Acer America Corp. (“Acer”), defendant in the above-titled and numbered civil

action, moves the Court to extend the deadline to answer or otherwise respond to the First

Amended Complaint until November 8, 2007. In support, Acer will show the following:

The current deadline for Acer to answer or otherwise respond is October 9, 2007.

The plaintiff and defendant have agreed to extend the deadline to answer or otherwise

respond to the Complaint until November 8, 2007.

WHEREFORE, PREMISE CONSIDERED, the defendant requests this Court to
