Certification General

Full term certificates may only be issued by LR Antwerp, as all statutory certificates issued on behalf of the
Belgian Administration must be countersigned by LR Antwerp's authorised surveyor. Short term certificates
may, therefore, be issued by other offices. A copy of the short term certificate issued is to be forwarded to
LR Antwerp. LR Antwerp will then issue the full term certificate.

A copy of the Report C11 (IMO) is to be forwarded to the Administration via LR Antwerp.
A copy of any certificate issued is to be forwarded to the Administration via LR Antwerp.
Both the Flemish and English statutory certificates issued by the BMI should be endorsed on completion of
the statutory survey.

National 'Certificaat van Deugdelijkheid' (Certificate of Seaworthiness), certificate


LR has authorisation to endorse the national 'Certificaat van Deugdelijkheid' (Certificate of
Seaworthiness).The Flag Administration (BMI)will issue, after the special and renewal survey by class, a
new 'Certficaat van Deugdelijkheid' valid for 5 years with same expiry date as the Cargo Ship Safety
Construction Certificate. The certificate will be issued and forwarded to the respective shipping company
upon reception of the survey-report from class. The Certificaat van Deugdelijkheid shall be endorsed by the
surveyor endorsing the last statutory certificate during the annual statutory survey.

The "Certificaat van Deugdelijkheid" should not be endorsed by LR if there is no "Certificate of insurance or
financial security in respect of civil liability for oil pollution damage" on board or if there is no "Certificate of
insurance or financial security in respect of civil liability for oil pollution damage" on board issued by the BMI
after 20/02/2010. The BMI should be contacted immediately if no "Certificate of insurance or financial
security in respect of civil liability for oil pollution damage" is on board before the departure of the vessel.
The sailing permission and/or instructions given by the BMI at that moment have to be followed and
reported to the BMI.
Port of Registry
The port of registry on all certificates is to be the Belgium spelling e.g. ANTWERPEN and not Antwerp.
Withdrawal of certification
Should it be identified by an LR surveyor that the condition of the ship or its equipment does not correspond
with the particulars of any of the certificates or class certificates, or its condition is found to be such that the
ship is not fit to proceed to sea without danger to the ship, persons on board or a third party, or presents an
unreasonable threat to the marine environment, the LR surveyor is to immediately recommend repairs or
corrective actions to rectify the deficiencies.

If the recommended repairs or the corrective actions are not implemented prior to the departure of the ship,
the certificate(s) concerned must be withdrawn. LR is to advise the Master in writing that the certificate(s)
is(are) invalid from the date of signature of the letter, and that the surrender of the certificate(s) is
requested. The Administration and the local port State control is to be informed immediately and a copy of
the letter is to be forwarded to them.

In those cases where deficiencies are identified which cannot be rectified at the port of survey and the ship
is found fit to sail under special provisions without danger to the ship, persons on board or a third party or
an unreasonable threat to the marine environment to an appropriate repair yard, the LR surveyor is to give
the Master a letter stating that the certificate(s) are being withdrawn with effect from the date of signature of
the letter. A conditional certificate is to be issued. The conditional certificate is to be valid only long enough
to permit the ship to proceed to the port where the correction will be made: the maximum validity will be two
months, except in cases where the Administration has given special dispensation. The Administration must
approve the conditional certificate. The local port State control must be informed immediately and copies of
the letter and the approval by the Administration must be forwarded to them.

The withdrawn certificate should either be removed from the ship or be placed on board in a closed, sealed
envelope in custody and under the responsibility of the Master. Only the attending surveyor who is to carry
out the resurvey is authorised to open the sealed envelope.

Reporting General
All survey codes will be shown on the reporting system for the benefit of the Owners.

In order that these codes may be reported when required memo FSX will be added to the ships records. In
cases in which a ship changes flag to Belgium, surveyors should request London Classification Services to
add the memo PRIOR to downloading the SPP in order that correct survey code reporting may take place.
Similarly FSX should be deleted prior to downloading the SPP for ships leaving the Belgium Flag.

NOTE.
If the required surveys are carried out by the BMI the owners should be advised to notify LR Antwerp of the
date and place the survey was held in order that a dummy report may be issued to update the records.
Memo BLG will state this requirement.

If however clear evidence is available to the surveyor attending that surveys have been held by BMI, the
surveys may be reported in the normal manner and the details should be recorded in the narrative.

Notifying the Administration in the event of deficiencies and damage


LR is to immediately notify the Administration and receive the OK from the Administration before acting in
the case of detainable deficiencies. A detainable deficiency is a defect where the seaworthiness of the ship
is no longer guaranteed, and which must be repaired before departure. This may relate to certificates or to
class certificates.

In the case of deficiencies, the Administration must be informed. A deficiency is a shortcoming or omission
that has not been rectified and which may be harmful for the safety of the ship. A time window will be set by
LR or the Administration, within which the deficiency must be rectified.

In the case of an observed deficiency, the Administration must be informed. An observed deficiency is a
deficiency which gives no cause for concern in the (near) future. The frequency of reinspection, where the
situation allows, will fit in with other periodic inspections (e.g. must be checked during an annual survey,
keel survey, etc.).

Where accidental damage in a port, either during loading and unloading operations,or damage sustained
while manoeuvring the ship has occurred, the Administration must be informed. Information about the
working methods must also be sent to the Administration.

Where accidental damage has occurred, other than ina port, the Administration must be informed.

The Administration has access to CDLive.

Exemptions, waivers, extensions of certificates

Requests for exemptions should be made through the Local Chief Executive in Belgium who is based in the
LR Antwerp office (see above for contact details).

In instances where, temporarily, the requirements of an applicable instrument cannot be met under
particular circumstances, the LR surveyor is to specify such measures or supplementary equipment as may
be available to permit the vessel to proceed to a suitable port where permanent repairs can be made or
considered equipment can be renewed / replaced. The Administration must approve these measures before
they are implemented. If the ship is in a foreign port, LR is to ensure that a report is sent to the appropriate
port State control authorities. This report must contain the notification of approval by the Administration.

Change of Flag and/or Change of Class


Transfer of Class
If a Belgian flagged ship transfers Class to LR, LR can issue or renew certification only after all overdue
surveys have been satisfactorily completed and all overdue recommendations or conditions of class

previously issued against the ship have been completed as specified by the losing Classification Society.
Prior to the issuance or renewal of the certificates, LR, as the gaining Classification Society, must advise
the losing Society and the Administration of the date of issue or renewal of certificates and confirm the date,
location and action taken to satisfy each overdue survey, each overdue recommendation and overdue
condition of class.

If she ship is not classified by an RO, LR is to consider the ship to be a non-classed ship. LR is to assemble
a complete history file. Before finally issuing the certificates, a joint inspection is to be carried out by LR and
the Administration.

For ships that are registered, or are contemplating registry in the Belgian register but were involved with
another Flag Administration prior to or during the final stages of construction and that have not yet been
delivered, special procedures and requirements will be drawn up by the Administration, on a case-by-case
basis and in close consultation with LR.

MED
Where a vessel is to change Flag from a non-EU/EEA member state to an EU/EEA member state, the
surveyor is to confirm with the gaining Administration that equipment on board which is required to be
certified under the MED, and which does not have such certification, is acceptable to the gaining
Administration.

Port State Control

If a Belgian flagged ship is detained in a foreign port by port State control, or any other competent authority,
LR, when advised of the detention, is to immediately notify the designated official. Acting on a report from
the competent port authorities, the designated official may conduct a full inquiry into the cause and nature
of the foreign port authority's report. If so requested, LR is to cooperate with the designated official to see to
the repair of any failures reported, on behalf of the designated official. LR is to report this to the designated
official and the foreign port authorities.

If a Belgian flagged ship is inspected in a foreign port by the appropriate port State control and the latter
makes remarks about the certificates, without resulting in detention, LR, when advised of the remarks, is to
inform the designated official immediately.

Requirements General

For all ships all communications with the administration to be via LR Antwerp and survey authorisations are
as below.
Surveyors must ensure that authorisation is received for surveys not automatically authorised by BMI. All
requests for authorisationto carry outsurveys for which LR is not authorised should be made through the
Local Chief Executive in Belgium, who is based in the LR Antwerp office (see above for contact details).

LR has Case by Case authorisation to carry out plan approval and the initial survey for ships being built
under the Belgian Flag. LR Antwerp is to be contacted to obtain authorisation in these cases at the contract
stage. A Statement of Compliance (Form 1774) can then be issued; the BMI will issue the full-term
certificate. The SE1 and Form E are also to be prepared.

Annual/Periodical Surveys
LR is authorised to undertake Annual and Periodical Safety Equipment Surveys.

Halon systems
HALON fixed fire-fighting systems to be decommissioned by 31 December 2003 in accordance with EU
regulations 2037/200.

Immersion Suits
Immersion suits are to be serviced every three years by an RO approved service supplier. Flag circular

Inspection and testing of CO2, nitrogen cylinders


10% of CO2, nitrogencylinders should be tested each year after 10 years of age or 100% every 10 years
thereafter.

Navigation lights, navigation light controllers and associated equipment


Resolution MSC.253(83) is mandatory for:
l new ships
l existing ships where such equipment was not previously carried on board or where equipment which
was previously carried on board the ship is replaced, except where international conventions permit
otherwise, whether or not the ship is situated with the EU when the equipment is placed on board.

Any navigation lights, navigation light controllers or associated equipment that were installed on board prior
to 6 April 2010, and which do not comply with the MED, do not need to be replaced; any navigation lights

Document of Compliance
Any Company [1], who wishes to operate ships under Belgian flag, should apply for ISM Code certification
to the Belgian Maritime Inspectorate.

An assessment of the Company's management system is required to be carried out at the offices where
such management is carried out and at other locations (ex: branch offices), depending on the Company's
organisation and the functions of the various locations. The mentioned assessment will be carried out by
the RecognizedOrganisation (RO)and must be witnessed by an auditor of the Belgian Maritime
Inspectorate.

The Belgian Maritime Inspectorate reserves the right to intervene during the assessment and impose
additional questions. The Belgian Maritime Inspectorate may abort the assessment if the Company's
structure or management system does not comply with the Belgian requirements. The Belgian requirements
may be additional to the requirements mentioned in the ISM-code.

Only on satisfactory completion of the assessment and upon the satisfaction of the BMI-auditor, a
Document of Compliance or an Interim Document of Compliance in accordance with paragraph 14.1 of the
ISM-Code will be issued by Belgian Maritime Inspectorate.

The validity of a Document of Compliance will be subject to annual verification. The annual verification will
be carried out by the RO in accordance with the working agreement (Table IV, 1.25), but shall be witnessed
by a BMI official. The audit plan may be subject to additional verifications of BMI.

The controlling MMSO is to forward a copy of all the ISM Code related audit documents
(annual/periodical/renewal DOC) to LR Antwerp for forwarding to the BMI and archiving purposes.

Actions and follow up audits, resulting from any recorded non-conformities, are to be mutually agreed
between the recognized classification society and BMI. The attending RO auditor will endorse the DOC
upon successful completion of the annual verification.

The Belgian Maritime Inspectorate may request an additional DOC-audit to be carried out, if there is
evidence of mayor non-conformities or when an assessment of the ISM-system is required as a result of an
incident. I such case BMI may request the additional audit to be carried out by another classification
society, which has not carried out any ISM-DOC-verification for the concerned Company.

Only the Belgian Maritime Inspectorate is authorised to withdraw the Document of Compliance when the
annual verification is not requested or if there is evidence of major non-conformities with the ISM-code.

Safety Management Certificate(SMC)


The recognized classification societies are authorised to carry out the ISM verifications related to the Safety
Management Certificate, on behalf of Belgium, in accordance with the working agreement, Table IV, section
1.27, with the exception of Intermediate audits. Intermediate audits will becarried out by the
Administration.This includes the required endorsements of the certificates.

When at the time of completing an initial or renewal verification, a SMC, issued by BMI, is not available, the
recognized classification society may issue a "short term" SMC with a maximum validity of 5 months. The
"short term" SMC must be replaced, as soon as possible, by a "full term" SMC, issued by BMI.

An Interim Safety Management Certificate can be issued with a maximum validity of 5 months. Based on
exceptional circumstances, an extension of one month may be granted.

Following the satisfactory completion of the initial Safety Management audit of the ship, BMI will issue the
full term Safety Management Certificate, based on the audit-report (mentioned below). A full term Safety
Management Certificate has a maximum validity of 5 years.

In principle only one intermediate verification is to be carried out, it should be take place between the
second and third anniversary date of the issue of SMC. However BMI reserves the right, in specific cases,
to increase the frequency of the intermediate verifications.

BMI should always be informed of any planned SMC-audit at least 14 days in advance. This can be done
through the BMI specific email address: ism-isps@mobilit.fgov.be. BMI reserves the right to carry out any
given audit by itself, with or without the assistance of a recognized classification society, or to only witness
any given audit which is leaded by a recognized classification society.

The controlling MMSO is to forward a copy of all the ISM Code related audit documents
(annual/periodical/renewal SMC) to LR Antwerp for forwarding to the BMI and archiving purposes.

Upon completion of any verification, a report should be forwarded, without delay, to BMI. Any report should
always be sent through, and validated by, the local chief representative of the classification society in
Belgium. The report should include at least the following information:

l Place and date of the verification


l Identification of the audit team
l Type of verification (interim/initial/renewal/additional)
l Audit plan (interviews with the different departments and key-personnel)
l Registered non-conformities and observations
l Required actions and/or follow up audits
l Copy of the "short term" SMC (if applicable)

When non-conformities have been registered, the RO, should inform BMI regarding the corrective actions to
be taken, the follow up audits and the final clearance of the non-conformities.

In case of registering any major non-conformities with the ISM-Code, the recognized classification societies
are authorised by BMI to withdraw the SMC. In such case, BMI should be immediately contacted through
the flag state contact procedure (BMI Circular 2008/002).

International Ship Security Certificate (ISSC)


The recognized security organisations (RSOs) are authorised to carry out the Interim, Initial and Renewal
ISPS verifications related to the International Ship Security Certificate (ISSC), on behalf of Belgium, in
accordance with the working agreement, Table IV, section 1.30. This includes the required endorsements of
the certificates.LR is not authorised to carry out the Intermediate verification; theAdministration will
undertake this verification.

When at the time of completing an initial or renewal verification, an ISSC, issued by BMI, is not available,
the RSO may issue a short term ISSC with a maximum validity of 5 months. The short term ISSC should be
replaced, as soon as possible, by a full term ISSC, issued by BMI.

Any Interim International Ship Security Certificate will be issued with a maximum validity of 5 months.
Based on exceptional circumstances, an extension of one month may be granted.

Auditor
Each RSO should forward to BMI, a list of the auditors within the RSO, who are assigned to perform the
verifications, both for the SSP and on board, on behalf of the Kingdom of Belgium. Only the persons
mentioned in this list will be authorised to perform the earlier mentioned verifications. It is the responsibility
of the RSO to inform BMI of any changes in the above mentioned list.

RSO-auditors should, when doing a SSP review at the shipping company and when doing verifications
onboard, be able to present following documentation:
l Valid passport
l Evidence of being in service of the RSO (RSO-ID pass or declaration from the RSO)
l Evidence of being authorised for ISPS (in accordance with IACS PR 25)

Ship Security Plan (SSP)


In accordance with the ISPS-code, the shipping company should prepare a SSP and a ship security
assessment (SSA). The SSP should include at least the issues mentioned in article 9.4 of part A of the
ISPS-code.

The preparation of the SSP and SSA may be performed by a RSO, chosen by the shipping company. The
review and approval of the SSP can not be performed by the same RSO who has been involved in the
preparation of the SSP or SSA.

When the SSP and SSA has been finalised, the shipping company should submit the SSP and the report of
the SSA to the RSO (assigned for the review and approval) for approval. BMI does need not to be informed
separately.

Once the SSP has been approved, the RSO issues a "letter of approval" and validates all pages of the
approved SSP. The RSO shall forward the letter of approval to BMI for endorsement, to which BMI returns
the endorsed letter of approval to the RSO. The countersigned letter of approval shall be put in the SSP on
board the vessel.

BMI reserves the right to fully review the SSP and issue remarks which could result in amendments of the
SSP. For security reasons, BMI will not keep any copy of the SSP for shipping companies based in Belgium
. However the SSP should be readably available at the shipping company at any time. Upon request of an
authorised person of BMI the shipping company must be able to present instantly any given SSP.

On the other hand, BMI will keep one copy of the SSP for shipping companies based outside Belgium. This
may be either a hard copy or an electronic version.

Amendment of the Ship Security Plan


Any amendment of an approved procedure, SSP and/or security equipment, shall be notified to the RSO
(who has performed the approval of the SSP).

The RSO, decides in each case if this amendment is permitted without a new verification, or that further
inspection is required.

International Ship Security Certificate (ISSC)


The extent of delegations to the RSO for the issue and verifications related to the International Ship
Security Certificate is in accordance with the Work Matrix, Table IV, 1.30.

The maximum validity of the ISSC for Belgian flagged vessels will be, in principle, 5 years unless expressed
otherwise (see Security Alert System). BMI reserves the right, in specific cases, to reduce the maximum
validity or even withdraw the certificate.

The RSO performing the verification must be the same RSO who has performed the review and approval of
the SSP.

The RSO, authorised by BMI, may not impose higher requirements than those stated in:

l part A of the ISPS-code


l paragraphs 8.1 to 13.8 of part B of the ISPS-code (agreed by the Maritime Security Working Group
MSWG)
l the articles from part B of the ISPS-code in accordance with the EU-regulation 13611/03, COD
2003/0089

The interpretation by BMI of any requirement overrules the interpretation made by the RSO. In case of any
conflict between the shipping company and the RSO, the shipping company should contact BMI. The
findings of the RSO will be considered as advice to BMI.

Interim International Ship Security Certificate


The extent of delegations to the RSO for the issue and verifications related to the Interim International Ship
Security Certificate is in accordance with the Work Matrix, Table IV, 1.29.

Reporting of non conformities


The RSO provides the shipping company a summary of the noted non-conformities, resulting from the initial
verification. A copy of the summary and the recommendation from the RSO to not issue the ISSC are to
beforwarded to BMI.

The concerned shipping company should within a period of maximum 2 months, from the date of the initial
verification, rectify all noted non-conformities. After rectification, a new verification should take place,
however the scope of the verification shall be limited to the noted non-conformities. This new verification
should be performed by the same RSO who has noted the non conformities.

The report of the new verification and the recommendations by the RSO should be forwarded as soon as
possible to BMI.

If the shipping company does not rectify all deficiencies within above mentioned period of 2 months, a full
initial verification should take place.

Training Ship Security Officer (SSO) / Company Security Officer (CSO)


To this date, the STCW 78 Convention, as amended in 1995 has not incorporated the standards of training
for SSO and CSO. Therefore, meanwhile, officially BMI will not certify or endorse any training course for
SSO or CSO.

The SSO and CSO must be able to perform the security related duties and responsibilities specified in
article 11.2 and 12.2 of the ISPS-code. The RSO shall verify the knowledge and performance of the CSO
an SSO during the approval of the SSP and verifications on board.

BMI requests documentary evidence for SSO and CSO, from a third party institution, that a training has
been followed and that this training fulfils the requirements set in article 13.1 of part B of the ISPS-code.

Although mentioned in the SSP, the name and contact details of the CSO must be formally transmitted to
BMI in a separate message, any subsequent change must immediately be notified.

Security Alert Systems (SAS)


The performance of the SAS shall be in accordance with:
l Resolution MSC 147 (77)
l MSC circular 1072 without restrictions

The hardware belonging to the SAS is subject to the radio-inspections (related to the Cargo Ship Safety
Radio Certificate), for example the check on performance when connected to the emergency power.

For some types of ship the date of coming into force of the ISPS-code and the mandatory instalment date of
the Security Alert System (SAS) will not coincide. For those ships, BMI will not make any remark on the
ISSC regarding missing SAS.

The shipping company remains responsible for the instalment of the SAS prior the deadline. The shipping
company shall inform the RSO when instalment of the SAS has been completed. The RSO will then
perform an additional verification to confirm compliance of the SAS with the requirements of SOLAS
Chapter XI-2 Reg. 6.

Records
"Records" as specified in article 10 of part A of the ISPS shall be kept on board for a period of minimum 3
years.

Declaration of Security (DoS)


Each Declaration of Security shall be kept on board for a period of minimum 3 years.

Multiple Load Line Certificates


Multiple load line certificates are issued subject to the following (see Flag circular 2005/005):
1. The ship is to comply fully with all relevant legislative safety requirements in force for a ship of a
maximum deadweight corresponding to the least freeboard shown on the certificates issued. Safety
standards are to be maintained regardless of the deadweight of the ship.
2. The initial survey of load line marks corresponding to the certificates are to be carried out by an LR
surveyor, who will verify that the load line marks are permanently marked on the ship's sides and advise
the Master of his responsibilities. The Surveyor will also hand over the Guidance Notes with the load
line certificates issued.
3. The Master must ensure that only one set of load line marks and the corresponding load line
certificatearevisible at any one time. The remaining load line marks are to be painted out, and the load
line certificates not being used, are to be kept in a sealed envelope under lock and key by the Master.
4. The Master is to make an official entry in the ship's deck log book on every occasion the load line marks
are changed. Additionally, the shipping company should inform the Belgian Maritime Inspectorate each
time the load line has been changed.
5. The load line marks for the intended voyagemust be exhibited and all others painted over before
loading cargo.
6. The stability booklet shall contain information relating to all the freeboards assigned for which a load line
certificatehas been issued.
7. An LR surveyor is to witness each change of marks, verify the correct certificate is exhibited and seal
the envelope containing the other certificates. The surveyor is to carry out an examination of the ship to
satisfy himself as to its condition and countersign the official logbook entry.
8. In the event that the change of marks is scheduled for a port where an LR surveyor is unavailable, and
upon approval of the Administration and LR, the changes may be made under the Master's
responsibility with the attendance of the Chief Engineer who should verify each step as specified above.
At the next convenient port, the requirements of 7 are to be complied with.
9. When a periodical load line inspection is held, the Master is to ensure that each set of loa dline marks
are verified and that all corresponding load line certificates are endorsed.

Until 20th August 2014 RO's will be granted authorisation to undertake MLC inspections on a Company
basis where LR is carrying out ISM certification.

On receipt of a request from a company for initial inspection of a vessel against the Maritime Labour
Convention, 2006, the CFO is to contact the Antwerp office who will advise BMI of the request.
The original DMLC Part I and the DMLC Part II signed by the ship owner are to be on board the vessel.
LR does not have authorisation to endorse the DMLC Part II or to issue a maritime labour certificate. A
copy of the DMLC Part II and the inspection report are to be forwarded to the Antwerp office on completion
of the inspection. The DMLC and the maritime labour certificate will be issued by the flag Administration
following review of the submitted documentation.
