Late last year, the Italian Army revealed it would be taking
a stand for the Italian people, by selling their own medical
marijuana and undercutting current prices. Now, less than
one year later the Army is almost ready to begin sales.
According to iMarijuana.com, Italian law reads as follows:
Medical use of substances prepared with marijuana is
legal in Italy, if provided by medical prescription. Otherwise,
cannabis is illegal in Italy and an imprisonment of 1-6
years for small amounts and imprisonment of 6-20 years
may be imposed on big amounts of cultivation.
The use of medical cannabis to qualified patients has
been legal since 2007, but since there are no licensed
producers in the country and imported cannabis is so
costly, patients are forced to obtain their medicine via
black market purchases. Imported grams can cost up
to 40 euros ($45) each making it inaccessible for most
patients.
The secure army facility housing the grow operation
is located just outside of Florence. It was chosen,
as it is currently responsible for developing several
pharmaceuticals and already has the necessary security
in place. Reportedly, it will produce 100kg (220lb) annually.
Colonel Antonio Medica, Director of the Facility, tells the
Corriere della Sera website, Were aiming to lower the
price to under 15 euros, maybe even around 5 euros
per gram. By moving production to the country, it will
drastically drop prices and allow for more patients to
obtain the medicine they need.
Currently, private cultivation and distribution of cannabis
is still illegal in Italy.

CEO Krystal Kithara is a young entrepreneur, who after

graduating with a business degree started several small
businesses, interned at a marketing agency, and even
worked in corporate media, as an account executive.
Shortly thereafter, she realized there was a way for her
to impact the world, through cannabis, and thus, Yummi
Karma was born.
She saw a need in the market and realized she was just
the person to fill it. Yummi Karma focuses on products
that are unique and favored by women. By using this
approach, Yummi Karma is quickly making a name for
themselves.
The brand is determined to bring the highest quality
products to patients and strives to help change the face
of cannabis. Kithara is adamant about being part of the
cause; she is a supporter of Women Grow, an organization
that empowers women in the industry and even donates
of portion of their proceeds to organizations dedicated to
making our industry better and safer.
Yummi Karma offers a full line of savory edibles, something
that is severely lacking in this business. Coming from
someone who does not have a sweet tooth nor wants
to consume 3,000 calories in one sitting, to receive the
desired effects of my medicine, I could not have been
anymore excited when a bottle of infused salad dressing
came across my desk for the first time.
Their savory line currently consists of two salad dressings;
Balsamic Vinaigrette and Asian Sesame, as well as a full
line of sauces; Honey BBQ Sauce, Teriyaki Sauce, Hot
Sauce and Sriracha Sauce. The BBQ sauce is by far my
favorite, and is just as good as (arguably better than) any
mainstream BBQ sauce. It is both sweet and smoky, think
more Sweet Baby Rays than Jack Daniels.
As opposed to most edibles on the market, there is only
a hint of the cannabis flavor, not enough to overpower
the flavor in the sauces. This is something extremely
attractive to those who may be just starting with cannabis
or even folks like myself who hate the taste of it shh,

dont tell my bosses I dont like eating weed!

I wouldnt want to forget about YKs hot sauces either. Being
from Southern California, I can handle the heat and am a
natural skeptic when given any new hot sauces; however, I did
really enjoy both the Sriracha sauce and hot sauce. While the
Sriracha sauce is more flavorful, the heat is subtle, whereas
the heat of the hot sauce has a quick onset and lingering
flavor. On my personal hot sauce Richter scale, Id rate the
Sriracha sauce at - 4 and the hot sauce 6.5.
Yummi Karma has also recently extended their savory
product line to include drumroll please INFUSED POTATO
CHIPS! I hope all of you are as excited about this as I am! I
mean, who wouldnt be excited about potato chips, but these
are infused potato chips, that come in Salt & Pepper as well
as Sriracha flavors. These are not like the bag of Lays you get
at the market. My taste buds danced as I put a visibly hand-cut
chip into my mouth.
The Sriracha chips are obviously nothing short of amazing, but
it was the salt & pepper chips that were perfectly seasoned
and delectable (and green).
In addition to the aforementioned products, Yummi Karma
has added another not so savory, yet still not sugary-sweet
product, Apple Crisps. These delicious dehydrated apples are
dusted in cinnamon and are the perfect on-the-go snack for
anyone. Not too sweet, but they are a healthier alternative to
the usual infused baked goods.
Yummi Karma was created to fill a very apparent gap in the
market and clearly they are accomplishing that feat, and then
some. As far as we can tell, this company will only continue
to grow and succeed. This brand is spot on from everything
including packaging to flavor and I am personally eager to see
what comes next from this zesty company!
Spoiler Alert: Yummi Karma is launching a female-geared
collection called Canna Girls by Yummi Karma. This line will
feature topicals and tinctures specifically formulated to help
women! Ladies, trust me when I say you should have gone out
and picked up these new products, yesterday.
Cheers & Happy Medicating!

Upon raiding her home, the Garden City Police Department
stated they found approximately 1 1/4 pounds of suspected
marijuana was located to include a lab for manufacturing
cannabis oil on the kitchen table.
She faces possible charges of: Possession of Marijuana with
Intent to Distribute, Felony Possession of Drug Paraphernalia,
Misdemeanor Possession of Drug Paraphernalia, and
Endangering a Child. She has yet to be formally charged.
Her son was officially seized and placed into protective custody
until an emergency hearing was scheduled. Shonas ex was
ultimately granted custody of the child as she lost the hearing
on April 20. Since then, a gag order has been issued and it is
unclear if Banda will, in fact, be charged.

WICHITA, KS - Cannabis activist and author of Live Free or Die:
Reclaim your life Reclaim Your Country!, Shona Banda, was met
with stern police officers at her front door and in her backyard as
she returned to her home on March 24 at 3pm.
The officers demanded access to her home, in suspicion of
possession of marijuana, which is illegal in the state of Kansas.
Bewildered, (as she was unaware of the events occurring earlier
in the day at her sons school), she denied authorities entry into
her home without a search warrant. The officers would not let
Banda enter the premises as they waited the three hours for it to
be issued.
Earlier that afternoon, in a drug education class, Shonas 11-yearold son spoke out and contradicted police officers anti-cannabis
propaganda that he knew to be false. He was removed and
questioned by authorities without consent from either Banda or
her estranged husband.

On May 7, HB 2048 was passed by the House and is heading

to the Senate for a vote. If passed, the bill will decrease penalties
for marijuana possession, allow the limited production and sale
of hemp oil for seizure treatments, use of this oil will be granted
to qualifying the patients, and study uses of industrial hemp.
This bill will decrease states overcrowded prisons and save
more than $1.7 million over the next two fiscal years, according
to state estimates.
It would allow only state-licensed productions to grow and
create hemp oil. The bill also mandates that an extract,
mixture or preparation containing cannabis plant material that
is no more than 3% tetrahydrocannabinol (THC) by weight.
Rep. John Wilson (D) from Lawrence, crafted the medical
marijuana language and said that only residents with severe
seizure disorders would be allowed to purchase the hemp oil,
estimating the number at about 24,000 patients.

According to a Garden City Police Department press release,

officers were initially contacted to check the welfare of Bandas
son after he reportedly told school officials, His mother and other
adults in his residence were avid drug users and that there was a
lot of drug use occurring in his residence.

Shona is a true patient who calls marijuana, cannabis and found a

way to treat her Crohns disease by vaporizing the oil, back when
she lived in Colorado. Even though she lives in Kansas, she keeps
a small personal supply on hand to keep her symptoms at bay.

HAWAII LEGALIZES
DISPENSARY STOREFRONTS
(15 YEARS LATE)

DAN CAPENER
STAFF EDITOR
May 8, 2015 House Bill 321, allowing up to
16 dispensaries throughout the Hawaiian
Islands, was approved for Hawaii Gov. David
Iges signature. The bill came 15 years after
Hawaii approved the use of medical cannabis,
but at that time, failed to create a dispensary
system for customers to purchase the
product. Thus until now, users had to either
grow their own, or purchase on the black
market.
The Hawaii Senate voted unanimously and
the House voted 36-13 to pass the bill,
allowing 8 licenses, each license covers up
to two dispensaries, and two production
centers, totaling 16 stores and production
outlets. It allows up to 6 on Oahu, 4 each
on Maui and the big island of Hawaii, and 2
on Kauai. Governor Ige, a proponent of this
measure, is expected to sign the bill.
Requirements for the licenses are: $5,000
application fee, $75,000 per license annual
fee if selected, a stringent security check, and
a history of success in business along with
1.2 million in accessible funds. Applications
for dispensary licenses would become
available in January.
The measure almost did not get out of the
committee when it apparently died after
the chief negotiators, Sen. Josh Green and
Rep. Della Au Belatti, could not reach an
agreement, in the final hour of conference
committee deliberations. Green wanted to
require businesses to have at least $2 million
and individual applicants to be limited to
health care providers. The final version does
not have any such requirement.
Green originally pushed for allowing just one
licensee per county, while Belatti originally
requested 26. The new bill will allow eight
total, with three on Oahu. The final sticking
point that halted negotiations came when
Green wanted the state to start accepting
applications as soon as July 15 of this year,
with licenses being awarded first-come, firstserved. Belatti said the license awards should
be merit-based.

18

The merit system, which may allow for

legislative or gubernatorial discretion as
to who is the best qualified, won out. In an

HAWAII STOREFRONTS

unusual move, Senate President Donna

Mercado Kim and House Speaker Joe Souki
decided to reconsider the measure after
16 senators signed a petition expressing
support for the final House draft of the bill.
Committee chairman Green was removed
from the committee and was replaced as
Chief Senate Negotiator, by Sen. Will Espero,
who took over as lead negotiator for the
Senate. After the passage of the measure
Espero said, Hawaii finally got it right, we are
now on the verge of having a safe, secure
product for our patients who need this, and in
particular the children who will benefit greatly
from medical marijuana.
Later in the week, legislature approved the bill.
Unlike the Senate, which passed the measure
unanimously, there were mixed feelings from
House members, who were concerned over
what this measure would lead to, namely
legalization of recreational marijuana. Rep.
Marcus Oshiro (D) said he wants a well-run,
carefully regulated system for providing
medical marijuana to patients, but the
proposed law does not properly spell out how
the operators of this lucrative dispensary
business will be selected. He said the bills
language allows dispensary operators to
subcontract portions of their operations,
which could get around background check
and other safeguards. On the other side of
the debate, House health chairwoman Della
Au Belatti noted, this bill has had many hands
work on it and is truly the peoples bill.

Hawaii will start accepting licensee
applications Jan. 11, 2016. The application
window will close Jan. 29, after which the
Department of Health will evaluate the
applications. Licensees will be announced on
April 15. Under the proposal, dispensaries
could begin operating as soon as July 2016.
Several Hawaii based bloggers have
expressed their disdain towards the big and
rich business requirements, including the 1.2
million in assets needed, in order, to apply
for a license. They feel that small business
entrepreneurs and most of the local small
businesses (such as head shops) are left
out in the cold with this unfair advantage.
The $5,000 non-refundable application
fee, and the $75,000 annual license fees
are exorbitant. Add the cost of securing a
storefront dispensary, and a location for grow
operations, and you come out with an overall

start-up cost that was meant specifically for

big businesses and very rich individuals.
Many want to know if the intent of the bill is to
provide access to people in need of medical
cannabis or is it to serve revenue generation
for the state of Hawaii and select businesses
that may or may not have put a little cash
down in campaign contributions?

WHATS NEXT?

Stephen Pingree, a Lawyer from UCSD and

California Western Law School blogged
a capsulized itinerary of the measures
necessary for a potential licensee before
applying, along with his positive comments of
the bill passed.
H.B.321 H.D.1 S.D.2 C.D.1 is an excellent
legal precedent for medical marijuana
patients to legally obtain their medicine. The
law will be amended and improved on at
the next legislative session: all other states
that have legalized medical marijuana
have done so. For now it is critical that all
potential applicants understand not just the
law, but, all the legal, financial and business
parts that must be organized before the
application deadline of January 12, 2016.
Besides meeting the legal entity and owner
requirements, applicants need to have
financial resources of $1.2 million plus fees,
financial statements, tax documents, audit
procedures and resources, secure two
physical properties for the dispensary and
the grow/production facilities (2 for each
dispensary license), a security plan, inventory
control seed to sale software, survey and
architectural plans for the dispensary and the
grow/production facilities (up to a maximum
of 3,000 plants), grow and extraction
expertise, employee procedures, criminal
background checks, transportation security,
product development and packaging, testing,
State and Federal law coordination and, more.
Stephen P. Pingree, J.D., Attorney at Law,
www.hawaiimarijuanabusinesslawyer.com.
The general consensus on the dispensary
bill is that it will greatly increase the number
of medical marijuana users, with a readily
available supply that is inspected for quality
and safety. Hawaii residents will still have to
wait a year when dispensaries open to see
the results.

2015-041.

B. LE GRAND
EDITOR-IN-CHIEF
Puerto Rican Gov. Alejandro Garcia Padilla (D), signed an executive
order May 3, that would have authorized the medicinal use of
marijuana, for certain conditions under the control of the health
department.
The original heavily debated bill introduced in 2013 was never put
to vote. The U.S. Territory does not currently have a ballot initiative
process. Gov. Padilla used his executive authority to immediately
enact the bill. Puerto Rico would have joined the 23 U.S. States,
District of Colombia and Guam that allow medical marijuana.
Gov. Padilla said in a statement, Were taking a significant step
in the area of health that is fundamental to our development and
quality of life... I am sure that many patients will receive appropriate
treatment that will offer them new hope.
The governor added that several studies conducted in the United
States, demonstrated that cannabis could assist in pain relief
from serious diseases. It is not certain if they would allow local
cultivation of cannabis or plan to import the medicine.
Less than five days later, he reversed his proposal, stating they
will not legalize the smoking of marijuana for medicinal purposes.
However, patients would be able to obtain other forms of cannabis
consumption, such as inhalants or capsules.
Padilla gave legalization proponents false hope when he directed
Health Secretary Ana Rius to authorize use of some or all
controlled substances or derivatives of cannabis for medicinal
use. Rius was then to submit a report that would outline how the
program should be carried out, as well as determine its impact
and future implementation. She also noted that the University of
Puerto Rico is collaborating with two U.S. companies to determine
the use and production of medical marijuana.
Justice Secretary Cesar Miranda made a statement to the
Associated Press, smoking marijuana is not being contemplated
as part of a medical treatment.
Rius seconded the notion by noting that smoking marijuana
remains a crime in Puerto Rico. It is unclear whether the joint
research with the U.S. companies has also been suspended, or
whether Padilla will clarify exactly what legal methods of consuming
medicinal cannabis will be made available to patients.

CANADA CANNABIS
LEGALIZATION UPDATE
DAN CAPENER
STAFF EDITOR
Close to 100 Marijuana dispensaries in Vancouver, Canada
have the city calling for stricter regulations, including a
$30,000 licensing fee. The city disclosed a list of at least
84 Marijuana businesses, with local CBC media adding at
least 9 more, including start-ups for a total of at least 93
businesses related to Marijuana. At present some are not
licensed, and many accept a notarized, signed statement of
illness for purchase, without a prescription. One of the most
talked about stipulations is for dispensaries to be situated
at least 300 meters from schools. At present 40% of the
businesses do not meet that proposed requirement.
Vancouvers lack of cannabis business regulations has
spawned huge growth in dispensaries with little regulation, or
enforcement. According to Tobin Postma, a city spokesman,
The city has no jurisdiction on regulating the selling of
products all we can do is regulate land use. He said,
the city hopes to create a new business license category,
charge a $30,000 fee, ban pot shops from certain areas
and require them to be 300 meters away from schools,
community centers and each other. Public safety is the main
concern as well as accessibility for the users.
While Vancouver debates dispensary regulations, marijuana
for medicinal use is the focus. Legalization for recreational
use may be a long time coming, especially since the present
regulations lack the teeth necessary to prevent recreational
use. Canadas marijuana laws are set at the federal level,
meaning that legalization would in theory provide the
opportunity for foreign investment and exports.
Before Canada can consider opening a recreational
marijuana market, it must first successfully implement their
new medicinal marijuana regulations, which have already
proved problematic for many of Canadas 40,000 medicinal
marijuana users. But with nearly 100 dispensaries in
Vancouver alone, there are buyers and users that get their
pot much easier than United State cites, and the Canadian
pot market is booming.
However, while Vancouver is looking at regulating the
citys booming marijuana dispensary business, Victoria
is considering a crackdown on those flouting its bylaws.
A recent count of 18 dispensaries, up from 4 last year in
Victoria, showed the majority operating without a license. City
staff is urging council to direct them to step up enforcement
of existing bylaws and business license rules, meaning that
marijuana-related businesses that wont comply could be
shut down. Victoria is the countrys Capital, and the city
wants to make an example of businesses that dont follow
the law, or arent licensed. It seems the country is following
the USs path, perhaps, lagging behind a year or two.
On the other hand our neighbor to the south, Puerto Rico
this month legalized Marijuana, and it looks like we are
following in that countrys footsteps, perhaps a year or two
behind, still picking up the pace.

How To Write A FoolProof

Medibles Recipe (AKA Formulation)
EDIBLES SAFETY:

RACHEL ZEMSER
STAFF EDITOR
In the Medibles worldaccuracy is very important. You need
every piece of brownie or chocolate to be the same size and
weight - as well having consistent amounts of active medicine
inside. I often get calls from small food companies asking me
how they can scale up their recipe to an industrial size. Clients
will often ask, I measure my liquids with a measuring cup and
I use teaspoons to weight out my salt and sugar- is that ok??
I answer NO!! A recipe and a formula are not really the same
thing (although they are often used interchangeably) a recipe
is what you make in your house, and record your amounts in
cups, tablespoons and pinches. A formula is how a professional
food maker will document your information and is based on
pounds, kilograms, grams and other weight measurements.
These weights are then converted to percentages so any
amount or batch size can be made on those confirmed
percentages.
This means that if you have 2 cups of water in your recipe, you
have to weigh it outand 2 cups of honey will not weigh the
same amount as that water, and a cup of corn syrup will also
have a different weight. This is because all these ingredients
have different densities. The density of water is 1 gram per 1
ml (volume) but the density of honey is about 1.4 gram per 1
ml (volume) and different types of honey even have different
densities!

Here is a sample of a simple conversion of a homemade recipe

to a professional industrial formulation:
Typical Chocolate Chip Cookie Recipe

Recipe Converted to Weights

(Approximate)

2-1/4 cups All Purpose Baking Flour

320 grams

1-teaspoon baking soda

4.8 grams

1-teaspoon salt

165 grams

1 teaspoon vanilla extract

4 grams

2 large eggs

97 grams

1 teaspoon vanilla extract

303 grams

2 large eggs

122 grams

This very simple mathematical conversion will ensure that

your staff will be consistent with their food measurements.
Consistency will translate to cost savings as well as ensure
that each portion will have the right amount of active medicinal
ingredients. After all, if the batch comes out too large, the
medicine portion may be, by percentagenot as much as it
was the last time you made it.

Supreme Court
Calls Obama
to Comment
on Inter-State
Cannabis Dispute
KYMBER WARD
STAFF EDITOR
Nebraska and Oklahoma appealed to the Supreme Court
to reverse the 2012 voters decision to legalize the use of
recreational cannabis in Colorado in December 2014. The
states are unhappy about the issues it has caused along
their borders. The states cite it as a cross border nuisance,
increasing the amount of cannabis supply in the region.
The Supreme Court has asked the Obama Administration
to weigh in on the issue as it considers the lawsuit. The
Administration has always left it to the State to decide
individually about cannabis, although it is illegal at a federal
level. The Department of Justice will continue to investigate.

Colorado Bill May Allow

Medical Marijuana in Schools

medible FEATURE:
B. LE GRAND
EDITOR-IN-CHIEF

DENVER - Senate Bill 14 cracks down on large, unregulated, medical

cannabis grow operated by caregivers. However, the bill was
amended May 4, which has passed the legislature vote to allow a
students prescribed medical marijuana onto school property. The bill
has been passed to Gov. John Hickenlooper (D), who has 30 days
to sign or reject it. A spokeswoman for the governor explained that
he would be signing it, according to Fox News. The revision, called
Jacks Amendment, is named for Jack Splitt, a 14-year-old middle
school student from Lakewood. Jacks mother testified that her son
is unable to attend school if using medical marijuana as it is banned
from school property.
Splitt suffers from dystonia, a neurological movement disorder that
causes his muscles to contract uncontrollably. He also has spastic
cerebral palsy. Both of his severe conditions have symptoms that
are alleviated by medicinal cannabis in a way that no other medicine
provides.
Stacey Linn, Jacks mother, said her son could return to school, only if
SB 14 becomes law, with Jacks Amendment intact.
Its his favorite thing to do, Linn said, noting that other kids get to take
prescribed speed and narcotics on school property.
The bill requires cannabis to be administered in an appropriate time
and place, by a parent or medical professional that accompanies the
child to school. But the primary purpose of SB14 is to create a stricter
system for regulating undocumented medical marijuana caregivers.
The bill sets the limit on grows to 99 plants, without registration.

Rep. Jonathan Singer, D-Longmont, said that before dispensaries were

approved in 2010, most medical marijuana in Colorado went through
caregivers who grow marijuana on behalf of patients who have a doctors
recommendation for marijuana.
Singer said that because caregivers operate outside the regulated
dispensary system, it has caused confusion for law enforcement when
they come across large undocumented grows. In one high-profile case,
32 people who hid illegal grows behind the caregiver law were indicted for
trafficking marijuana across state lines.
Were going to be able to do something that will provide clarity for law
enforcement around the issue of medical marijuana caregivers, but
also providing protections to patients, especially kids who need to be
going to school, Singer said. We needed to come up with some hard
and fast numbers of what is acceptable and what isnt acceptable ... the
caregiver model still has a place here in Colorado, as long as we dont
have dispensaries on the eastern plains, western slope and cities like
Longmont.
Jason Warf, head of the Southern Colorado Cannabis Council, said the
amendment for Jack would be useless because the new plant limit is
going to severely limit the supply of medical marijuana and drive up the
cost.
It will literally kill patients, Warf said. Most patients who use caregivers in
Colorado are our sickest patients. Its impossible to buy the amount they
need in dispensaries.

ARIZONA BILL TO LEGALIZE MARIJUANA

B. LE GRAND
EDITOR-IN-CHIEF
JP Holyoak was, in a way, chosen by the cannabis industry. His
daughter, Reese, suffers from a rare illness that he believes is
helped by the power of medical cannabis.
Holyoak was a financial advisor, before he built his commercial
cannabis nursery, in a warehouse, in an industrial area near
Phoenix Sky Harbor airport. He operates two dispensaries
that have served approximately 9,000 patients since their
doors opened last year. Holyoak believes that cannabis should
be legalized recreationally not because of enthusiasm for the
stoner culture, but because he considers it sound conservative
policy.
Holyoak, a Republican, said he has learned about the total futility
of the war on drugs and is convinced that the only two choices
are tax and regulate, or enrich criminals. Because of this, he
is backing a new ballot initiative asking Arizona voters to legalize
recreational pot. He sees it as a wholly separate issue from
medical marijuana, which was narrowly approved by the state in
2010 when yes won 50.13% of the vote.
The current campaign needs to secure about 150,000 valid
signatures by June 2016, to get the proposal on the ballot for
the November voting season. Im comfortable and confident that

56

well gather the signatures, said Holyoak.

If the ballot passes, Arizona will become the fifth state to pass such
legislation, after Washington, Colorado, Oregon and Alaska. Even
when state legalization happens, the road to Federal rescheduling
is a long and arduous one.
Even though the petition drive is just getting started in Arizona,
the battle for hearts and minds has already begun and is gaining
traction. Near the Phoenix airport is a huge billboard with a picture
of a baby eating a cookie. Would your child know if this cookie had
pot in it? asks the ad.
Under the proposed bill, adults 21 years of age and up would be
able to buy a maximum amount of 1oz of cannabis flower from a
state-licensed retailer. It would limit personal home growing to six
plants per person and twelve plants per household.
A 15% marijuana tax would be instated and revenue from the
cannabis tax would go towards regulation and public health
education. Local cities would have the opportunity to prohibit
sales, private property owners can prevent it from being sold on
their premises, and employers would be able to enforce drug-free
workplaces.
In regulating cannabis similarly to alcohol, emphasizing tight
control and user responsibility, they are walking the path to
convince the skeptics that Arizona will not turn into Amsterdam.

OREGON MAY

HOLD OFF ON EDIBLES UNTIL 2017

B. LE GRAND
EDITOR-IN-CHIEF
Last year, Oregon legalized recreational cannabis. Sales are
expected to begin in early 2016, but edibles may not hit the
retail market until early 2017.
The Oregon Liquor Control Commission, also known as OLCC,
is the governing agency over Oregons recreational cannabis.
Oregons regulatory agencies closely monitored their
predecessors in Colorado and Washington.
On April 1st, the OLCC submitted a letter to the Joint Committee
on implementing Measure 91.
The letter made a case for delaying the sale of edibles,
due to concerns regarding the complexity of developing
rules and procedures that would allow processors to safely
produce edible products under the timelines described in
Measure 91.
The letter identifies several policy issues needing to be
addressed, prior to medible regulation being adopted, and
manufacturers licenses are approved. These concerns
include serving size, packaging/labeling, testing, and
types of edibles.
Oregons liquor commission cites that Colorado and
Washington define a serving of edible cannabis as 10
milligrams of activated THC but there is little conclusive
scientific evidence to support this number.
The lawmakers on the Joint Committee on Implementing
Measure 91 have not yet responded to the liquor commissions
letter.
Read the edible marijuana products section in the Oregon
Liquor Control Commissions letter:
The OLCC has identified a number of policy issues that it
feels should be addressed prior the adoption of rules and
the approval of licenses which manufacture edible marijuana
products:
How much THC should be in any one edible marijuana serving?
Both Colorado and Washington have settled on a rate of 10
milligrams per serving. There is little conclusive scientific
evidence to support this number. The OLCC has asked the
Oregon Health Authority to convene a panel of experts to try
and answer this question. We have asked for an answer as
soon as possible.
How many servings should there be in one product? Some
edible products available in OMMP dispensaries contain 500
milligrams of THC or more. This translates into 50 servings in
a single product. OLCC has asked the OHA for advice on this
issue. Both Colorado and Washington have set a maximum
64

of 10 servings per product or a sum total of 100 milligrams

of THC.
How should these products be labeled with respect to
marijuana? Colorado just completed its third change to its
labeling rules for edible products. Washington is undergoing
another iteration of its rules regarding labeling. Each time a
change has been made the edible manufacturers have had to
make new packaging and labels to meet the new rules.
What labeling should be in place for the underlying food
product? OLCC staff is currently working with the DOA and OHA
to address this issue.
What types of testing should be done on an edible product.
OLCC intends to require potency testing and is working with
food experts to understand what other tests should be in place
before a product can be considered safe.

What type of safety warnings should be included? Colorado

requires its products to indicate how many doses are in a
package, how long it will take before the product will affect the
consumer and warning labels aimed at children. OLCC has
asked OHA for help in developing these standards.
What type of product should be allowed? The general public
has expressed concern regarding products that appeal to
children or mimic existing non-marijuana products. Building
rules that clearly protect children will be complicated. The rules
drafted by both Colorado and Washington are possible models
but OLCC wishes to work with experts in childrens behavior to
assure that products sold in OLCC licensed retail establishes
cannot be confused with non-marijuana products.
What type of advertising should be allowed on the packaging?
Package looks, labels and branding need to be defined by rule to
assure that it is both accurate and does not appeal to children.
The dash one amendments to Senate Bill 844 propose to give
OLCC an additional year to adopt rules related to edibles. This
provision helps to align expectations with the complexity of the
issue and grants the agency the necessary time to get our rules
right.
The OLCC intends to move as quickly as possible to adopt rules
and make edible products available in the recreational market.
General Option:
1. Provide for a one year period to promulgate edible rules,
January 2017 (following anticipated retail location licensing in
the last quarter of 2016).
2. Do not change law and expect that OLCC will manage this
responsibility with the understanding that OLCC should take the
time to get it right (phase-in).

Alaska Regulates
Cannabis with
Official Agency

Chelsea Handler
I like marijuana now!

KYMBER WARD
STAFF EDITOR
Chelsea Handler seems to be moving out of her liquor infused comfort
zone. The self-proclaimed, alcohol enthusiast seems to be slowly
becoming a cannasseur. Back in February, she shared with fans on
Twitter that she had become a legal marijuaner, by going to get her
medicinal cannabis card. She even showed off her newly acquired
card via picture on Twitter.

KYMBER WARD

Alaska joins Colorado in regulating cannabis by a creating a
five-member volunteer team, the Marijuana Control Board. On
Monday, May 4th Gov. Bill Walker (D) signed Bill 123 into law. The
newly created department will operate under the Department
of Commerce, Community, and Economic Development for
administrative and regulatory purposes.
The bill outlines the Governor appointed, five person panel will
consist of, a current resident in rural of Alaska, someone from
the public health sector, someone from the public safety sector,
someone currently in the cannabis industry and either someone
from the general public, or someone else in the cannabis industry.
However, the bill also mandates that no more than two members
be allowed to have the same profession, occupation, or business.
A last minute amendment to the bill, also mandates that anyone
with on parole, probation or convicted of a felony, within five years, is
unable to obtain a license for a marijuana establishment.
I look forward to seeing the hard work of the (Alcoholic Beverage
Control) Board continue, and I know the Marijuana Control Board
has an incredibly big task ahead, Walker stated in a press
release. By empowering the new board with the authority and
resources to develop a strong regulatory framework, Alaska has
the opportunity to establish clear, consistent, and thorough rules
around this substance for the benefit of citizens, licensees, and law
enforcement.
He also indicates that he was a supporter of the bill; however, he
mentions he will not pass any more legislation until regulations are
in place.
The board be closely linked to the Alcohol Control Board, even
sharing a director. Currently, the board has been allocated a budget,
reportedly being mainly used to hire staff, in order to, accommodate
the branch.
Walker also passed Bill 116, extending the termination date of the
Alcoholic Beverage Control Board to June 30, 2018.

Recently, Handler was a guest on NBCs Late Night with Seth Meyers
and she took viewers by surprise when she began to reminisce about
her first run in with infused medibles. She explains that she took edibles
to Mexico on a family trip and as the night went on, ten girls, one by
one, went down. However, in true Handler fashion no story could be
that simple. The night ended with her sister, the reserved lawyer was
the audience to a hilarious set of events and in the end she wasnt
even the one who ended up with no clothes on. Perhaps cannabis will
show us a tamer side of Chelsea!
