BACKGROUND

Section6.1oftheZoningBylawfortheTownofWilliamsburgstates:ThepurposeofSitePlan
ReviewistofurtherthepurposesofthisBylawandtoensurethatnewdevelopmentoflarge,
nonresidentialandnonagriculturalstructuresisdesignedinamannerthatreasonably
protectsvisualandenvironmentalqualitiesandpropertyvaluesoftheTown,andassuressafe
vehicularaccess,safepedestrianmovement,andadequatedrainageofsurfacewater.

Section5.10oftheZoningBylawfortheTownofWilliamsburgstates:Anysubstantialchange,
alteration,orexpansionofauseallowedbySpecialPermitshallrequireanewspecialpermit
fromtheZoningBoardofAppeals.

Section6.0oftheZoningBylawfortheTownofWilliamsburgstates:NoSpecialPermitor
buildingpermitshallbegrantedforanynonresidentialstructureorstructureswhichhavea
footprintexceeding5,000squarefeet,unlessaSitePlanhasbeenreviewedbythePlanning
Board.

Section3.2oftheZoningBylawfortheTownofWilliamsburgindicatesthatanyindustrial,
manufacturing,orsawmilluseintheRuralZonerequiresaSitePlanReview.

ThePlanningBoardcanfindnoevidenceofanycurrentlyvalidSpecialPermitfortheoperation
ofanybusinessat17HydeHillRoad.ThePlanningBoardcanfindnoevidenceofanypermitfor
theoperationofasawmillatthissite.ASpecialPermitwasgrantedin1986tooperatea
woodworkingshopforthemanufactureofwoodenpallets.In2000,becauseofasubstantial
changetotheuseallowedbytheSpecialPermit,asrequiredbySection5.10oftheBylawsof
theTownofWilliamsburg,anapplicationforanewSpecialPermitwasfiledforautomotive
repairandmaintenance,andthatSpecialPermitwasgrantedin2001.Currentlytheoperations
carriedonat17HydeHillRoadrepresentanothersubstantialchangetotheuseallowedunder
theSpecialPermitissuedin2001,assubstantiatedbytheapplicationforanewSpecialPermit
whichwasfiledin2014.Thoughsomefirewoodispreparedandsoldonthesite,suchactivities
wouldnotfallunderthe1986SpecialPermit,whichwasspecificallygrantedforawoodworking
shopforthemanufactureofpallets.

ThePlanningBoardconcludesthatasubstantialchangehasoccurredregardingthebusiness
activitiesat17HydeHillRoad,thatthecurrentactivitiesareindustrialactivities,thatthereisno
currentlyvalidspecialpermitforanybusinessactivityonthesite,andthatanewspecialpermit
isrequiredfortheproperty.

SPECIFICDEFICIENCIESINTHESITEPLAN

SubsequenttotheApplicationforaSitePlanReviewsubmittedonDecember24,2014,the
JointPublicHearingofthePlanningBoardandZoningBoardofAppealswascontinuedtwiceto
allowtheapplicantadditionaltimetoaddressshortcomingsoftheSitePlan.TheApplicantwas
informedinwritingthattheSitePlanwasinadequate.Thelegalrepresentativeforthe
ApplicantwasinformedduringthehearingonApril28,2015thattheSitePlandidnot
adequatelyaddressanumberofissues.

DuringitsreviewoftheSitePlanfor17HydeHillRoad,thePlanningBoardidentifiedatotalof
45areasofdeficiencyintheplanassubmitted.ThePlanningBoarddoesnotsuggestthatthis
listofdeficienciesisallinclusive.TheBylawclearlyliststhecriteriaforreviewofaSitePlan.The
followingpagesenumeratetheindividualdeficienciesoftheSitePlanfor17HydeHillRoad.
QuotationsofsectionsoftheBylawareinitalicsandreferencethespecificsectionoftheBylaw.
Deficienciesarelistedandnumberedsequentially.

6.51a: Buildingsitesshall,totheextentfeasible:

1.Minimizeimpactonwetlands,steepslopes,floodplains,hilltops
2.Minimizeobstructionofscenicviewsfrompubliclyaccessiblelocations
3.Preserveuniquenaturalorhistoricalfeatures
4.Minimizetree,vegetationandsoilremovalandgradechanges
5.Maximizeopenspaceretention
6.Screenobjectionablefeaturesfromneighboringpropertiesandroadways

1:
TheSitePlanprovidesnoplantominimizerunoffintothewetlands.

2:
TheSitePlanindicatesthatdevelopmenthasencroachedonthewetlandsandextends
intothebufferzoneof100feet(MassachusettsWetlandsProtectionAct)thatisrequired
adjacenttowetlands.TheSitePlanprovidesnoplantomitigatethisencroachment.

3:
TheSitePlanprovidesnoplantopreventanypollutionofthewetlandsbyrunoffof
petroleumorotherwasteproducts.

4:
TheSitePlanpresentsnoplantoscreenobjectionablefeaturesfromneighboring
propertiesandroadways.

6.51b: Intheabsenceoftownservices,thedevelopmentshallbeservedwithadequatewater
supplyandwastedisposalsystemsprovidedbytheapplicant.Forstructurestobeservedbyan
onsitewastedisposalsystem,theapplicantshallsubmitasepticsystemdesignpreparedbya
CertifiedEngineerandapprovedbytheBoardofHealth.

TheSitePlanprovidesnoinformationregardingtheadequacyofthewatersupply.

6:
TheSitePlanprovidesnoplanorsystemdesignforthesepticsystemattachedtothe
houseontheproperty,andnoreportbyaCertifiedEngineerisprovidedonthesepticsystem
toensureadequacyofdesignoroperation.

7:
TheSitePlanprovidesnoplanorsystemdesignforthesepticsystemattachedtothe
shopormainworkareaontheproperty,andnoreportbyaCertifiedEngineerisprovidedon
thesepticsystemtoensureadequacyofdesignoroperation,orthatitisofanadequatesizeto
servicetheneedsofthestaffofthebusiness.Thisomissionisofparticularconcernconsidering
thenumberofpeopleworkingatthesiteandtheproximityofthesepticsystemtothe
wetlands.

6.51c: Theplanshallmaximizetheconvenienceandsafetyofvehicularandpedestrian
movementwithinthesiteandinrelationtoadjacentways.Theplanshalldescribeestimated
averagedailyandpeakhourvehiculartraffictobegeneratedbythesite,trafficflowpatterns
forvehiclesandpedestriansshowingadequateaccesstoandfromthesite,andadequate
circulationwithinthesite.

8:
TheSitePlanprovidesnoplantoaddresssafetyofvehicularandpedestrianmovement
withinthesiteandinrelationtoadjacentways.

9:
TheSitePlanprovidesnoinformationonestimatedaveragedailyandpeakhour
vehiculartraffictobegeneratedbythesite,thoughsomeverbalestimateswereprovidedat
thesitevisit.

10: TheSitePlanprovidesnoinformationontrafficflowpatternsforvehiclesand
pedestrians.

11: TheSitePlandescribesnomeasurestobetakentoensuresafespeedsandoperationof
vehiclesonHydeHillRoadwhendeliveriesaremadeorwhenfinishedmachineryisremoved
fromthesite.

12: TheSitePlanprovidesnoinformationonaccesstoandfromthesiteexceptforthe
locationofthedriveways.

13: TheSitePlanprovidesnoinformationontrafficcirculationwithinthesite.

6.51d: TheSitePlanshallshowadequatemeasurestopreventpollutionofsurfaceor
groundwater,tominimizeerosionandsedimentation,topreventchangesingroundwaterlevels,
andtopreventincreasedrunoffandpotentialforflooding.Drainageshallbedesignedsothat
runoffshallnotbeincreasedandthatneighboringpropertieswillnotbeadverselyaffected.A
systemofgroundwaterrechargeshallbeprovidedthatdoesnotdegradegroundwaterquality.
Rechargeshallbebystormwaterinfiltrationbasinsorasimilarsystemcoveredwithnatural
vegetation.Drywellsshallbeusedonlywhereothermethodsarenotfeasible.Allbasinsand
wellsshallbeprecededbyoil,greaseandsedimenttrapstofacilitateremovalofcontamination.
Anyandallrechargeareasshallbepermanentlymaintainedinfullworkingorderbytheowner.

14: TheSitePlanprovidesnoplansormeasurestopreventpollutionofsurfaceor
groundwater.

15: TheSitePlanprovidesnoplantominimizeerosionandsedimentation.

16: TheSitePlandescribesnomeasurestopreventchangesingroundwaterlevels.

17: TheSitePlanprovidesnoinformationonmeasurestopreventincreasedrunoffand
potentialforflooding.Thisisaparticularconcernduetothelargeareaofimperviouspavement

6.51f: Exposedstorageareas,machinery,serviceareas,truckloadingareas,utilitybuildings
andotherunsightlystructuresorusesshallbesetbackorvisuallyscreenedtoprotectthe
neighborsfromobjectionablesitecharacteristics.

24: Thoughverbalrepresentationsweremadeduringthesitevisitregardingcertain
outdooractivitiesbeingsetback,theSitePlanprovidesnoinformationonhowstorageareas,
machinery,serviceareas,truckloadingareas,utilitybuildingsandotherunsightlystructures

ZoningBylawfortheTownofWilliamsburg.
