AN ORDINANCE AMENDING SECTIONS 333.02 AND 333.09
OF THE CODIFIED ORDINANCES, THE SAME RELATING
TO WILLFUL, WANTON OR RECKLESS OPERATION OF A MOTOR VEHICLE
WHEREAS, the Police Prosecutor has recommended that Sections 333.02 and
333.09 of the Codified Ordinances be amended so as to facilitate flexibility in managing
cases through the Court system.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE
OF KIRTLAND HILLS, COUNTY OF LAKE, STATE OF OHIO, THAT:
SECTION 1. That Section 333.02 of the Codified Ordinances be amended to
read as follows:
333.02 OPERATION IN WILLFUL OR WANTON DISREGARD OF SAFETY.
(a) No person shall operate a vehicle on any street or highway in willful or
wanton disregard of the safety of persons or property. (ORC 4511.20)
(b) No person shall operate a vehicle on any public or private property other
than streets or highways, in willful or wanton disregard of the safety of persons or
property. This subsection does not apply to the competitive operation of vehicles on
public or private property when the owner of such properly knowingly permits such
operation thereon.
(c) Whoever violates this section is guilty of a misdemeanor of the first degree.
(d) Whenever a person is found guilty of reckless operation of a motor vehicle
under this section, the trial court of any court of record, in addition to or independent of
all other penalties provided by law, may impose a class five suspension of the
offenders drivers or commercial drivers license or permit or nonresident operating
privilege from the range specified in division (A)95) of Ohio R.C. 4510.02 (ORC
4510.15)
SECTION 2. That Section 333.09 of the Codified Ordinances be amended to
read as follows:
333.09 RECKLESS OPERATION ON STREETS, PUBLIC OR PRIVATE
PROPERTY.
(a) No person shall operate a vehicle on any street or highway without due
regard for the safety of persons or property.
(b) No person shall operate a vehicle on any public or private property other
than streets or highways, without due regard for the safety of persons or property.
This subsection does not apply to the competitive operation of vehicles on public

or private property when the owner of such property knowingly permits such operation
thereon.
(c) Whoever violates this section is guilty of a misdemeantor of the third degree.
SECTION 3. It is found and determined that all formal actions of this Council
concerning and relating to the adoption of this Ordinance were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal action were in meetings open to the public, in
compliance with all legal requirements, including Section 121.22 of the Ohio Revised
Code.
SECTION 4. This Ordinance shall take effect thirty (30) days after passage.
