MUNICIPAL ORDINANCE NO. 017-2011


DECLARING THE REAL PROPERTY KNOWN AS LOT NO. 11734, CSD05-018184-D, IDENTICAL TO LOT 10690-B (FORMERLY KNOWN AS
LOT
1401-B, CSD-05-001474), OWNED BY THE LGU OF
GUINOBATAN WITH AN AREA OF 5 HEACTARES, LOCATED AT SITIO
KANGGAO, QUITAGO, GUINOBATAN, ALBAY AS THE SITE FOR LOW
COST HOUSING PROGRAM OF THE LGU FOR ITS EMPLOYEES,
PROVIDING GUIDELINES AND CONDITIONS FOR ITS ACQUISITION
AND FOR OTHER PURPOSES.

Be it ordained by the Sangguniang Bayan of Guinobatan, Albay,


in session assembled, that:
SECTION 1.
TITLE. This ordinance shall be known and cited as the
GUINOBATAN SHELTER ORDINANCE OF 2011 or GSO.
SECTION 2.
DECLARATION OF PRINCIPLE. It is the policy of the
LGU to take good care of the social well-being of its workforce
by providing them with decent housing program at a minimal
and more affordable cost and scheme.
SECTION 3.
DEFINITION OF TERMS. When used in this ordinance,
the following terms shall mean:
a. Employees all employees of the LGU who are qualified to
acquire home lots in the LGU Property for its Shelter
Program for Employees which include all permanent,
temporary, co-terminus, elective or consultant, except those
hired as job orders.
b. Lot 11734 the real property bought and owned by the
LGU located in Sitio Kangao, Quitago, Guinobatan, Albay for
its housing/shelter program for its employees with an area

of 5 hectares, identical to Lot No. 10690-B (formerly known


as Lot No. 1401-B, Csd-05-001474).
SECTION 4.
WHO ARE QUALIFIED TO ACQUIRE LOTS. All
employees of LGU Guinobatan, whether permanent, temporary,
elective, consultancy, co-terminous, except job orders, are
qualified to acquire home lots in this property provided at the
time of the acquisition or signing of the Deed of Sale or
Contract to Sell with the LGU, they are officially or validly
employed by the latter.
SECTION 5.
MANNER OF ACQUISITION. All qualified and
interested employees shall acquire a home lot in this property
through sale either by installment or full payment.
SECTION 6.
TERMS OF PAYMENT. To make it easier and more
affordable on the part of the employee-buyer, the terms for
payment shall vary according to the year considering that the
price of the lots also varies or increases every year as provided
under Section 7 hereof. The employee has the option to have it
paid in full or by installment either through salary deduction or
bonus deduction or mixed.
SECTION 7.
LOT PRICE. The prices of lot shall be as follows with a
necessary incremental increase every year to cover for its
appreciation cost, to wit:

SECTION 8.
AUTHORITY OF THE MAYOR TO SIGN DEED OF
SALE /CONTRACT TO SELL IN FAVOR OF EMPLOYEEBUYER. The Municipal Mayor, in his capacity as such, is
hereby authorized to represent the LGU, in all the contracts
that will be executed between the LGU, as the Seller and the
Employee, as the Buyer of home lots.
SECTION 9.
RESTRICTION/PROHIBITION. The lots being sold by
the LGU to its employees are at a very minimal amount only to
really show its care for the employees hence, the LGU
prohibits/restricts its employee from re-selling or conveying
their property, except through hereditary successions.
SECTION 10.
LOT/BLOCK ASSIGNMENT BY OFFICE. For purposes
of harmony and order among LGU employees, the assignment
or distribution of the lots or of the blocks shall be by office.
Hence, the block assignment shall be determined by the
Guinobatan Shelter Secretariat created under Section 14
hereof.
SECTION 11.
NUMBER OF LOTS THAT MAY BE ACQUIRED BY
THE EMPLOYEES. Every qualified employee is entitled to

acquire only one homelot at the place/block designated for


his/her office except when the same is already fully occupied. In
such a case, the employee may choose to select vacant lots
adjacent or near to the block assigned/designated to their
office. In case of couple employees, meaning both are
employees of the LGU, each one of them is entitled to acquire in
their respective blocks if they so desire.
SECTION 12.
ALL OTHER EXPENSES TO BE BORNE BY THE
EMPLOYEE. Aside from the payment of the lot price stated
under Section 7 hereof, the employee shall also shoulder all
other expenses of documentation of his/her property such as
but not limited to the payment of capital gain tax, documentary
stamp tax, real property tax, attorneys fees, transfer fee,
registration with appropriate agency and the like.
SECTION 13.
HOMEOWNERS ASSOCIATION. The LGU pursuant to
the principle of people empowerment, hereby encourages all
employees who will avail under this program and acquire
property in this lot to form and organize a Homeowners
Association.
SECTION 14. CREATION OF GUINOBATAN SHELTER SECRETARIAT
(GSS). To facilitate the disposition of the lots to the employees,
a secretariat to be known as the Guinobatan Shelter Secretariat
(GSS) is hereby created under the Office of the Mayor to be
composed of the following:

The Staff Assistant of the Chairman;

Municipal Treasurer
HRMO

SECTION 15. GSS FUNCTIONS. The following shall be the primary


functions of the GSS:
1. Prepares the necessary forms relative to lot acquisition.
2. Prepares the Deed of Sale/Contract to Sell for signatures of
the parties.
3. Accepts and processes the applications for lot acquisition;
4. Keeps Record and documents regarding the property;
5. Continuously work and help for the documentation of the
property in the name of the LGU and of the awarded
employees; and,
6. Such other functions that may be assigned to them by the
Mayor and the Sangguniang Bayan, which may be deemed
necessary to fully carry out the shelter program.
SECTION 16.
EFFECTIVITY. This Ordinance
immediately upon its approval.
