MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT entered into and executed this ______ day of
January, 2015, at __________________________, Philippines by and
between:

PROVINCIAL GOVERNMENT OF PALAWAN, established and

existing under the laws of the Philippines, herein represented, by
HONORABLE JOSE CH. ALVAREZ, Governor, with principal office at
the Provincial Capitol Complex, Puerto Princesa City, Palawan,
hereinafter referred to as the PGP
-andThe MUNICIPALITY OF ABORLAN, established and existing
under the laws of the Philippines, herein represented, by
HONORABLE JAIME ORTEGA, Mayor, with Principal office at Municipal
Building, Aborlan, Palawan, hereinafter referred to as the
MUNICIPALITY.

WITNESSETH THAT:
WHEREAS, Sec. 16 of the Local Government Code provides
that Every local government unit shall exercise the powers
expressly granted, those necessarily implied therefrom, as well as
powers necessary, appropriate, or incidental for its efficient and
effective governance, and those which are essential to the
promotion of the general welfare. Within their respective territorial
jurisdictions, local government units shall ensure and support,
among other things, the preservation and enrichment of culture,
promote health and safety, enhance the right of the people to a
balanced ecology, encourage and support development of
appropriate and self-reliant scientific and technological capabilities,
improve public morals, enhance economic prosperity and social
justice, promote full employment among their residents, maintain
peace and order, and preserve the comfort and convenience of their
inhabitants.
WHEREAS, Sec. 17 of the Local Government Code provide
among others that

exercise such other powers and discharge such other functions and
responsibilities as are necessary, appropriate, or incidental to
efficient and effective provisions of the basic services and facilities,;
WHEREAS, Section 33. Of the Local Government Code
provides Cooperative Undertakings Among Local Government Units.
Local government units may, through appropriate ordinances,
group themselves, consolidate, or coordinate their efforts, services,
and resources for purposes commonly beneficial to them. In support
of such undertakings, the local government units involved may,
upon approval by the Sanggunian concerned after a public hearing
conducted for the purpose, contribute funds, real estate, equipment,
and other kinds of property and appoint or assign personnel under
such terms and conditions as may be agreed upon by the
participating local units through Memorandum of Agreement.

WHEREAS, the Provincial Government of Palawan has started

the implementation of its main slogan project I-HELP, of which
among others include Livelihood Programang Pangkabuhayan sa
Palawan as one of the administrations focus to empower its citizens
by providing them resources to eradicate poverty;

WHEREAS, the current administration of the Provincial

Government of Palawan and the Municipal Government of Aborlan
desirous in its promise to the people of Palawan in providing
livelihood to help alleviate the people of Palawan from the cancer of
society that is called poverty and to jumpstart and further stimulate
the economic activities within the Province of Palawan;

NOW THEREFORE, in consideration of the foregoing premises,

parties to this Memorandum of Understanding hereby agree on the
following terms and conditions:

ARTICLE I-PROJECT COVERAGE

Section 1.1 This Memorandum of Understanding lays
down the basic principles in the establishment of the
Programang Pangkabuhayan sa Palawan the program for
brevity A Joint Micro-Financing Governmental Program of the

Provincial Government of Palawan and the Municipality of

Aborlan, geared towards the eradication of poverty and to
further promote the economic and commercial activity of the
Province and in the local community.
Section 1.2 Program Beneficiaries The beneficiaries
shall only be bona fide residents of Municipality of Aborlan.
Beneficiaries shall be chosen by the parties based on a system
that shall be determined by them.
ARTICLE II-OBLIGATION OF THE PROVINCE
Section 2.1 The PGP shall allocate an amount of two
million pesos (P 2,000,000.00) for this program. Said amount
has been included in its 2015 Annual Budget.
Section 2.2 The PGP shall create a TRUST ACCOUNT
whereby all funds allocated by the Municipality and collections
remitted by the Municipality of Aborlan from the program
beneficiaries, shall be held.

ARTICLE III-OBLIGATION OF THE MUNICIPALITY OF ABORLAN

Section 3.1 The Municipality of Aborlan shall allocate the
amount of Two Million Pesos (P2,000,000.00) in its 2016 Annual
Budget as its share in this program. The said budget shall
automatically be remitted to the Provincial Government of
Palawans created Trust Account for this Project.

Section 3.2 It shall be the Municipality of Aborlan, thru

the Office of the Municipal Treasurer that shall collect from the
beneficiaries of their daily/monthly/annual returns to the
parties. Returns of beneficiaries and the manner of payment
shall be conceptualized in a separate Memorandum of
Agreement

Section 3.4 It shall be the duty of the Municipality of

Aborlan to remit all collections to the Provincial Government of
Palawan thru the office of the Provincial Treasurer.
ARTICLE IV-EFFECTIVITY

Section 4.1 This MOU shall take effect upon the signing
of this document , unless mutually terminated earlier by both
parties.

contracting parties and their witnesses.
