Plaintiffs Candidates for Monitor


Pursuant to the Courts direction, Plaintiffs herewith submit their three candidates
for the Monitor position with their respective key team members. Based on indications
from the Court, Plaintiffs focused on persons with a successful record of monitoring
local law enforcement agencies, and possessing significant front line policing
experience. Understanding the importance of effective and constitutional law
enforcement and of working with and understanding the concerns of the Latino
community, and possessing the ability to assess complex data collection systems, were
essential. After significant investigations and referrals, and much diligence and
discussion, Plaintiffs found that the first two persons listed, Robert S. Warshaw [Ex.
A], and Joseph E. Brann [Ex. B], fully met the above criteria, and endorsed both as
candidates for this demanding position. Plaintiffs also sought a qualified candidate local
to Maricopa County and selected Timothy A. Nelson [Ex. C] from amongst several
experienced applicants and prominent members of the Arizona Bar with law
enforcement expertise. All the nominees agreed to limit the significant costs involved to
the extent possible, and to reduce their hourly rates to assist. All are available to speak
with the Court to discuss their background and approach, and respond to questions as the
appointment is considered.
On November 21, 2013, the resumes and team members of Robert Warshaw and
Joseph Brann were forwarded to Defendants counsel to enable consideration of
acceptance by Defendants. Plaintiffs stated that, after vetting, these two persons were
found acceptable and would be nominated for the Monitor position. Plaintiffs informed
Defense counsel that they planned to add a third name after finishing their due diligence;
the decision to include Tim Nelson in the list of nominees was a recent one and did not
permit circulation to Defendants. Candidates Warshaw and Brann were fully available to
speak with Defense counsel in order to assess whether they would be agreeable to both

sides. On November 19, 2013, Defense counsel forwarded six resumes to Plaintiffs
indicating that these persons are appropriate for short list consideration. Plaintiffs were
told that none of these persons had been approved by Defendant Arpaio or any other
Defendant. To date, Plaintiffs have not been provided the name of any person who
Defendants had decided to propose as a candidate for Monitor. Based on the limited
information provided Plaintiffs do not agree to any of the six persons identified by
Defendants.
