AFFIDAVIT
I, Greta Cruz, Filipino citizen, of legal age, single to, and a
resident of 522, 5th st. San Beda Subdivision, Mendiola, Manila, after
having been duly sworn in accordance with law, hereby depose and
say:
1. That I am the sister of Melanie Batumbakal, the respondent in a
custody case over Scarlett Batumbakal filed by Frank
Batumbakal.
2. That according to her, she separated with her husband Frank
Batumbakal sometime in 2004, and left their house to live with
Joey Cedric Lee.
3. That according to her, in February 2005, Joey Cedric Lee broke
up with her, so she went to my house and ask if she can live
with me, which I permitted.
4. That during her stay at my house, I caught her several time
using drugs.
5. That sometime in March 2005, I saw empty syringe and a
rubber on her hamper while I was doing laundry. I had a feeling
that she was doing something wrong but I did not have courage
to confront her, at first.
6. That on April 16, 2005, a day after my 34 th birthday, she came
home late at about 2 am, and I noticed that her eyes were really
red and she does not seem normal because when I asked her
where she had been, she just laughed at me and uttered, Like
I bought taho from heaven, OMG. I love you sissy!

7. That on April 30, 2005, when I came home from a company

outing which unexpectedly ended early, I saw her at the living
room injecting something by a syringe in her left upper arm She
panicked when she saw me. Then and there, I confronted her
about what she was doing. She promised not to do it again. And
pleaded not to tell anyone about it, specially her husband and
the police.
8. That on May 10, 2005, as I was about to ask her to get ready
for Scarletts birthday party at Franks House, I was shocked to
see her sniffing a white powder on her desk. She was so high
and could hardly recognize me. She told me to get out of the
room, shouted, I do not care about that damn birthday! Leave
me alone!!! Then she threw a lamp shade at me when I tried to
calm her down.
9. That afternoon she left the house and I never saw her again nor
heard from her again.

That after the incident, I went to tell Frank about
everything that happened.
