1 Pursuant to Paragraph 7 of the Court’s Standing Order, the following dates for briefing and
2 argument of Defendant’s motion to dismiss and for the initial case management conference are hereby
3 stipulated and agreed to by the parties, through undersigned counsel, subject to the approval of the
4 Court:

6 Plaintiffs shall file a brief opposing Defendant’s motion on September 7, 2004. Plaintiff’s brief
7 shall be limited to 40 pages.
8 Defendant shall file its reply brief on October 8, 2004. Defendant’s brief shall be limited to 30
9 pages.
10 A hearing shall be held on Defendant’s motion on October 29, 2004.
11 The initial case management conference shall be held on December 3, 2004.

13 The parties have agreed to the foregoing schedule, as well as to the enlarged briefs, in light of
14 the number and nature of issues in this case. The parties respectfully submit that the foregoing schedule
15 and page limits will result in the most helpful presentation to the Court of these issues and will put the
16 parties and the Court in the best position to address the issues in this case at the revised initial case
17 management conference date. Accordingly, the parties respectfully request that the Court issue the
18 attached proposed order consistent with this stipulation.
