SUMMARYOFTHEARGUMENT

relationship?
3.Ifhomosexualityis,asitsopponentssay
empiricalevidencedemonstrates,notnormalor
naturalbutratherpredominantlyamanifestation
ofdevelopmentaltraumaordysfunction,then
institutionalizingitisasupremedisserviceto
thosemanywhohavesuccessfullyabandonedthe
lifestyle:agovernmentdriventurnaboutforlong
respectedculturalremedies,aforcedreversal

forpreachersoftraditionalmorality,andafount
ofconfusionforyoungpeople.
4.Marriageasacivilrightbasedondesiresalone
isoutsidetheestablishedcharacterofthecivil
rightsrealmthatprotectsimmutable
characteristicsofnationalorigin,religious
heritage,sexandrace.Thehumancapacitytobe
attractedtonearlyanythingandpropensityfor
rationalizationbeliesgivingmarriagessocietal
imprimaturtoanyloving,committed
relationship;i.e.redefiningmarriageto
encompassmeredesiresassignslegalimportto
samesexroleplaying,onlyimitatingwhatis
attainedbynaturalheterosexualpairing.
5.Heterosexualattractionand(potential)
functionwithinmarriageisatitscoreexistential.
Samesexattractionhasvaryingorigins,mostly

traumaticoraberrantandcommonlyentrenched
duringadolescenceorothervulnerableperiod.
6.Scripturaladmonishmentsagainstthe
Christianfaithfulindulgingsamesexattraction,
portenddangerineternity.However,thesmall
vocalminorityofChristiansvilifyinghomosexuals
areanembarrassmenttothelargerChurchof
Christ,particularlywhenshowcasedbythemedia
totheexclusionofthosewishingtooffer
friendship,reconciliationandredemption.
7.The99%likelihoodofanadoptedchild
becomingheterosexualdespitebeingraisedby
samesexparents,raisesthequestionofhowthis
canbeconsideredeffectivemodelingforthe
young.
8.Notwithstandingmarriageaccommodating
equalityofdifferentracesandeconomicparityof

womenwithmen,marriageablelovedoesnot
logicallyextendtoallhumanaffection.
9.Practicallyspeaking,homosexualsproposed
normalizationbegsthequestionofwhysociety
doesntseparaterestroomsasheterosexualand
homosexual.The(presumed)visceraland
institutionalcost/benefitrejectionofthisnotion
putsPetitionersparadigmanditsinevitable
implicationsoutsidethemarginsofacceptability.
10.Oncemarriageisredefinedawayfromthe
establishednorm,allnontraditionalhuman
groupingshavelegalprecedenttobringtheir
respectivecases.Posteritywillinglyaccountable
toourlegalregimecannotbeassuredonsucha
foundation;chaosisitsonlyforeseeableend.

Fortheabovereasons,itisappropriatethatthe
CourtstrictlyscrutinizePetitionerscaseswhich
seektoassigninterstaterecognitionand
imprimaturtosamesexlibido.Statesmaydiffer
intheirtreatmentofmarriage.However,the
stabilityreasonablyassuredbyrejectionof
Petitionersargumentsservesthegreatergood
envisionedbyourfoundingdocumentsandthe
subordinatelegalregime,intoperpetuity.

ARGUMENT
Marriageisacivilconstructusedtodefineand
clarifytheattractionandunionbetweenthe
humanmaleandfemalesex.Beforesociety
existed,menandwomenformedsuchunions.As
historyplayedout,variationsofthisunionwere
triedandsometimesevensanctionedby

society,butultimatelyonemanandonewoman
(unrelatedbyblood)becamethenormforall
moderncultures.EveninMuslimcountries,
wheretheKoranpermitsupto4wives,thenorm
isneverthelessonemanandonewoman.

Althoughsomespeciesmaymateforlife,animals
dontgetmarried,onlypeopledo.Onlypeople
recognizeandunderstandtheimplicationsof
marriageANDrecognizeandunderstandwhat
kindsofunionsarenotmarriages.Cansocieties
changetheirinterpretationsofmarriage?Of
coursetheycan.Buthereisthechangeweare
beingcalledtoconsider:willonemanandone
woman(unrelatedbyblood)continuetobethe
basisfordefiningmarriageorwillanyloving,
committedrelationshipbecomethestandard?

Eachsidehasgatheredargumentstobuttress
theircause.FranklyIfindfewofthese
compelling.Theyusuallyboildowntoifwedo
this,thatwillhappenorthishasbeendone
alreadyandnothingbadhappened.Itskindof
pitifulwhenyouthinkaboutit.Butwhatelseis
tobeexpectedwhenpeopletrytobolstertheir
secretfearsordesireswithmoreandmorewords?
And,justlikeme,theyavoidanydataorscripture
thatcompromisestheirposition.Inthefinal
analysiswearealldishonestdebaters.

Itisthegreatdesireofthosewhosupportgay
rightstoseehomosexualitynormalized.
Legalizinggaymarriageisamajorobjectivein
achievingthatgoal.Butifhomosexualityisnot
normalornatural,ifhomosexualityisinfact

dysfunctional,ifmosthomosexualityislargelya
productoftraumaordeficit(andsin,ifwewould
servetheconservativeChristianview)then
institutionalizingitisthesupremedisserviceto
thosewhowouldleaveit.Theywillbetoldto
quitlivingalieandembraceit.

Andtheoneswhodesiretoleavehomosexuality
willbedemonized,indeedarealreadybeing
demonized.Toobad.Toobadforthosewhohave
alreadylefthomosexuality,fortheirvoiceswillbe
stifled.Toobadforthosestrugglingwithsame
sexattraction,fortheremediesofreligion,
psychology,andrecoverygroupswillberemoved
fromthem.Toobadforthechildrenwhoyethave
toembraceasexuality,fortheywillbetoldat
schoolandthroughthemediathatanyattraction

isgoodattraction,justdonthurtanybodyby
passingaSTD.Andtoo,toobadforthosewhodo
notwishtoembracegaymarriageasthenewcivil
right,fortheircallstorepentancewillbelabeled
hatespeechandtheywillbejailedfortheir
dissent.Thisishappeningalready.Somuchfor
freedomofspeechandrespectfuldissent.

Civilrightsprotectusfrominjusticesbasedon
nationalorigin,religion,sex,orrace.
Nevertheless,redefiningmarriageasacivilright
basedonoursexualdesiresisilladvised.We
haveaninfiniteabilitytobesexuallyattractedto
almostanythingaswellasanequallyinfinite
abilitytorationalizethatoursexualdesirescan
behousedinaloving,committedrelationship.
Intryingtodeflectthisobjection,opponentswill

usethephrasesexualorientation,butifthere
areonlytwogenders,chromosomallyeither
xxorxy,whicharedefinedbybiological
differences,compatibility,andprocreative
potential(hencetheinstitutionofmarriage
arisingtodescribeandprotectsuchrelationships
betweenthesetwogenders)thengender
identificationorsexualorientationreallybecome
yetanotherrationalizationtoallowustostayin
ourhousesofloving,committedrelationships.

Itiswrongtolumpallthevarietiesof
homosexualityintooneetiologyoroneparadigm.
Thisisunfairtohomosexualsandpromotes
misunderstandingandprejudice.Samesex
attractiondoesnotcomefromonecauseorone
gene,norisitfromthesameconstellationof

causesorgenesactingtogether.Foroneitmight
bealienationfromtheoppositesexthatbegan
withatraumaticevent(s).Foranotheritcouldbe
overidentificationwiththeoppositesexthat
formedbysharinggendersimilartraits.For
someitwasfromenvyofthesamesexbecauseof
aselfperceivedgenderinadequacy.Forsomeit
wasfromarelationaldisconnect(resentment,
really)thatmaterializedintoanidealizedsame
sexsolidaritysupplementedbysamesexsexual
activity(thisiscommonforlesbians).For
anotheritmighthavecomefromaresponseto
romanticoverturesfromsomeoneofthesamesex
whichenmeshedtheminanaffirming/adulating
relationshipwhichcompensatedforadamaged
selfimageorsenseofisolation.Foryetothersit
makesnosenseatallbutjustis.

Itisironicthatthegayrightsmovementusesthe
rainbowastheirembleminasmuchasthecauses
ofhomosexualityareindeedasvariedasthe
colorsoftherainbow.Butwhensexualizedat
pubertyandreinforcedinadolescence,samesex
attractionbecomesentrenchedandisfortified
witheverynewhomoeroticfantasyorpersonal
affirmationbyasympatheticparty.Itjustifiesits
worthwithloveanddeflectsdisapprovaleither
byopenoppositionorsecretretention.Thisis
indeedlivingthelie,andweshouldnotpropose
gaymarriageasafinalendorsementofthelie.

ForthemostpartIhaveusedsecularreasoning
astowhygaymarriageshouldnotbecomeacivil
right.Tome,itisregrettablethatinapost
Christianworld,appealstoScripturearesoeasily

dismissed.NonethelessifGoddidinfactcreate
marriagethatis,foramantobejoinedtoa
woman,andforahusbandtobejoinedtoawife
thenwetreaddangerouslyifwewouldseekto
overturnthis,directlyorindirectly.Ifwegetthis
onewrong,humanordainedcivilrightswillnot
protectusforGodsjudgmentinHeaven.

StillmyheartisalwayssaddenedwhenIhear
Christiansvilifyinghomosexuals.The
admonitiontohatethesinandlovethesinner
seemslostonthese.Fortunatelytheyareonlya
smallminority.Theyareneverthelessalarge
embarrassmenttotheChurchofChrist,
especiallywhenthemediadelightstoshowcase
themandignoresthemuchlargerpartofthe
Churchthatwishestoofferfriendshipand

reconciliationANDredemption.Ifanyonewishes
toidentifytheseChristians,theyaretheones
whobelievehomosexualityisasinbutarehappy
tobefriendanyhomosexualwhowishestoleave
thegaylifestyle(asin,havethemoverfordinner
orgoouttoamoviewith)andareevercourteous
tothosewhowishtoremainhomosexualsand
evercometotheiraidwhenintrouble.This
constitutesbeingintheworldbutnotofit.
Commoncourtesytoallisasmuchapartofthe
Christiancallingasbeingunalterablyopposedto
sin.Truelovetellsustoloveourenemiesaswell
astostaypurepersonallyinanadulterousworld.

Thisamicuscuriaebriefwillprobablyhaveno
effectonthosecommittedtotheirrespective

causes.Theyhavetoomuchinvested.Frankly,
bothsidesoftheissueasportrayedinthemedia
leavemecold.Itseemsthatoncewehavemade
upourminds,anyappealstoalternate
resolutionsareeasilydeflected.Beingproperly
labeledasahomophobeorapervertismuch
easierwhennoonewantstolisten.Butiffora
fewIcanbeavoiceofcalmthatoffersdifferent
viewofthings,especiallyinanincreasingly
turbulentandpolarizedsea,thenIamsatisfied.

Re:AdoptionSomuchenergyandtimearespent
onqualifyingprospectiveadoptiveparents.Why?
Presumablythisistoreasonablyinsurethatthe
adoptedchildwillberaisedinastablehome.But
ifthereisa99%likelihoodofthatchildturning

outtobeheterosexual2,howdoesitmakesenseto
send a child to a household where neither of the
partnerscanmodelnorrelatetothatsexuality?

advances,neverhadthequestionrevolvedaround
changingthedefinitionofmarriagefromone
manandonewomantoanyoneinaloving,
committedrelationship.Equalityofraceorsex
isnotthesameasconflatingallloveas
marriageablelove.

bringyouranswerovertoaddresswhywedont
haveseparatebathroomsforhomosexualsand
heterosexuals.Wouldntthereasonsbethesame?
Andagain,whydoweseparatethesexesinthe
military,thatis,whyaretheygivenseparate

barracksandbathingfacilities?Andagain,bring
youranswerovertoaddresswhywedont
separatebarracksandbathingfacilitiesfor
heterosexualsandhomosexualstoseeifthe
reasonswouldnotbethesame.Forme,thisis
thereasonthathomosexualityisincompatible
withmilitaryservice,notfromanyquestionsof
competenceorbraveryorpatriotism.

Re:PolygamyThoseagainstgaymarriage
correctlypointoutthatifmarriageisconferredon
anyunionbasedonaloving,committed
relationship,thenlittleobjectioncanbe
interposedagainstincestualrelationships.This
israreandunlikelytobeanissueanytimesoon.
Butpolygamyisfoundinmanyplaces.Granted,
itiscurrentlyhiddenorinobscureculturesor

religions,butitissuretobethenextnon
traditionalmarriagehottopic.Andadvocates
willfindsupportintheanimalkingdom,history,
andeconomiclogic,justliketheydonowforgay
marriage.Astoowillbetheirproteststhatlove
andcommitmentandcaringarealtogether
possiblewithinsuchunions,andthatitisa
callousandcrueldecisiontodiscriminateagainst
thesekindandjustpeople.Sowhoshallsay
themnay?

CONCLUSION
AstoQuestion1,theFourteenthAmendment
doesnotrequireastatetolicenseasamesex
loving,committedrelationshipthatbyits
natureisoutsidethejurisdictionsdefinitionof
marriage.AstoQuestion2,theFourteenth

Amendmentlikewisedoesnotrequireastateto
recognizemarriagesitwouldnotsolemnizeunder
statelaw.Accordingly,thedecisionoftheCourt
ofAppealsshouldbeaffirmed.However,
individualsstillhavefreedomtocontract,gift,
andbequeathwithoutrespecttomarriage,which
otherstatesmusthonoraccordingtotheFull
FaithandCreditclauseofArticleIV,Section1of
theConstitution.
