to Parcel E). Twenty Two Liberty LLC, the Project Developer of the residential project
presently under construction on Parcel C, has entered into an Affordable Housing
Agreement Fan Pier Parcel C with the BRA, dated as of September 16, 2013 (the Parcel
C Affordable Housing Agreement) pursuant to which Twenty Two Liberty LLC is
constructing two (2) affordable condominium units on Parcel C. Fan Pier Development
LLC has requested that the remaining eight (8) affordable condominium units not yet
under construction be reallocated so that four (4) affordable condominium units be
constructed on Parcel D and four (4) affordable condominium units be constructed on
Parcel H. BRA staff has no objection to such reallocation.
In addition, BRA Housing staff has requested that the Parcel C Affordable Housing
Agreement be amended to attach the latest form of the BRA Deed Rider Covenant for
Affordable Housing and associated documents to be used for the sale of the two (2)
affordable condominium units on Parcel C.
RECOMMENDATION
Therefore, BRA staff recommends that the Director be authorized to execute (i) an
amendment to the Fan Pier Affordable Housing Agreement to provide for the
reallocation of the remaining eight (8) affordable condominium units for four (4)
affordable condominium units on Parcel D and four (4) affordable condominium units
on Parcel H; and (ii) an amendment to the Parcel C Affordable Housing Agreement to
substitute the latest form of the BRA Deed Rider Covenant for Affordable Housing
and associated documents to be used for the sale of the two (2) affordable condominium
units on Parcel C.
An appropriate vote follows:

That the Director be, and hereby is, authorized to execute (i) an
amendment to the Affordable Housing Agreement for the Fan Pier Project
by and between the Boston Redevelopment Authority (BRA) and Fan
Pier Development LLC, dated as of September 16, 2013, to provide for the
reallocation of the remaining eight (8) affordable condominium units for
four (4) affordable condominium units on Parcel D and four (4) affordable
condominium units on Parcel H; and (ii) an amendment to the Affordable
Housing Agreement Fan Pier Parcel C by and between the BRA and
Twenty Two Liberty LLC, dated as of September 16, 2013, to substitute the
latest form of the BRA Deed Rider Covenant for Affordable Housing
and associated documents to be used for the sale of the two (2) affordable
condominium units on Parcel C.
