1. I submit that MSR Motors is the second opposite party in the
complaint. I further submit that this Honble Forum had passed
an ex-parte order against this opposite party due to nonfiling of the vakalatnama on time before this Honble Forum.
2. I state that the notice of the subject case was served upon the
Opposite Party No. 2 directing this opposite party to appear on
. however I was unable to appoint a suitable advocate for
representing our case.
3. I submit that thereafter the counsel for the Opposite Party No. 2
informed me the next date fixed as ..

decided to represent the case in person, however when I reached

this Honble Forum on .. the case was already called up and
I couldnt make any representation and next date was fixed as

4. I submit that I was present before this Honble Forum on
and the inordinate delay in making representation and filing of

written version on the date fixed was neither deliberate nor

willful but due to bonafide reason as stated above.
5. I state that the Opposite Party No.2 has a good case on merits,
as such an opportunity may kindly be granted to this opposite
party to file written version and contest and other necessary
pleading as may be deemed fit to contest the case on merits.
6. I submit that if the accompanying application is not allowed, the
Opposite Party No.2 will be put to serious loss and hardship and
no hardship of any kind would be caused to the Complainant if
the instant application is allowed. The opposite party is ready to
comply with any direction/costs the Honble Forum may put while
allowing the prayer(s) in the instant application.
