Summary of Legal and Investigate Expenses Year to Date 2015

RECOMMENDATION(S):
Receive the report.
EXECUTIVE SUMMARY:
At the March City Council Meeting, I noted that there were several large payments to
outside counsels for legal services and to individuals for investigations. Knowing that
large contractual costs had been of concern to the Council and the citizenry in the
recent past, I noted that a report on legal and investigative expenses would be
forthcoming at the April Council meeting.
ANALYSIS/DISCUSSION:
Below is the summary of legal counsels that the City has employed to date in 2015.
BRIAN FINEGAN - $3680.00
Mr. Finegan served as legal counsel for the Planning Staff and City Council earlier this
year on a commercial development due to the City Attorney owning property within 500
feet of the proposal. Mr. Finegan had numerous exchanges and conversations with City
Staff on the project, code, etc., and sat as legal advisor to the City Council at its
hearing.
BLAYLOCK INVESTIGATIONS - $9462.91
Cynthia Blalock undertook an extensive investigation involving claims by a former City
employee.
BURKE, WILLIAMS & SORENSEN - $21,622.31
BWS is the Citys legal advisor on labor matters and has been participating in
negotiations with the Police Officers Association and LIUNA.

KENNEDY, ARCHER & GIFFEN - $7,791.50


KAG has been counsel in the preparation of various easement documents involving the
Larson Field/Rio Park pathway, specifically regarding CAWD, Mission Ranch and
Carmel Mission properties and has assisted a City employee who in his official capacity
has been interrogated in regards to a civil matter.
MEYERS FOZI, LLP - $192.98
Meyers Fozi was legal counsel to the Citys Hearing Officer in a June 2014 personnel
hearing. The firm recently was contacted regarding certain matters arising from that
hearing and documents needed in response to a subpoena.
MEYERS/NAVE PROFESSIONAL LAW CORP - $25,549.08
Meyers/Nave is the Citys legal advisor on PG&E issues and has prepared the Citys
briefs for pre-hearings before the Administrative Law Judge.
OGLETREE, DEAKINS, NASH, SMOAK & STEWART - $205.24
ODNSS prepared an audit letter for the City in late 2014.
STEPHANIE ATIGH - $11,916.00
Atigh has been reviewing certain contract documents for the City Attorneys Office and
has been the chief investigator on several personnel grievance matters.
DON FREEMAN - $22,500.00
Mr. Freeman is the City Attorney and receives $7500/month.
