Dear Ms. Smoot:
This responds to your facsimile dated September 17, 2012, regarding an incident in
which you were the vietim of a civil rights violation allegedly committed by officers of the
Fairview Heights, Illinois Police Department on May 11, 2011 at the French Village Motel. We
recently received a package of documents (enclosed) after you had mailed a similar package to
the Special Litigation Section several weeks ago.
‘The Criminal Section of the Civil Rights Division has the responsibility of enforcing
federal criminal civil rights statutes that pertain to incidents of official misconduct, in general,
the use of excessive force by police officers.
Our office is currently reviewing the documents furnished to us, and you can be assured
that if we find that there is sufficient evidence to establish a prosecutable violation of any federal
criminal civil rights statute, appropriate action will be taken, Once we have determined what
action to take, you will be notified by mail
During our review, we note a pending trial is scheduled in the 20% Judicial Circuit Court
of St. Clair County pertaining to this incident. In addition to the information you have furnished
to us, please provide specific details concerning the criminal case, such as the name of defense
attorney, the outcome of the proceedings and any documents related to the criminal trial.
Further, you enclosed information which indicates that you filed a civil rights claim in Illinois
Southem District Court. We would suggest that you contact the assigned attorney, Angel
‘VonBokel, for assistance in providing the civil suit documents to us for review.
