INTRODUCTION
The Complaints Management Program (CMP) manages the receipt and resolution of telephone
and written complaints involving allegations of noncompliance of laws relating to the education
of students with disabilities. CMP manages the intake of due process hearing requests. In
addition, the CMP verifies the implementation of actions ordered by a hearing decision,
settlement agreement, mediation agreement, or complaint investigative report.

Telephone Complaints
CMP contacts the school and reconnects the school with the parent.
CMP addresses the parent’s concerns by informing the caller of the legal requirements
and an explanation of Department’s policy and rules.
CMP contacts the schools and restates the parent’s concerns and informs the school of
the legal requirements.
Telephone complaints help reduce the number of due process hearing requests.
Schools, parent groups, advocacy agencies, and contracted agency personnel are encouraged
to refer telephone and written complaints to the CMP to employ early dispute resolution
strategies to avoid due process hearings. Data showed that when early dispute resolution
procedures were utilized, parents’ trust and confidence increased, resulting in fewer due
process hearings.

Table 2a. Special Education (SPED) Population and Section 504 Populations. The SPED
population and Section 504 population changes daily. Throughout the state, students become
eligible and/or ineligible on a daily basis. For purposes of this report, the number of students
eligible for SPED/Section 504 was frozen in December 2007 through the Official Child Count
and Section 504 Student Count. The overwhelming majority of students with special needs filed
no complaint or due process hearing request. Less than one percent (1%) of the students filed
a dispute.

CONCLUSION
This report provided due process hearing requests, written complaints, and telephone
complaints data reported during the fourth quarter of SY 08-09. In general, due process hearing
requests, written complaints and telephone complaints decreased over the last three years.
Telephone complaints addressed and resolved conflicts quickly and informally. Telephone
complaints and written complaints were an effective means of resolving issues before resorting
to due process hearings. Finally, the number of due process hearing requests and complaints
filed in SY 08-09 were less than one percent of the total SPED and Section 504 population. The
data showed that an overwhelming majority of students did not file due process hearing
requests or complaints.
DATA BY COMPLEX
The data includes individual reports by complex for due process hearing requests, written
complaints and telephone complaints.
As the reports are reviewed, please keep in mind that a high number of telephone and written
complaints do not reflect negatively on a complex. Those complexes with a high number of
telephone and written complaints may be utilizing early dispute resolution practices to avoid the high
cost of litigation. Complexes should be encouraged to use early dispute resolution strategies such
as telephone and written complaints, mediation, facilitation, and conciliation. Those schools that
employ effective communication skills and develop trusting relationships with parents often avoid
lengthy litigation.
*Eligibility reported as “SPED” related to students with disabilities in a low incidence category.
Student’s eligibility was omitted and replaced with “SPED” to comply with state and federal
confidentiality legal requirements.
