MUNICIPAL ORDINANCE NO. 012-2014

RENAMING THE TASK FORCE KAAYUSAN UNDER SECTION 8 OF THE
GUINOBATAN TRICYCLE CODE OF 1999 FROM TASK FORCE KAAYUSAN (TFK)
TO GUINOBATAN TRICYCLE FRANCHISING REGULATORY COMMITTEE
(GTFRC).

WHEREAS, the Task Force Kaayusan is created under section 8 of Municipal

Ordinance No.: 02 Series of 1999, otherwise known as the Guinobatan Tricycle Code of
1999;
WHEREAS, paradoxically, at the outset, the title Task Force Kaayusan implies to
be enforcers of Traffic Rules and Regulations, however, it is not for its prime duty under
the Tricycle Code of Guinobatan 1991, which is to assist the Sangguniang Bayan in
carrying out the latters Franchising Authority granted under the Local Government
Code of 1991;
WHEREAS, to rename the Task Force Kaayusan (TFK) into Guinobatan Tricycle
Franchising Regulatory Board (GTFRC) shall remove doubts and confusion in its true
mandate under the code as an aid of the Sangguniang Bayan in its regulatory power to
enhance the franchising system in the Municipality of Guinobatan;
WHEREFORE, in view of the foregoing premises,
BE IT ORDAINED
ASSEMBLED, THAT:

SECTION 1. AUTHORIZATION. It is hereby authorized the remaining of the

Task Force Kaayusan to GUINOBATAN TRICYLE FRANCHISING REGULATORY
COMMITTEE (GTFRC).
SECTION 2. COMPOSITION. The GTFRC shall be composed of the following:
Chairman
Vice-Chairman
Secretary

- A permanent employee designated by the Mayor

- SB Committee Chairman on Transportation
- A permanent employee designated by the Mayor

Regular Members

- PNP Personnel In-Charge on Traffic

- SB Committee Chairman on Laws & Rules
- Accounting Personnel (1)
- Treasury Personnel (1)
Ex-Officio Members - Parada Presidents
SECTION 3. FUNCTIONS. The main function of the GTFRC is to assist the
Sangguniang Bayan in its Regulatory Function enumerated under Section 7 of the
Guinobatan Tricycle Code of 1999. Being an assisting committee, the GTFRC could
craft Rules and Regulations to effectively carry out the mandate of the code and come
up with recommendatory measures to enhance the franchising system of Tricycle-forHire in the Municipality of Guinobatan. Moreover, the specific function of the TFK under
Paragraph 8, Subparagraph B of the code is also hereby adopted. The power granted to
the GTFRC is understood to be recommendatory in nature and in the form of
resolutions subject to the final approval of the members of the Sangguniang Bayan.
SECTION 4. SEPARABILITY CLAUSE. If, for any reason/s, any part/s of this
Ordinance shall be held to be unconstitutional or invalid, other part/s or provisions
hereof which are not affected thereby shall continue to be in full force and effect.
SECTION 5. REPEALING CLAUSE. Any Ordinance or part/s thereof which are
inconsistent with any of the provisions of this Ordinance are hereby repealed, amended
or modified accordingly.
SECTION 6. EFFFECTIVITY. This Ordinance shall take effect upon its approval.
