ORDINANCE NO. 01-2007

APPROVING THE RECLASSIFICATION OF PORTIONS OF AGRICULTURAL LOT
NOS. 10689-B, 10689-C, 10689D, AND 1472-A MEASURING AN AREA OF MORE OR
LESS 60,000 SQUARE METERS OF THE TOTAL AREA OF MORE OR LESS 171,000
SQUARE METERS PER ATTACHED RESIDENTIAL SUBDIVISION PLAN,
SITUATED IN SITTO KANGGAO, BARANGAY QUITAGO, GUINOBATAN, ALBAY
FROM AGRICULTURAL TO RESIDENTIAL FOR USE AS PERMANENT HOUSING
AND RELOCATION SITE CALAMITY VICTIMS OF THE MUNICIPALITY.

WHEREAS, an application for reclassification of portions of Lot Nos. 10689-A, 10689-B,

10689-C, 10689-D and 1472-A from agricultural to residential purposes was filed
by the sons and daughter of the spouses Miguel Garcia and Vicky Tongco-Garcia
thru their authorized representative or atty.-in-fact;
WHEREAS, the Sangguniang Bayan through the Committee on Housing and Urban
Development to which such matter was referred to, had conducted the necessary
committee and on-site public hearing and ocular inspection on October 19, 2007
at 2:00 p.m.;
WHEREAS, during such hearing, the municipal and barangay officials, MARO Personnel and
the residents living thereat were all amenable for the area to be a permanent
housing/resettlement site of calamity victims provided that the few families, more
or less six (6) of them, who are actually living on the site under consideration
shall have to be given their own home lots, of which the LGU guarantees to
faithfully comply such condition and the other minor request as to introduced
improvements by one (1) or two (2) persons shall have to be addressed to the
owners of the lots;
WHEREAS, the Sangguniang Bayan through the Committee likewise consider the imminent
necessity of having the area reclassified into residential use in its effort to provide
relocation sites for its constituents who were displaced by typhoons that hit the
municipality last year and until now are living in holding centers;
WHEREFORE, in consideration of the foregoing premises:
BE IT NOW ORDAINED by the Sangguniang Bayan of Guinobatan, Albay in session
assemble that:

SECTION 1. The re-classification from agricultural to residential of portions of Lot

Nos. 10689-A, 10689-B, 10689-C, 10689-D and 1472-A measuring an
area of more or less 60,000 square meters is hereby authorized in
accordance with Chapter 2, Section 20, Book I of R.A. 7160 otherwise
known as the Local Government Code of 1991.
SECTION 2. The office of the Municipal Assessor is likewise authorized to make the
necessary adjustment on the existing records on file pertinent to the lots
herein reclassified.
SECTION 3. This ordinance shall take effect immediately upon its approval.
ENACTED: November 12, 2007.
