Your child comes home one day and says, Mr. Smith came to school wearing a dress
today and told the class that we are now supposed to call him Ms. Smith; then he read a
book to us about it!
Your request to transfer your child to another teacher?
Your child comes home one day and says John came to school today dressed as a girl
and the teacher said he is allowed to use the girls restroom now.
Your child does not want to use the bathroom when John is in there and now does not
want to go to school.

STOP THE FAIRFAX COUNTY SCHOOL BOARD POLICY CHANGE
On MAY 7, 2015, the FCPS Board plans to vote to expand its Non-Discrimination Policy 1450 to
include Gender Identity as a special protected group. The FCPS Board has made no effort to
engage parents or advise the public what this means for student or employee safety, respect of
privacy, parental rights or the right to a distraction-free, education-centered environment.

THIS POLICY CHANGE BY THE FAIRFAX COUNTY SCHOOL BOARD IS A NO-GO!

CREATES MORE QUESTIONS AND PROBLEMS THAN WHAT IT TRIES TO SOLVE!
1.

The change is not needed.


There have been no situations that the current policy has
not handled. Policy 1450 already prohibits discrimination
based on sex.
Technically and legally what we already have does
include gender identity. Ilryong Moon, FCPS Board
Member At-Large, 3-12-15. So, why does Moon support
expanding the language of Policy 1450 to include gender
identity?

Why would the FCPS Board establish policy which will


force vulnerable opposite sex interactions in
restrooms or locker rooms?
There is no state or federal law that that requires school
districts to grant students access to facilities dedicated to
the opposite sex. Trying to address adult employees or
even children struggling with sexual identity confusion that
then creates discomfort for the other employees and
children isnt a solution, its a problem.

Will the FCPS Board move to open bathrooms and


locker rooms to students identifying as the opposite
sex?
Schools in two other Virginia counties have already dealt
with this controversy. Their lawyers, the ACLU and the
Virginia School Boards Association all recommended this
to the boards involved.
We should put it in writing so we could, in fact, enforce it if
it ever came to that. Dan Storck, FCPS Board Member,
Mount Vernon, about adding gender identity; he did not
elaborate on what he meant by enforce.

There will be a domino effect into the community on


out of school activities such as community sports
leagues and clubs.
No one knows the full impact of expanding Policy 1450
language due to lack of parent and public engagement.
How will the FCPS Board, and then other community
youth leagues, address students who gender identify with
the opposite sex for student athletes, including club
sports?

The FCPS Board claims their impetus to change and


expand this policy is the March 4, 2015 Attorney
General Opinion of Mark Herring.
However, Mr. Herrings opinion contradicts eight other
Virginia AG Opinions Democrats and Republicans - from
1982 to 2010. These Opinions all concluded that the
Virginia General Assembly is the only body with authority
to establish or change public policy to define classes for
forbidden discrimination under Virginia law.
What is the potential liability for the FCPS Board and
taxpayers if all the previous AG opinions prevail?

The FCPS Superintendent will hire a consultant to set


the regulations and accommodations AFTER the
FCPS Board approves the expansion of language and
passes the Policy 1450 change and all without
consultation or engagement with parents and the
community!
Parents will only learn of the impact AFTER it is passed
and it will be too late to undo or protect children and
employees from unintended consequences.

Policy 1450 is not only about students but includes all


teachers and employees of the school system.
Fairfax County Schools is the largest employer in the state
with over 45,000 full and part time employees.
How will this policy change affect a transgender teacher
who has dressed as a male but gender identifies as a
female? Will this policy change allow that teacher to come
to school dressed as the opposite sex? How will this affect
drama, coaches, trainers, counselors, sanctioned
overnight class trips and more?

How will the FCPS Board ensure the issue of privacy


and safety for the vast majority of students and staff?
Granting special privileges to a few at the expense of
privacy for the majority is not an answer. The FCPS Board
must protect a vulnerable population from bullying and
harassment but not at the rights of the majority. A Privacy
Policy should be drafted with parent and public
engagement to protect the privacy rights of students and
employees alike.
