This has reference of your request to verify the present status of the case of your
probationer Jerome Perihan y Bacalo for Illegal Possession of Firearm filed at the Regional Trial
Court, Branch XI, Manolo Fortich, Bukidnon. Moreover, we have interviewed the employer of the
probationer Mr. Alex Payangga who said that he admired Jerome for being a good truck driver
even if he worked with him for few months only. The only thing that he dislikes is his bad attitude.
He is boastful or conceited. He is angry if other drivers would overtake his truck. He has a gun with
him and he uses it to terrify his rivals on the road. The parents, siblings and relatives of his wife do
not like him either. A few days before he was arrested, he was suspected of pushing prohibited
drugs in some areas in Manolo Fortich.

RECOMMENDATION
WHEREFORE, In view of the foregoing, it is respectfully recommended to the Honorable
Court that the petition for probation of SARAH JAEL AMION y RUSIANA be GRANTED for a
period of ONE (1) YEAR, to be counted from Probationers initial report for supervision and subject
to the following conditions:
1. Probationer shall report initially to the Chief Probation and Parole Officer at Bukidnon
Parole and Probation Office, No. 1, Manolo Fortich, Bukidnon within seventy-two (72)
hours from the receipt of the Order granting probation.
2. She shall, thereafter, report to her supervising Probation and Parole Officer once a
month unless otherwise modified by the Chief Probation and Parole Officer.
3. She shall reside at 074 Virgen de Regla Village, Zone 2, Tablon, Cagayan de Oro
City and shall not change her residence without prior approval of the Chief Probation
and Parole Officer, or Court, as the case may be.
4. She shall secure a written permit to travel outside the jurisdiction of the Parole and
Probation Office from the Chief Probation and Parole Officer and from the Court if such
travel exceeds thirty (30) days.
5. She shall not commit any crime or any other offense.
6. She shall render community service and will participate in tree-planting activities.
7. She shall allow the supervising Probation and Parole Officer or an authorized Volunteer
Probation Aide to visit her home and place of work.
8. She shall meet her family responsibilities.
9. She shall devote himself to a specific employment and shall not change said
employment without prior notice to the supervising officer and/or pursue a prescribed
secular study or vocational training.
10.
She shall refrain from associating with persons of questionable character.
11. She shall cooperate with his program of supervision, and shall satisfy any other
condition related to her rehabilitation and not unduly restrictive of her liberty
incompatible with her freedom of conscience.
12.
She shall plant ten (10) trees during her probation period and shall see to it its
proper growth and survival.
In the event that Petitioner fails to observe the preceding conditions and/or has committed
any material misrepresentation in his application for probation, his probation may be revoked by
the Court or the conditions thereof modified.

RECOMMENDATION

WHEREFORE, in view of the foregoing, it is respectfully recommended to the Honorable


Court that the petition for probation of _________________________________________ be

Accused-petitioner is the eldest of the 5 siblings in the family. His father is a carpenter while
his mother operates a sari-sari store at home. Even with their meager income, the parents were
able to send their children to school; the 2nd reached college while the rest finished high school.
From Kinawe the family transferred to its neighbor Barangay Kiliog. The parents and
siblings of accused-petitioner are living in Kiliog, Libona, Bukidnon at present. They are known as
responsible members of the community.

ANALYSIS AND EVALUATION

The people of Barangay Kinawe and Barangay Kiliog who learned the new information about
accused-petitioners instant case said they could not believe what they heard. Accused-petitioner has
no record of stealing in the two barangays mentioned above. His parents and siblings are

Up to this time, his parents could not understand why he has done the offense. Whatever is the

According to the investigating probation officer, Cagayan de Oro City Parole and Probation
Office that handled the case of the petitioner, the latter alleged that it was his co-accused Rico Rio
who is responsible of the said crime. He came to know the co-accused because he was one of
their customers in their eatery and since then they became close friends. Rico as he said is a
notorious drug user and thief in Manolo Fortich and it happened that he was implicated in the
instant case because of the past offense where he was involved.

ANALYSIS AND EVALUATION


Based on the results of the background investigation and records check conducted, the
accused-petitioner has been involved in unlawful activities though not in his Barangay but in the
nearby Barangays of Bukidnon. He was implicated in crimes like Robbery and Illegal Possession of
Firearm. Currently, he is detained at the Lumbia City Jail, Cagayan de Oro City for a Robbery case
filed at the RTC-Branch 39. Other previous criminal cases were dismissed and provisionally
dismissed.
The accused-petitioner vehemently denied his involvement in this Robbery case filed at him at
the RTC, Branch 39. He was detained in the city jail for more than a year already and he is worried
of his wife and children especially that they are studying now and his wife is all alone to work to
support for their needs.
Even if the accused-petitioner is facing another criminal case at present, he is still a first
offender; thus making him eligible for probation. He expressed remorse for the crimes that he was
involved with and he is asking for another chance; even just for the sake of his children who are

ANALYSIS AND EVALUATION

Based on the information collated, the petitioner is notorious in Barangay Pongol and
Poblacion, Libona, Bukidnon. He is a thief of all kinds of farm animals. All the informants are
dismayed of the bad practice of the accused-petitioner and because of it they want him to serve his
sentence in jail. They dont like the idea of giving the accused-petitioner another chance because
they believe that he is beyond reformation already. They dont understand why he would steal when
in fact he is very strong and physically fit to work for a living.
The petitioner is one of the recipients of the housing project of the local government of
Libona, Bukidnon for the victims of typhoon Sendong in their place, He has a live-in partner after
his wife left more than 2 years ago. Since then and until now, their two children are living with his
parents in Pongol, Libona. His live-in partner is a Security Guard and she promised for her support
to accused-petitioners program of rehabilitation.
The office on the other hand is recommending for a second chance to petitioner who
promised to reform if given another chance. To address the problem of the accused-petitioner who
claims that his earnings as a habal-habal driver is very minimal is to refer him for skills or
vocational training such as painting, carpentry or to any TESDA offered classes for the unskilled.
Hopefully this would stop him from committing another offense.
Results of records check show that he is a first offender.

The petitioners father was a former Barangay Chairman of Basak, Talakag, Bukidnon for
22 years but prior to that, he was Barangay Kagawad for 10 years.
The petitioner said that he was not happy with the life they had before. As a politician, his
father had almost no time for his family. Even in the financial aspect, sometimes he gave first
priority the needs of his constituents than the needs of his own family.
The petitioners mother is very caring to all her children. Even if she is an illiterate, she is
very supportive to all her children. As a matter of fact, three of petitioners siblings finished a
college degree.
The familys main source of income is derived from farming. His father who is an industrious
man has planted hard wood trees, coffee and fruit trees that they are still enjoying now.
