CHAPTER I
GENERAL PROVISIONS
Article 1
In this Regulation of the Coordinating Minister for Economic Affairs the following
definitions apply:

Business Entity means a private business entity in the form of limited liability
company, State Enterprise (BUMN), Regional Enterprise (BUMD) and
Cooperatives.

This Regulation of the Coordinating Minister for Economic Affairs has the purpose as:

This Regulation of the Coordinating Minister for Economic Affairs is intended to support
the acceleration of Infrastructure Provision thereby being able to enhance the growth of
national economy.

The types of risks and the form of Government Support shall be as referred to in
Regulation of the Minister of Finance Number 38/PMK.01/2006 regarding
Implementing Directives for Risk Control and Management on Infrastructure
Provision.
CHAPTER III
PRINCIPLES OF PROVISION OF GOVERNMENT SUPPORT
AND CRITERIA ON EVALUATION
First Part
Principles of Provision of Government Support
Article 5
Government Support is provided based on the following principles:

conformity with the Regional Spatial Plan, whereby the Partnership Project shall
be in accordance with the Regional Spatial Plan whether compiled at regional or
national levels;

economic and social benefits and reasonable costs, whereby the proposed
Partnership Project can provide benefits and shall be reasonable from the point of
economic and social costs as proven by a detailed analysis concerning the benefits
and economic and social costs, which contains an analysis on settlement of the
opportunity issue for employment, the role in reduction of poverty, influence over
level of productivity, role in reduction of gaps among regions and economic
growth in macro;

affirmation in risk settlement, whereby the risks that emerge from the
implementation of the Partnership Project have been analyzed in detail from the
point of risk allocation, estimate of amount of risks in a quantitative manner and
the necessary steps to be taken to minimize the level of risk;

project feasibility, whereby the Partnership Project has been declared as feasible
from technical and financial viewpoints (project quality) based on the results of a
feasibility study.
CHAPTER IV
PROCEDURES FOR EVALUATION OF PARTNERSHIP PROJECTS
WHICH REQUIRE GOVERNMENT SUPPORT

The proposal as referred in Article 8 shall be completed with the following documents:

The Committee through the Committee Secretariat will examine the completeness
of documents as referred to in Article 9.

In conducting evaluation, the Central Unit for PPP Development through the
Committee Secretariat will request for other necessary documents and/or
information to the Minister/Institution Head.
Article 12

In determining sequence of priorities, the Central Unit for PPP Development shall
consider:
a. analysis on benefits, economic and social costs;
b. harmonization and/or integration between sectors; and
c. range of Government Support applied for.

Prior to establishment of Organization Structure and Work Procedures of the Central Unit
for PPP Development, the Committee Secretariat shall carry out functions of the Central
Unit for PPP Development.
CHAPTER VI
CLOSING PROVISIONS
Article 16
This regulation shall commence to be effective on the date of its establishment.
