ABSTRACT
Public Services - Irrigation & CAD Department Disciplinary action against
Sri V. Hara Prasad, Dy. Executive Engineer for Irregularities/lapses
committed in the issue of experience certificate to the contractor which
resulted awarding of the works relating to construction of Barrage across
Ponnal river near Kalavagunta (V) in Penumur (M) Chittoor Dist. for drinking
water supply to Chittoor town stageII to the contractor in Tender
finalization Disciplinary action concluded imposing a punishment of two

of the orders due to retirement of the individual Modification of

ORDER:
In the reference 1st read above, orders were issued modifying the
punishment of dismissal from service to that of stoppage of two annual
grade increments with cumulative effect against Sri V. Hara Prasad, Dy.SE
(Retd.) as advised by the APPSC.

In the reference 2nd read above, the Engineer-in-Chief(AW), I&CAD
Dept., Hyderabad has informed that out of withholding two annual grade
increments, one increment due on 1-11-2010 was stopped and the 2nd
increment could not be stopped as Sri V. Hara Prasad, I/C EE has retired
from the service on 30-06-2011. The Engineer-in-chief (AW),I&CAD Dept.,
Hyderabad has therefore requested to revise the punishment of stoppage of
(2) annual grade increments with cumulative effect immediately as the
individual has approached the Honble Tribunal for settlement of pensionry
benefits.

After careful examination of the entire matter, it has been decided to
modify the punishment of withholding two(2) annual grade increments with
cumulative effect to that of 10% cut in Pension permanently. Accordingly,
in the reference 3rd read above, a revised show cause notice has been
issued to Sri V. Hara Prasad, Dy.SE(Retd.) to submit his representation, if
any thereon.

In the reference 4th read above, Sri V. Hara Prasad, Dy.SE(Retd.)
has submitted his representation to reduce the punishment on humanitarian
grounds.

After examination of the representation, it has been decided to
confirm the proposed revised penalty of 10% cut in pension permanently
against Sri V. Hara Prasad, Dy.SE(Retd.).

Accordingly, in the reference 5th read above, the Secretary, APPSC
has been requested to place the above proposal of the Government before
the Commission and to communicate the concurrence of the Commission
on the provisional decision of the Government.

In the reference 6th read above, the Secretary, APPSC has
communicated the concurrence of the Commission on the proposal of the
Government to impose a penalty of 10% cut in pension permanently against
Sri V. Hara Prasad, Dy. SE(Retd.) and requested to take further action
accordingly.

Government, after careful examination of the entire issue, hereby
order to modify the earlier punishment of stoppage of two (2) annual grade
increments to a penalty of 10% cut in pension permanently on Sri V. Hara
Prasad, Dy. SE (Retd.), for the Irregularities/ lapses committed in tender
finalization, in the works relating to construction of Barrage across Ponnal
river near Kalavagunta (V) in Penumur (M) Chittoor Dist. intended for
drinking water supply to Chittoor town stage II.

The I&CAD(Ser.II) Department / Engineer-in-Chief (AW), I&CAD
Department, Hyderabad shall take necessary action accordingly.
