with the COMPANY;

7. The COMPANY shall accomplish necessary forms (e.g. Student Performance


Evaluation, etc.) and shall issue a Certificate of Completion to each student trainee upon
fulfillment of all the training requirements;

5. The COMPANY shall assign personnel who shall orient the student-trainees on the
Rules and Regulations of the COMPANY, especially on such matters which pertain to
safety and security precautions, and who shall monitor and supervise the studenttrainees;
6. The COMPANY shall assign a Training Officer to supervise and monitor the activities,
performance and progress of the student trainee;

4. The UNIVERSITY shall voluntarily withdraw a student-trainee who is found have


misbehaved and/or acted in defiance of existing standards, rules, and regulations of the
COMPANY and impose necessary sanctions on the said student-trainee;

8. The COMPANY shall commit to take in qualified student-trainees for the semester
wherein the Internship/Practicum program is offered in the UNIVERSITY;
9. The COMPANY shall provide free relevant instruction and training to the studenttrainees, consistent with its policies, rules, and regulations. It shall treat the students in a
professional manner, and shall not subject him/her to task and work assignments that
are risky, dangerous or unrelated to the purpose of this Agreement;
10. There shall be no employer-employee relationship between the COMPANY and the
student-trainee. As student-trainee, he/she shall not be entitled to the
compensation/benefits accorded to an employee. However, the COMPANY may grant
the student-trainee a training allowance, if possible, in accordance with the COMPANYs
existing rules and regulation;
11. The COMPANY is not obliged to employ the student-trainee upon completion of training.
However the COMPANY, upon consultation with the UNIVERSITY, may require qualified
students to submit themselves to examinations, interviews, and file pertinent documents
to support their applications;
12. The student-trainee shall be personally responsible for any and all liabilities arising from
gross negligence in the performance of his/her duties and functions while under training;
13. The parties shall not divulge any information that they may have access to, and any
such information will only be used for academic purposes;
14. Both parties shall have the right to pre-terminate the internship/practicum program if:
a. The TRAINEE violates the rules and regulations of the COMPANY, or if there is
serious misconduct;

b. The COMPANY does not provide the kind of responsible training as agreed upon; or
c. There is any violation of the foregoing covenants that will warrant the cancellation of
this Agreement;
PROVIDED, that the terminating party shall formally inform the BSIT Internship
Coordinator or BSCS Practicum Coordinator of the grievance before any decision
to terminate is made and finalized. The BSIT Internship Coordinator or BSCS
Practicum Coordinator shall intervene in order to rectify the situation in the interest
of all parties concerned.

15. This MEMORANDUM OF AGREEMENT shall become effective upon signature of both
parties and implementation will begin immediately and shall continue to be valid
hereafter until written notice given by either party, thirty days (30 days) prior to the date
of intended termination.
COMMON PROVISIONS
1. Any Change of training date shall be relayed to the other party the soonest possible
time by phone and e-mail.
2. The liability of each party under this Agreement is limited to the liability stipulated
herein.
3. This Agreement supersedes and renders void all agreements, written or oral, prior to
or simultaneously with the signing of this Agreement regarding the same subject
matter.
4. This Agreement shall be valid and effective upon the signing hereof by the
authorized officers until the accomplishment of this Agreement.

INTERNSHIP/PRACTICUM POLICIES

Internship/Practicum is designed to expose students to the various operational areas of


the Information Technology industry. It is expected that the students will get the feel of how it is
to be employed in an I.T. firm. Performance of duties projects the image and reputation, not only
of the university, but as well as COMPANY. These rules and regulations shall be confirmed by
the student trainee and the Training officer of the COMPANY where the student trainee will be
deployed.
1. Duration of training shall be limited to the time period indicated in the endorsement letter.
Training period more than the specified, which may be required by the COMPANY
program, may be considered upon proper notification to the Faculty Coordinator.
2. Strict observance of work hours. Work hours of student trainee shall be limited to eight
(8) hours a day, and not be assigned on graveyard shift.

3. Performance of duties. Student trainees are expected to perform duties as required by


the training program of the COMPANY. Any other tasks beyond the training program are
discouraged by the university.
4. Punctuality and regular attendance. Student trainees are expected to report for work on
time at a regular basis and observed break periods. In instance that the university will
require the attendance of students to attend official school functions, the COMPANY will
be properly informed in advance.

5. Decorum. Student trainees are expected to observe proper decorum at all times within
or outside the COMPANY. The university denounces discourteous, ill and immoral acts
committed by students during their training period. Any of the said actions shall be
reported immediately by the Training Officer to the Faculty Coordinator.
6. Termination of the training. The university has the right to stop the training of the
student/s should the COMPANY or student trainee fail to comply with these policies.
