SUBJECT: AMENDMENT TO THE MANUAL OF APPROVALS ON
ADMINISTRATIVE, HUMAN RESOURCE, FINANCIAL
AND INTERNAL AUDITING MATTERS

In the interest of service and in order to expedite the processing of


documents pertaining to administrative, human resource, financial and internal
auditing matters, a new Manual of Approval is hereby prescribed.
The attached manual shall form part of this Administrative Order and shall
serve as guide and reference on the delegated authorities to officials in the
Central Office, Bureaus, Regional Offices, PENROs, CENROs and Attached
Agencies.
This Order shall take effect immediately and all parts or provisions of DAO
Nos. 2000-11 and 98-24 and DENR Memorandum Circulars on administrative,
human resource, and financial matters are hereby amended, accordingly.

COVERAGE AND GENERAL PROVISIONS


I.ADMINISTRATIVE

APPOINTMENT
The PERSONNEL SELECTION BOARD (PSB) shall cover both the recruitment and
and 2ndlevels of the career service who are entering

Disciplinary Actions
The general rule in the law on Public Officers is that the power to appoint carries with it
the power to remove an employee. The Civil Service laws, rules and regulations govern
administrative proceedings including imposition of penalties.
The Central Office Grievance Committee is composed of the following:

Reassignment outside aeoaraphical location if with consent shall have no limit.


However, if it is without consent, reassignment shall be for one (1) ..
A-Ryear only. Reassignment outside geographical location may be from
one regional office (RO) to another RO or from the RO to the Central Office (CO)
and vice-versa.
Reassignment is presumed to be regular and made in the interest of public
service unless proven otherwise or if it constitutes constructive dismissal.
Constructive dismissal exists when an official or employee quits his or her work
because of the agency head's unreasonable, humiliating, or demeaning
actuations, which render continued work impossible because of geographic
location, financial dislocation and performance of other duties and responsibilities
inconsistent with those attached to the position. Hence, the employee is deemed
illegally dismissed. This may occur although there is no diminution or reduction
in rank, status or salary of the employee.

GENERAL PAYROLL
The General Payroll shall be used for the payment of salaries, wages, overtime
pay, honoraria and other emoluments of government officers and employees. This form
shall be prepared in triplicate copies to be distributed as follows:
Original -Accounting Unit
Duplicate Copy - Cash Unit
Triplicate Copy - Payroll Section

PREVENTIVE SUSPENSION
Preventive suspension of a civil service employee or officer pending an
investigation can be ordered even without a hearing because such suspension is not a
penalty but only a preliminary step in an administrative investigation. Further, if found not
guilty, procedural guidelines shall be formulated separately by the Legal Service.
However, when a respondent's guilt is confirmed, preventive suspension is
punitive and is considered part of the penalty, pending hidher appeal. The purpose is to
prevent the accused from using his position or ofice to influence prospective witnesses
or tamper with the records which may be vital in the prosecution of the case against him.

The Appointing Authority in any Department, Bureau, Regional Offices, etc. may
preventively suspend any subordinate officer or employee pending an investigation, if
the charge against such officer or employee involves dishonesty, oppression or grave
misconduct, or neglect in the performance of duty, or if there are reasons to believe that
the respondent is guilty of charges which would warrant his removal from the service
(Section 51, Executive Order No. 292, 1987).
