WHEREAS, Section 12 of Republic Act No. 9369 requires the examination and
testing of the equipment or device of the Automated Election Systern (AES) to be used
in the voting and counting;

WHEREAS, the Commission on Elections, by virtue of Republic Act No. 9369,


has resolved to adopt a paper-based AES that will use Preci~rctCount Optical Scan
(PCOS) Machines to count the votes in 1:he precinct level;

NOW THEREFOR6 pursuant to the powers vested in it by the Constitution, the.


Omnibus Election Code, Republic Act No. 9369, and other election laws, the Commission
RESOLVES as it hereby RESOLVED, to promulgate the following Rules and Procedures
for the Testing and Sealing of the PCOS Machines:

SECTION I.Period for testing and sealing of PCOS nlachilles. - A t least


three (3) days before April 10, 2010 in the case of overseas absentee voting, or before
the May 10, 201.0 national and local elections, in the case of the elections here in the
Philippines, the Board of Election Inspectors (BEI)/Special Board of Election Inspector

of the PC05 machines. - At least five (5) days before the testing and sealing of the
PCOS machines, the Election Officer (EO) / Committee on Overseas Absentee Voting
(COAV) of the Commission shall notify in writing, the BEIJSBEI concerned of the clate,
time and place of the testing and sealing.

I n case of candidates, registered political parties, coalition of political parties,


associations or organizations participating in the party-list systeni representalion in Lhe
cily or municipality, accredited citizens arm ill the city or niunicipalily, the EO shall
notify them by posling a notice of the date, time ancl place of testing and sealing for
each cltrsterecl precinct, not later than April 30, 2010, ill the b~lllelinboards of his
office and of the city or municipal hall and in at least three (3) conspicuous places in
city or municipality.

For the ovel-seas absentee voting, the national candidates, registered political
parties, coalition of political parties, associations or organizations participating in the
party-list system of representation, accredited citizens arm, and accredited OFW
organizations, shall be notified by the COAV thern by posting a notice of the date, time
and place of testing and sealing for each precinct, not later than March 31, 2060, in
the websites of the Commission and the Department of Foreign Affairs (DFA).

SEC. 3. Forms, docrlments and s~~pplies.

g testing and sealing, the BETISBE1 shall observe the following PI-oceclures:

a) Explain to those present, the purpose of, and the procedures for the testing
and sealing;

b) Randomly choose from among those present, ten (10) voters who will
accomplish the test lxillots. I f there are less than ten (10) voters, any of the ten (10)
voters may accomplish more than one (1) test ballot to complete the ten (10) test,
l~allotsneeded;

c) Show.to the pitblic that: tlie PCOS hox is sealed;

d) Rem ove the sticker seal of the PCOS box;

e) Open the PCOS box;

f) Check whether tlie following are insicle the PCOS box:

1. Cliecl(list of contents of the box;


2. PCOS machine;
3. Power cord of the PCOS n~achine; ,

4. Ten (10) test ballots;


5. One (Ienvelope
) containing spare IButton;
6. Three (3) rolls of paper;
7. One envelope containing the back-up memory;

g) Retrieve the PIN of each member of the BEIISBEI and distribute the same
among theniselves. The PIN for re-zeroing shall lil(ewise be retrieved and shall be in tlie
custody of the Chairman;

h) Ketri eve tlie test ballots from the PCOS box.

i) Retrieve the PCOS fl-onl iLs box;

j) Show to the public that tlie slot labeled POLL WORKER where the main
memory card is stored is sealed. I t sllall remain sealed throughout the
testing and sealing procedure;

I<) Place the PCOS properly on top of the ballot box;

I) Break the plastic fixed length seal of tlie printer cover of the PC05;

m) Open the printer cover and the Chairman shall take out the iButLon security
key;

n) Veri fy if the roll of paper is already properly installed;

o) Close the printer cover;

p) Conn ect the power adaptor to the PCOS AC power port (20 VAC);

q) Plu g the other end to the electrical outlet;

r) Connect the battery to the PCOS DC powei- port (12 VDC). I f there is no
power, using a pen, press the KESET I)uttoli located at the back of the PCOS
above the AC power poll;

s) Wait until the PCOS displays the message "PLEASE INSERT SECURllY KEY
FOR AUTHENTICATION";

t) The Chairman shall place (:he iRiiMon security key on top of the iRuttor!

perform the following FJCOSdiagnostics proceditre:

1) Select "UTILITTES" option.

2) Select: "RUI\I DIAGNOSTICS" option. The PCOS runs diagnostics on I-he


main memory t l ~ e ndisplays lhe message "COMPLETE DIAGNO!3ICS.
MEMORY PASSED" if the melnory is working, otherwise it will display the
error message "COMPLETE DIAGNOSTICS. MEMORY FAILED."

3) 'The PCOS runs diagnostics on tlie backup rneniory. Wait until the screen
displays "BACI<UP MEMORY CARD NOT DETECTED. IS TI-IIS CORRECT?"
Select "YES" option. Then the PCOS displays the message "COrvf1PLErE
DIAGNOSTICS. COMPACT FLASI-I PASSED."

4) The PCOS shall then test the EEPROM then displays the message
"COMPLETE DIAGNOSTTCS. EEPROM PASSED" if the EEPROM is
operational; otherwise it shall display the error message "COMPLETE
DIAGNOSTICS. EEPROM FA1LED.Y

5) The PCOS then runs diagnostics on the thermal printer by automatically


prinling a sample output on Ll~eLliermal paper. The sample printuut
will be """* LliAGNOSTICS PRINTER TEST. "**".

6) The PCOS shall display "CAN YOU READ THE TEXT PRTIdTED ON TIiE
PAPER? with "YES" and 'NO" options.

7) Select Ll~eappropriate option. Jf "YES" is selectecl, 11-ie PCOS will display


"COMPLETE DIAGNOSTICS. TI IERMAI- PRINTER PASSED". I f "NO",
tlie PCOS will display "COMPLkTE DIAGNOSTICS. TI-IERr4AL PRINTER
FAILED."

8) Tlie PCOS shall then display a set of numbered bl~ttonsto test the LCD.
Test all buttons by pressing them one aL a time. I f a button n~or1:s
propel ly, Lhe following message will appear "BIJTON 1 PRESSED",
"BU ITOFI 2 PRESSED"...... depending on the n~rrr~ber
of the b~rtton
pressed. I f the button pressed is not working, the PCOS will not rlisplay
any message. Continue pressing the other buttons. When f~liished,
select "DONE". The PCOS shall then display the message "DOES THE
I-CD WORK PROPERLY?" with "YES" and "NO" optiol~s. Select the
appropriate option. I f "NO" is selected, the PCOS will clisplay
"COMPLETE DIAGNOSTICS. LCD FAILED". 7'lien the PCOS will
automatically perform No. 12 hereof.

9) I f "YES" is selected, the PCOS shall display tlie message "PI-EASE


PRESS TI-IE GREEN 'CAST' BUTTON TO TEST THE LCD SCREEN!" The
BEIJSBEI member shall then press the green "CAST" button.

10) The PCOS shall display the message "PLEASE PRESS TtIE RED
'RETURN' BUTTON TO TEST THE LCD SCREEN!" . Press the red
"RETURN" button.

I ) The PCOS will display "COMPLETE DIAGNOSTICS. LCD PASSED".

ballot: entry slot;

PCOS shall validate the ballot and display the message "SCAN
COMPLETE". The PCOS sliall display the cor~tentsof 1:he ballot with a
rnessage "VALID BALLOT PRESIDENT: BLANK COhITESI-, VICE
PRESIDEhI-T: BLANK CON1-EST ....... ". Select "MORE" to contin[-re the
display of tl-~econtents. Then select " N E W to cornplete t:he rlisplay.
Press the "RETURN" button. PCOS 'shall display the message
"RETURhlING BALLOT" .and the test ballot is returned through the
ballot entty slot. The certified I T capable menibel- of the BEI/SBEL shall
inclt~dethe test ballot used with tlie rest of the test ballots;

16) AKer this, the PCOS shall display the message "IS THE SCANNER
WORI(1NG PROPERLY AND ARE TtlE SCANNED BALLOT RESUI-TS
CORRECT?" wit11 'YES" ant1 "NO" options. Select the appl-opt iate
option. lf the ballot scanner is functional, select "YES" otherwise select
"NO". I f "YES" is selected, the PCOS will display "CQMPLR-E
DIAGNOSTICS. SCANNER PASSED". I f "NO" is selected, the PCOS
will display "COMPLETE DIAGNOSTICS. SCANNER FAILED";

17) PCOS shall display the "PRINT", "DISPLAY", and "PREVIOUS SCREEN"
options;

18) Select: "DISPLAY" option. The PCOS shall display !.lie Diagnostics
Report wiLh 'DONE" and "NEX'I-" optionsi

19) Select "NEXT" oplion to display the seconcl screen of the Diagnostics
Report;

20) PCOS sllall clisplay llle "PIlEV", "DONE, and "PRINT" options;

21) Select "PRINT" to print !-lie Diagnostic Report;

The report should contain the message "MACI-IINE 1S READY FOR USE"
that is printed at t l ~ ebottom of the Diagnostic Report. I f it does no1
contain such message, identify from the report which component
failed, and cdl the Lechnical support for assistance.

22) After printing the Diagnostic Report, the PCOS will display a message
"WOULD YOU LIKE TO PRINT MORE COPIES OF THIS REPORT?" with
YES and NO options. Press "NO" option;

23) The Utilities Menu will be clisplayed with the following oplions:
"TABULATOR INFO", 'RUN UIAGNOSPICS", "RE-ZERO" and
"PREVLOUS SCREEN". Select "PREVIOUS SCREEN" to return to the
Main Menu;

24) Detach the printed Diagnostic Report and place inside the envelope
(A17-TS) provided for the purpose;

25) Select 'OPEN VOTING" from the Main Menu.

The PCOS shall then:

i. Request for the PIN of tlie poll clerk who will then enter his
PIN and press "ENTER";

ii. Validate the PIN and display a message "PIN ACCEPTED";

iii. Request for the second PIN from tlie third member w1.10will
then enter his PIN and press 'ENTERni

iv. Validate the PIPI ant1 displays a I-116ssage


"PIN ACCEPTED";

v. Display two (2) options: "INI-1-IALIZE VOTE COIJNTEF(S" ancl


"PREVIOUS SCREEN".

26) Press the "INJTIALIZE VOTE COI INTERS" option of the PCOS.

The PCOS shall:

i. Display the. message "1NITIALTZING VOTE COUNTERS";

ii. ~utomatically print the Initialization Report showing zero


("0") vote for each candidate including the geographic
informati011 (province, city/municipality, barangay, voting
center and individual precinct in tlie cluster);

iii. After printing the Initialization Reporl, the PCOS will display
the message, "WOULD YOU LIKE TO PRINT MORE COPIES
OF TI-IIS REPORT?" with " Y E S and 'NO" options. Press
"NO". The PCOS will display the message "PLEASE INSERT
BALLOT". Now, the PCOS is ready to accept ballots.

27) Detach the Initialization Report,' affix their siynatlrres thereon


including tlie representatives of the political parties, candidates or
citizens arms present;

28) Place the Initialization Report inside the envelope (Al7-TS)


containing the Diagnostic Repo~tfor submission to the Election
0ffice1./SBRCG;

v) The Chairman of the BEI/SBEI shall issire the 10 test ballots.

Only two (2) voters car1 acconiplish the test ballot at the salne tinie. Fur
this purpose, give each of the test voters a ballot ir~sidea ballot secrecy
foldel- ancl a riiarlting pen;

The test voter shall, using t.lie rnarking pen, acconiplish his bdllot by f ~ ~ l l y
shading the oval opposite tlie name of the candiclate/political party
participating in the party-list system of his choice. Thereafter, lie shall
return his accomplished ballot inside the ballot secrecy folcier anrl proceed
to tile BEIJSBEI;

w) The Chairman of the BEI/SBEI shall:

a. Exaniirie the accomplisl~eclballots and determine wl~elliertlie ovals


opposite tlie names of tlie candidates/political parties participating
in the party-list systern chosen have been f~rllyshaded and the
sec~~rity
features (timing rnarks and bar codes) have not been
damaged;

give the same to the voter who shall personally feed the
accomplished ballot into the PCOS ballot entry slot.

4) Tlie PCOS will recluest for the PIN of the poll clerk who will Illen
enter his PIN and press "ENTER". The PCOS will validate the PIN
ancl displays a message "PIN ACCEPTED". The PCOS will request
for the second PIN from the third member who will then alter Ids
ll1N and press "EN'I-ER". Tlie PCOS will validale the PIN and
displays a rllessage "PIN ACCEPTED";

5) The screen will clisplay a message "POLL IS BEING CLOSED PLEASE


WATT" followed by another message "V071FIG IIAS BEEN CLOSED
NO MORE BAI-LOTS WILL BE ACCEPTED BY THIS PCOS";

6) Thereafter, the PCOS shall alltomatically count the votes and


immerliately clisplay a message "WOIJLD YOU LIKE TO DIGTTALI-Y
SIGN 7 IiE TRANSMISSJON FILES WITH A BE1 SIGNATURE I<E\r'?",
with a "YES" or "NO" option;

7) Press the "NO" option;

8) The PCOS will display 'ARE YOU SURE YOU DO NOT WANT TO
APPLY ANY DIGKAI- SIGNA'TURE?",~ with a 'YES" or 'NO" optiol r;

9) Press the "YES" option. A lnessage shall be displayed "PRINTING 8


COPIES OF NATIONAL RETURNS. P ~ E A S EWAIT".

the 8 copies;

12) A message shall be displayed "WOULD YOU LIKE TO PRINT MORE


COPIES OF TI-iIS REPORT" with YES and NO options. Press
"NO" option

13) Detach the Election Retirrns and place it inside the envelope
provided for \-he purpose;

14) A message shall be displayed "READY TO TKAI\ISMIT. PLEASE


PLUG IN TRANSMISSION CABLE 1 ELECTRONICALLY
TRANSMIT ELECTION REPORTS AND PRESS 01<TO CONTINUE";

15) Do not p11.rgtransmission cable. Press "SI(1P" option;

16) A message "ARE YOU SURE YOU WISt-I TO SI<IP CONNECTING TO


TI-IE MODEM?" with YES and NO options will be displayed. Press
"YES" option;

17) PCOS will display a message "FAILED TO TRANSMIT RESULTS.


TRANSMISSION PROCESS FAILED. PLEASE DISCONNECT
TRANSMISSIOFI CABLE".

19) The PCOS will atltomatically print the Transmission Report.


Thereafter display a message "WOULD YOU LIKE TO PRll\fT
MORE COPIES OF '1-1 ITS REPORT" with a YES and NO options.
Press "NO" option.

20) Detach the Transmission Report and place it inside 1:lie envelope
(A17-TS).

21) The PCOS will display the Main Menu;

y) Re-zero the machine counters, press "UTILITIES" in the Main Menu and
select the "RE-ZERO" option in the next menu.

ancl press "ENTER;

2) Validate tlie PIN arid displays a message "PIN ACCEPTED";

3) Request for the seconcl PIN from the Third Member who will then
enter his PIN and press "ENTER";

4) Validate the PIN and displays a message 'PIN ACCEPTED".

z) The Chairman shall enter the Re-zero PIN, then press "ENTER;

The PCOS w~ill:

SEC. 5. Mrirnr~alverit7cati.n of resf~lts.- The BEI/SBEI shall retrieve tlre


accon~plisliedvalicl test ballots from t l ~ eballot box, manually count the votes therein
and accomplish the Election Returns (ER) provided for the pr.irpose. T l ~ efollowing rules
shall be observed in the ri\an~.talcounting of votes:

a) The Chairmall shall verify the ballots to determine whether there is over-voting.
I f there is an over-vote in a position, no vote shall be counted in favor of any
candidate for the said position;

b) Th e Chairman shall take the ballot: one by one and read the names of candidates
voted for and the offices for which they were voted in the order in which they
appear thereon;

c) The Poll Clerk sliall record on tlie ER the vote as the names voted for each office
are read. Each vote shall be recorded by a vertical line, except every fifth vote
which shall be reco~,dedby a diagonal line crossing the previous four vertical
lines;

d) After finishing the ten (10) test ballots, the Poll Clerk shall determine tlie total
nunibel- of votes obtained by each candidate;

e) The.BEI/SBEI shall compare the results of the manually-prepared ER with that of


the machine-generated ER.

1) I f tl\e results of both ERs are the, same, the certification portion of
both ERs shall be signed by tlie BEI/SBEI and the representatives of
the political patties, canclidates or citizens' arms present;

2) I f the results of both ERs are not tlie same, the BEIISBEI shall
I-eviewlre-appreciate the ballots to determine the cause of the
cliscrepancy. I f after re-appreciation, there is still discrepanql, call on
t l ~ eassigned technical support.

i. The BEIISBEI shall immediately submit a report of the testing to


the EO concerned/SBRCG; and

ii. The EO/SBRCG sliall submit a report to the Commission, through


the Fielcl Operations Group of the Project Managemeilk Office.

Sec. 6. Post testing procer/!~re;


Shutting dow11 the PCOS nrachines. -
The cer tified. I T capable BEI/SBEI member shall turn off tlie PCOS by doing tlie
following:

a. Press tlie "51-IUT DOWN" option in the Main Menu. The PCOS will display the
message "ARE YOU CERTAIN YOU WANT TO SI-IUT DOWN THIS PCOS?";

b. Select "YES" option. Wait until the light of the screen turns off;

c. is connect the battery from the PCOS machine;

d. Disconnect the battery cable from the battery;

e. Disconnect the power cable of the PCOS machine from tlie electrical outlet;,

f. Disconnect the power cable fl.oni the PCOS machine;

g. Place the co~~nlecl

accomplishecl ER and all repol ts in an envelope (Al7-TS) for sl~bmissionto
the EOISBRCG for safelceeping, after the testing and sealing;

h. The BETISBE1 shall:

I.) Retrieve the envelope containing tlie back-up memory card fro111the
PCOS box;

2) Open tlie ADMINISTRATOR slot, insert the back-up memory c a d in

7) Lock the slicling cover of the ballot box slit with one ( I ) 11adlocIc and
one ( I ) plastic security seal and record the serial number of the seal
in the Minutes/OAVF No. 11.

8) Record in tlie MinutesIOAVF No. 11 the serial number of the


Comelec seal to be used in sealing the PCOS box;

9) Place inside the PCOS box the following:

i. PCOS and its power card;


ii. Keys to the padloclcs of the ballot: box;
iii. PIlVs for the BEIISBEI;

i . PIN for re-zeroing; and


v. ^ILvo (2) copies of the Min~ltes/OAVFNo. 11. in their envelopes

Ensure that the three rolls of paper, envelope for spare 1Bl.rtLij1-1

the ~noclem,if any, are still inside the PCOS box.

10) Seal tile PCOS box with the Slnaltlnatic seal and Comelec seal
provided for the purpose; and

11) ~llow
the accredited citizens arm to place their own seal.

Interested parties may, with prior authority from the Election Officer/blead of
Post, watch over the polli~igcenter where the PCOS are kept.

SEC. 7 . Disposition of forn?s/suppfies. -After the testing and sealing, the


BEI/SBEI shall:

1) Submit to tlie EO/SBRCG the envelope containing the following:

a) Diagnostic Report;
b) Ini tialization Report;
c) Eight copies of ER;
d) M anual ER
e) Transmission Report; arlcl
f) Counted ballots.

The EO/SBRCG shall keep the above documents until further instruction
from the Commission.

2) Leave the PCOS contained in tlie sealed box, the battery inside its box,
and the locked ballot box inside the polling place, properly secured.

SEC. 8. PCOS ntachirres to be opener/ on May 10, 2010 or on April 10,


2010 for overseas absentee voting. - PCOS machines shall only be opened on May
10, 201.0 or, for overseas voting, on April 10, 2010, and before the votir~gstarts and in
the presence of watchers, if any. ,
