INSTRUCTIONS FOR TENDERING

1

Tenders must be submitted strictly in accordance with the instructions given in Section
6 of document 2045-01 Scheme Overview and without qualification. In the event of
any doubt or query, clarification should be sought from the Project Manager or
Engineer.

Completed Tenders shall be returned to The Executive Director and Chief Finance
Officer of Staffordshire Moorlands District Council using the tender return label
provided in the Supplier Evaluation Questionnaire. Tender return envelopes must bear
the tender return sticker only and no other distinguishing marks.
Tenders must arrive no later than 12 noon on January 14th 2013.

All Tenderers are advised that they must not enter into any land or premises to carrying
out surveys or site investigation works without first obtaining the written approval of the
Employer and the owners and occupiers of the lands or premises affected by the
works.

The Employer does not bind itself to accept the lowest or any Tender and no expense
incurred in preparing and submitting a Tender will be paid for. Tenders shall remain
open for a period of TWELVE weeks from the due date for submission.

Site Conditions
The Tenderers attention is drawn to the need to satisfy himself as to the conditions on
site.

CONDITIONS OF CONTRACT
The Conditions of Contract shall be the NEC3 Engineering and Construction Short Contract
(June 2005) with the following amendments:
Contract Data page 3: reference to the conditions of contract; add with amendments
September 2011 after June 2005.
Page CC 12 of 12: the text is deleted and replaced with the following:
If the United Kingdom Housing Grants, Construction and Regeneration Act 1996 as
amended by the Local Democracy, Economic Development and Construction Act 2009
(the Act) applies to this contract, the following additional conditions apply.
Definitions

1.1

(1) The payment due date for an application for payment by the
Contractor is the assessment day which follows receipt of that
application.
(2) The final date for payment is three weeks after the payment
due date.

Assessing the
amount due

1.2

The Contractors application for payment is the notice of

payment specifying the sum that the Contractor considers to be
due at the payment due date (the notified sum). The
Contractors application states the basis on which the amount is
calculated and included details of the calculation.

1.3

The following replaces subclause 50.4

If the Employer intends to pay less than the notified sum, he
notifies the Contractor of the amount which the Employer
considers to be due not later than seven days (the prescribed
period) before the final date for payment. The Employers
notification states the basis on which the amount is calculated
and includes details of the calculation. A Party pays the notified
sum unless he has notified his intention to pay less than the
notified sum.

Compensation
event

1.4

If the Contractor exercises his right under the Act to suspend

performance, it is a compensation event.

The adjudication

1.5

The following replaces subclause 93.3(1)

A Party may issue to the other Party a notice of his intention to
refer a dispute to adjudication at any time. He refers the dispute
to the Adjudicator within one week of the notice.

1.6

The Adjudicator may in his decision allocate his fees and

expenses between the Parties.

1.7

The Adjudicator may, within five days of giving his decision to

the Parties, correct the decision to remove a clerical or
typographical error arising by accident or omission.

1.8

If the Adjudicators decision changes an amount notified as due,

payment of the sum decided by the Adjudicator is due not later
than seven days from the date of the decision or the final date
for payment of the notified amount, whichever is the later.

HEALTH AND SAFETY

The Contractor shall carry out the specified and associated works in accordance with all
current legislation including the Construction (Design and Management) Regulations 2007
(CDM) where applicable.
In accordance with the regulations, the Contractor shall submit a Health & Safety Plan to the
CDM Co-ordinator prior to commencing work.
The Contractor shall ensure that his rates are adequate to meet the cost of making all
necessary arrangements for the Health and Safety and welfare of all persons affected by the
Construction work.
DESCRIPTION OF WORKS
Location
The site is located off the A520 Cheddleton Road, Leek, Staffordshire, ST13 5RE.
The Ordnance Survey reference for the site is 398387-355182
Access
Access to the site is from Cheddleton Road only. Further details are given in Section 4 of
document 2045-01 Scheme Overview.

Silt trap

Description of the Operations

Installation of new drainage system and ancillary works.
The drainage works are to be carried out in two phases followed by a third phase entailing
topdressing and decompaction.
Phase 1 -

Drainage work to commence on April 8th 2013. Drainage works to bottom part
site only, i.e. to the wettest pitches.

Phase 2 -

Drainage to all other areas to commence after the end of the 2012-13 football
season May 7th 2013.

It is to be noted that works shall be suspended during the period 17th- 31st July, inclusive, to
accommodate Leek Show which takes place on the field.
Phase 3 -

Decompaction of existing surfaces and topdressing to follow commencing

August 1st 2013.

The intention is that all pitches will be playable in time for the start of the 2013-14 season.

SPECIFICATION - GENERAL REQUIREMENTS

Programme of Works
All Tenderers must submit a draft programme of works under Section 13 of the Supplier
Evaluation Questionnaire. An update programme shall be submitted by the successful
Contractor for approval by the Engineer before the commencement of the Works. In the
event of Extension of Time being granted in accordance with the Conditions of Contract,
the Contractor shall prepare and submit a revised programme to the Employer for
approval.

Assistance to the Engineer

The Contractor shall provide such assistance to the Engineer or his representative in
carrying out his duties as required.

Materials
No material shall be supplied for the Works without prior approval by the Engineer.
When instructed by the Engineer the Contractor shall submit samples of materials to be
used in the works.
Representative samples of all approved materials shall be kept at the site throughout the
duration of the works.

British Standards
Where a current British Standard Specification or British Standard Code of Practice
published by the British Standards Institution is applicable then all materials used or
supplied, all workmanship and tests , shall be either in accordance with that standard,
any equivalent European Economic Community standard, or to a higher standard.

Services
Copies of responses from the various utility companies are provided in tender document
2045-05 Utility Pack. Any information provided to the Contractor shall be confirmed on
site by liaising with the relevant Authority and by investigation on site. The Contractor
shall determine the exact position of any services on site or affected by the works.

Procedure
Unless otherwise permitted by the Engineer the works shall be carried out in the
sequence set out in the Specification.

Inclement Weather
Work must cease when ground conditions on site are such that poaching and/or deep
rutting of the soil or any other detriment would result.
The Works or any part thereof shall be suspended by the Engineer when, in his opinion,
working conditions are unsuitable due to inclement weather.

Site Meetings
The Contractor shall attend meetings on site as required by the Employer and Engineer.

Traffic Control and Pedestrian Safety

The Contractor shall provide and maintain all necessary signs on public highways as
required by the Employer or by the Police.
The site is open to the public at all times and the Contractor must make provision to
protect the public from all site operations and excavations.
The Contractor shall take all precautions to prevent the spilling of oil, petrol or diesel fuel
from vehicles, plant, storage drums or tanks on any access road or the Site. Any
spillage shall be immediately cleared and the damage made good.

10 Maintenance of Public and Private Roads

The Contractor shall keep clean all public roads, pavements, verges and rights of way
and shall allow for all costs incurred by him in the maintenance of same and for making
good at his own expense any damage thereto when carrying out the Works.
11 Delivery of Plant and Materials
All unloading and loading of Materials and Plant including that belonging to domestic
and nominated sub-contractors is to take place within the boundary of the Site except by
specific agreement with the Employer.
12 Site Restrictions
The Contractor shall confine his activities to the areas of the site directly affected by his
operations unless otherwise instructed by the Employer.
13 Weekend Working
No work will be permitted before 8am or after 7pm or at weekends without the approval
of the Employer and the Engineer.
14 Off Site Trespass
The Contractor or any domestic or nominated sub-contractor shall not trespass upon
adjoining land or property, and shall preclude any rubbish, materials, etc. from being
deposited thereon.
15 Boundary Protection
The Contractor shall protect and avoid all damage to adjoining owners boundaries.
16 Signs
The Contractor shall provide all necessary signs on site necessary for the carrying out of
the works. Other signs or Contactors Adverts shall only be permitted with the approval of
the Employer.
17 Instructions
The Contractors representative on site shall record all Site Queries and Site
Instructions.
18 Staff Welfare Facilities
The Contractor shall provide and maintain adequate sanitary facilities and shelter
accommodation for the use of staff employed on the works. The facilities shall be sited
maintained and cleared away on completion of the works to the satisfaction of the
Employer.
19 Temporary Works
The Contractor shall provide and maintain any temporary works required during the
execution of the Contract and or the protection of the public and remove the same as
required and make good to the satisfaction of the Employer on completion of the Works.
The Contractor will be deemed to have taken due account in his Tender of the total cost
of all temporary works necessary for the proper execution and completion of the
Contract.
20 Dust and Mud
(a) The Contractor must take all reasonable steps to minimise dust nuisance during the
construction of the works.
(b) All existing highways used by the vehicles of the Contractor or any of his SubContractors or suppliers of material or plant, and similarly any new roads which are part
of the works and which are being used by traffic, shall be kept clean and clear of all dust
and mud dropped by the said vehicles or their tyres. Similarly, all dust and mud from the
works spreading on these highways shall be immediately cleared by the Contractor.
(c) Clearance shall be affected immediately by manual sweeping and removal of debris

or, if so directed by the Employer or Engineer, by mechanical sweeping and clearing

equipment and all dust, mud and other debris shall be removed entirely from the road
surface. Additionally, if so directed by the Employer or Engineer, the road surface shall
be hosed or watered using suitable equipment.
(d) Compliance with the foregoing will not relieve the Contractor of any responsibility for
complying with the requirements of any Highway Authority in respect of keeping roads
clean.
21 Noise and Vibrations
The Contractor shall employ the best practical means to minimise noise and vibration
produced by his operations and shall have regard to the recommendations in BS 5228.
Also Noise Control on Construction and Open Sites, the Noise Abatement Act (1960)
and all amendments thereto, and the Department of the Environment Advisory Leaflet
No. 72 Noise Control and Building Sites and such subsequent publications.
22 Clearing Site
The Contractor shall, upon completion of the Works, remove all plant, unused materials,
etc., clean all roads, drains, etc. affected by the Works and leave the whole of the Site in
a clean and tidy condition to the satisfaction of the Employer.

SPECIFICATION - DETAILED REQUIREMENTS

1.

Access
The Contractor shall construct and maintain the site access including haul routes across
the site throughout the duration of the works in a condition to allow for the delivery and
removal of plant and the delivery of materials and such traffic across the site.
The Contractor shall prepare, maintain and provide markers and warning signs for the
site access.
Allowance shall be made for protection of all kerb edgings tarmac surfaces, concrete
paving and existing drains and services. Any damage shall be made good on
completion of the works to the satisfaction of the Employer. Public roads shall be kept
clean at all times.

2.

Storage compound
The Contractor shall provide and maintain a storage compound for equipment and
materials at a location agreed with the Employer throughout the contract period.

3.

Area to be levelled
a) Apply an approved total non residual herbicide to area to be cultivated and levelled
only as shown on Drawing No. STP/071/04C.
b) Rotary cultivate the above area 3(a). Ensure that the sward is thoroughly broken up
and that there is sufficient tilth to allow the topsoil to be re-graded.
c) Strip topsoil from area to be cultivated and levelled as shown on Drawing No.
STP/071/04C and stack for reuse.
Reduce levels by excavating subsoil and disposing of surplus material as specified in
Item 7 below.
Replace topsoil, grade, prepare seedbed, apply pre-seeding fertiliser and sow the
graded area. Ensure a smooth transition between the graded area and the
surrounding area all to the satisfaction of the Employer. On completion the depth of
topsoil throughout the graded area shall not be less than 150 mm
d) Maintain area until the sward is mature. Allow 4 cuts and 1 fertiliser application.

DRAINAGE SYSTEM
4.

Outlet drain
a) Investigate expose and test existing drains and drain outlet in south-west corner of
the field.
b) Introduce an outlet drain as shown on Drawing No. STP/071/03C using 200 mm drain
formed with un-perforated approved plastic pipe. The drain shall be laid to a depth of
650 mm 1000 mm to invert and with a uniform fall along its. Allow for connection to
existing chambers and reinstatement all to the satisfaction of the Employer. Allow for
hand digging over gas main easement.
c) Introduce un-perforated 100 mm drain through running tack and connect to silt
chambers as shown on Drawing No. STP/071/03C.
d) Reinstate running track including base, surface, kerbs and any drains that are
encountered all to the original profile and to the satisfaction of the Employer.

5.

Silt chambers
Excavate for and construct the silt chambers shown on Drawing No. STP/071/03C and
as specified in Drawing No. STP/S1.
The chamber shall be fitted with Grade B cast iron covers and frames to BS 497 the

frames to be bedded on and haunched around in cement mortar. Covers shall be set 25
mm below finished ground level.
Allowance shall be made for inlet and outlet pipes and for pointing and sealing around all
units and pipes to ensure efficient waterproofing.
Surplus subsoil from excavations for the chambers shall be disposed of as specified for
drain trenches.
6.

Drainage
Introduce the drainage system shown on Drawing No. STP/071/03C with 80 mm
diameter laterals at 5 and 6 metre centres as shown on the Drawing.
Perforated plastic mains and catchwater drains shall be laid as shown on Drawing No.
STP/071/03C to a depth of not less than 600 mm or to the invert levels shown.
General
Laying of pipes and backfilling of drain trenches shall not be carried out in temperatures
less than those specified by the pipe manufacturer.
The lateral drains shall be laid at depth of not less than 550 mm to invert. All drains
shall be laid to uniform falls of not less than 1:200. Perforated plastic drain pipes to
BS 4962 and of the sizes shown on drawing shall be used. All joints shall be made with
purpose made connectors and open ends sealed with end stops and all connections
between laterals and mains shall be formed with purpose made junctions of appropriate
sizes.
Lateral drain trenches shall be not less than 150 mm wide. All other drains shall be no
less than 50 mm wider than the outside diameter of the pipe. The trench beds shall be
shaped to fit and secure the pipes centrally.
The position of any existing drains which are cut through or damaged shall be accurately
recorded on a drawing, a copy of which is to be forwarded to the Employer on
completion of the works. Any such drains shall be connected to the new drainage
system using purpose made junctions or otherwise to the satisfaction of the Employer. In
connecting such drains care shall be taken to avoid blocking or obstructing existing or
new drains.
Pipe drainage shall be carried out progressively so that trenches are not left open for
any significant length of time. Pipe laying and backfilling shall be completed on the day
of trench excavation. The site shall be left in a safe condition at the completion of each
working day.
The work shall be carried out causing the minimum damage to the playing surfaces and
surrounds and any damage shall be made good to the satisfaction of the Employer.
All drainage machinery shall be capable of operating on soft ground and either tracked
or fitted with low ground pressure tyres.
Drain laying
a) Excavate topsoil and subsoil to form drain trenches to the required depth and shape
base to receive pipes. The spoil shall be loaded as it is excavated and carted away
as work proceeds. The spoil shall be disposed of as specified in Item 7 below.
b) Lay drain pipes of specified sizes to a true line on a firm subsoil foundation. Purpose
made junctions, connectors and end stops, etc. shall be set into the drain lines as
required.
c) Check all drain lines for line and gradient before placement of stone backfill.
d) Backfill all drain trenches up to 150 mm from ground level using approved clean
durable, 10 mm gauge gravel or stone chippings. Adequately and evenly compact
leaving the surface flat. Cover backfilling with approved medium coarse sand with a

particle size within the central range of the grade curve shown in Appendix 1.
Adequately and evenly firm leaving the sand level with the exposed surface
(approximately 50 mm below finished surface level) to allow topping off with topsoil
see reinstatement item 8 below.
e) All filling shall be carried out carefully to avoid displacement or damage to pipes. All
spillage of spoil, aggregate or debris on the playing surface shall be cleaned up and
removed to the Employers satisfaction.
7.

Spoil disposal
All spoil shall be disposed of on site in areas as shown on Drawing STP/071/04C or as
instructed by the Employer. On completion the spoil heaps shall be graded out and
seeded to the satisfaction of the Employer.

8.

Reinstatement of drain lines

The reinstatement of the drain lines shall be carried out progressively as the drainage
work proceeds and as follows:
a) Supply and place 60 mm firmed depth of topsoil (suitable material excavated from the
site may be used subject to approval of the Employer).
b) Supply and apply 35 g/m2 of granular fertiliser analysis 12% nitrogen: 6.0 %
phosphate: 6.0% potash or similar and approved.
c) Over-seed drain lines with approved fertiliser coated wear tolerant rye grass seed
mixture at a rate of 50 g/m2 such as DLF i-seed or similar and approved.
d) Roll or otherwise firm the drain lines on completion and leave level with the
surrounding ground.
e) The Contractor shall return to site 6 months after completion of the drainage works or
when directed by the Employer and top up any and re-seed any drain lines that have
settled below the surrounding ground level.

9.

Overall sand top dressing

Supply 100 tonne/ha approved medium fine sand with no more than 1% lime content, a
particle size distribution within the central section of the grade curve shown in Appendix
3 and spread to form a uniform layer over the drained area using an approved tractor
mounted distributor. The Contractor shall note that lorries will not be allowed on pitch
areas unless the ground is dry and unless agreed to by the Employer.
Harrow sand into the sward using short-toothed grassland harrow or other approved
method. The Contractor shall allow for damage to the reinstatement of the pipe drain
lines during harrowing to be made good to the satisfaction of the Employer.

12. Decompaction
Verti-draining shall be completed using a Sports Ground Verti-drain machine or other
similar and approved fitted with 25 mm tines working to a depth of no less than 250 mm
and at a spacing of 100 mm in the line of travel.
13. Slit drainage
Slit drains shall be installed in the designated area as shown on Drawing STP/o71/o4C
or as otherwise directed by the Employer. Ensure the slit drains connect effectively with
the pipe drain backfill.
(a) Formation of slits
The slits shall be excavated 50 mm wide, 250 mm deep at 1000 mm centres. They shall

cut a minimum of 50 mm into the pipe drain backfill. The beds of the slits shall be firm
and free of loose material and the pipe drain backfill shall be clearly exposed before
backfilling to ensure a good connection is achieved.
The slits shall be formed with an approved trenching machine with a conveyor
attachment to remove excavated material directly as work proceeds. Spoil shall be
disposed of on site as shown on Drawing STP/071/03C and as specified in item 7.
(b) Backfill materials
(i)
Supply an approved 5-8 mm gauge clean, hard non-calcareous aggregate for
backfilling the slits to within 75 mm of the ground level.
(ii)

Supply an approved medium/coarse sand, with a grading curve which lies within
the central recommended portion of the diagram at Appendix 3, to complete the
backfilling. Provide sufficient material to allow for a 35 mm depth of sand above
ground level before firming.

(iii)

Should settlement occur prior to completion of the Works, the Contractor shall
top up the slits to the level of the adjoining turf.

(iv)

Backfilling shall be carefully carried out to avoid damage to the slits and any
spillage of fill material shall be cleared up as it occurs.

(v)

Allowance shall be made for topping up the slits if settlement occurs during the
defects correction period.

(c) Reinstatement
The Contractor shall allow for reinstating any haulage routes or storage areas on site or
other areas damaged during the Works to their original condition, including all necessary
cultivations and reseeding.
The site shall be cleared of all debris, arisings and other surplus materials, leaving it
clean and tidy.
15. Maintenance
a) During the period of the works the field shall be mown at a nominal height of 50 mm
as directed by the Employer.
b) When directed by the Employer supply and uniformly supply granular outfield fertilizer
analysis 20:10:10 at a rate of 250Kg/ha to the drained area.

This summary is intended as an indication of the scope of the works included in the Contract
and is not for tendering purposes.

PREAMBLE
1.

In accordance with the Appendix to the Conditions of Contract, the measurement of the
Bill of Quantities has been carried out generally as described in the Civil Engineering
Standard Method of Measurement (CESMM) (3rd Edition 1991) and as modified herein.
In the event of any conflict the Clauses within the Preamble shall take precedence over
the Civil Engineering Standard Method of Measurement.

2.

The prices and rates to be inserted in the Bills of Quantities are to be the fully inclusive
value of the work described under the several items, including all costs and expenses
which may be required in and for the construction of the work described, together with all
general risks, liabilities and obligations set out in the documents on which the Tender is
to be based.

3.

Each item shall be priced independently of any other work scheduled in the Bills of
Quantities. A price or rate is to be entered against each item in the Bills of Quantities,
whether quantities are stated or not. Items against which no price is entered are to be
considered as covered by other prices or rates in the Bills.

4.

The Form of Contract, the Conditions of Contract, the Specifications and Drawings are to
be read in conjunction with the Bills of Quantities.

5.

General directions and descriptions of work and material given in the Specifications are
not repeated in the Bills of Quantities. Reference is to be made to the Specifications for
this information.

6.

Dayworks shall be carried out in accordance with the rates and prices stated in the
Daywork Schedule only when instructed by the Employer.

7.

No additional charge shall be made to the Employer in respect of carrying out the work
in isolated sections, co-operation with any of the Statutory Undertakers or any subcontractor, or of a break in the continuity of the Contractors operations between one
stage and another. Prices and rates are to include for the cost of all non-productive and
temporary works and for overtime involved in carrying out and completing the Works.

8.

The quantities given in these Bills of Quantities are believed to be correct, but are not
guaranteed, and are given for the purpose of enabling Contractors to make out their
Tenders on an equal basis and to enable the Employer to compare them, but they are
not to be taken as a guarantee that the total quantities of work will be executed or will
not be exceeded. All the work will be measured on completion and only the amount of
work executed will be paid for at the rates given in the Bills of Quantities or at rates
analogous thereto. No claim made by the Contractor arising from any increase,
reduction or omission in the Works will be considered by the Employer.

9.

The General Items shall be deemed to be spread over the whole of the period that the
Contractor is on site, and the amount of the General Items to be paid in the monthly

10. All Provisional Quantities or Provisional Sums of money are to be understood as being
subject to deduction in whole or in part, at the discretion of the Employer, from the
amount of the Contract. The rates set out for such items, if any, shall be used for the
valuation of works so ordered by the Employer in writing, whether the quantities shown
are used wholly or in part.

11 Amendments to Method of Measurement

a) Class E8 (Landscaping), the unit of surface area is either hectares or square metres
as appropriate.
b) Where appropriate, Classes I, J, K and L have been amalgamated in the Bills of
Quantities and the rates entered against these amalgamated items shall include for
