The program aims to raise funds to provide excellent delivery of
Red Cross services to our countrymen. Likewise, members will have

study programme entitled "Access to Criminal Justice and Human Rights:

in London.

GUIDELINES REGARDINGTHE APPEARANCE


IN COURTAND OTHER GOVERNMENT
AGENCIESOF INMATESUNDER THE
CUSTODYOF THE BUREAUOF CORRECTIONS

It has been observed lately that numerous requests from the


Courts, the National Bureau of Investigation and other government
agencies are received for inmates under the custody of the Bureau of
Corrections to appear before the said bodies, either for hearing or for
purposes of an investigation.
Paragraph a, Section 1, Chapter 6, Part II, Book I Ofthe Bureau of
Corrections Operating Manual (BuCor Manual) provides for the
instances wherein an inmate may be temporarily taken out of the prison
premises and appear before the above mentioned agencies of the
government. Said provision states:
"CHAPTER 6. OUTSIDE MOVEMENT OF INMATES
"Section 1. Movement of inmate outside confinement facility - The
Superintendent of a prison may authorize an inmate to be taken out of
prison in the following instances:

a) to appear in court or other government agency as directed


by competent authority;
b) for medical examination I treatment or hospitalization in an
outside clinic or hospital; or
c) to view the remains of a deceased relative." (Emphasis supplied)

Although the appearance in court or other government agency is so


provided under the said Section, the procedure and rules concerning the
said matter is, however, not specified in the said provision of the BuCor
Manual.
In view of the foregoing and in the exigency of the service and
pursuant to the provisions of existing laws, hereunder are the guidelines
that shall govern the appearance in court and other government agency
of inmates under the custody of the Bureau of Corrections:
.
1.

The temporary movement of an inmate outside the prison


facility to appear in court or any government agency should be
on the basis of a subpoena or processes issued by the court
or, in case of other government agency, a written request
timely submitted by the head of agency concerned specifying
the need for the appearance of the said inmate before the
agency.

2.

The appearance in court or. other government agency shall


require the favorable recommendation of the Director
of the Bureau of Corrections subject to the approval of
.the Secretary of Justice or his/her duly authorized
representative/so

3. In case the appearance of the inmates are requested by law


enforcement agencies, such as but not limited to the National
Bureau ofInvestigation and the Philippine National Police,:
a) The purpose of requiring appearance of the inmate should
be stated in the request, together with the appropriate.
case, matter subject of the investigation or court in which
the case is related, if any..
b) The estimated number of days in which the inmate shall
be placed under the government/law enforcement
. agency's custody should likewise be indicated in the
request in order for the Bureau to effect the appropriate
arrangements for custodial personnel.
c) The inmate should be fetched by appropriate number of
agents or personnel of the requesting agency.

d) In all cases, the inmate shall be accompanied by, and


entrusted to the custody of, sufficient custodial personnel
of BuCor.
4. Proper documentation shall be accomplished for the movement
of the inmates and that appropriate reports shall be submitted
immediately after the inmate has been returned to his prison
facility. '
5. The inmate/s shall be immediately returned to his prison
facility as soon as the purpose for his temporary release has
been accomplished.

SUBJECT.

Transfer of National Prisoners / Inmates to the


Penal Colonies/Penal Farms

The Department has received, on numerous occasions, complaints


from prisoners and their relatives regarding the alleged unreasonable or
arbitrary transfers of national prisoners to the different penal
colonies/penal farms under the control and supervision of the Bureau of
Corrections ("BuCor").
There are also reports of transfers of inmates to the colonies/penal
farms as a way of getting rid of them to pave the way for the unhampered
underground or clandestine activities of rival syndicates, particularly
those involved in illegal drugs.
On the other hand, there is a need to prevent or curtail the
reported proliferation of criminal activities inside the New Bilibid
Prison, so that any inmate positively identified, or on reasonable
grounds, suspected of involvement therein may be transferred to the
penal colonies/penal farms as a corrective or therapeutic measure
pursuant to Section 4, Paragraph b, Chapter 5, Part II, Book I of the
Bureau of Corrections Operating Manual (BuCor Manual), the pertinent
portion of which provides:
Chapter 5. TRANSFER OF INMATES
" xxx. "
Sec. 4 - Transfer of inmate not eligible to be a colonist to
a prison and penal farm. - Upon the recommendation of
the Classification Board, the Director may also transfer to
a prison and penal farm an inmate who, although not
eligible for classification as a colonist, is:
a) Physically and psychologically fit to absorb
rehabilitative program in the colony, or

In view of the foregoing, ALL transfers of inmates to any of the


penal colonies/penal farms
shall henceforth bear the prior approval of

It has been observed that purchase orders and job orders submitted
for review and/or approval by the Department are prevalently prepared
through alternative modes of procurement in contravention with the
provisions of the Philippine Government Procurement Act (RA 9184)
and other pertinent laws and issuances on the matter which mandates
government procurement to be undertaken through "competitive or
public bidding".
Further, "splitting" of contracts and/or transactions is strictly
prohibited. Pursuant to COACircular No. 76-41, s. 30 July 1976" splitting
may be in the form of:
(1)

Splitting of Requisitions which consists in the nonconsolidation of requisitions for one or more items needed at
about the same time by the requisitioner;

(2)

Splitting of Purchase Orders which consists in the issuance of


two or more purchase orders based on two .or more
requisitions for the same or about the same time by the
different requisitioners; and

In view thereof, and to put emphasis to the mandatory provisions of

Department shall be through public bidding. However, alternative
modes of procurement may be resorted to ONLY in cases where genuine
emergency exists and that the BAC certifies the same in writing,
otherwise, the purchase orders and job orders herein contemplated shall
be disapproved outright.

It has been observed that some employment applications submitted


in the Department are accompanied by letter-endorsements from various
public personalities.

In accordance with the provisio~s of'the

1987 Constitu~ion and


pursuant to Republic Act No. 6713, otherwise known as the "Code of
Conduct and Ethical Standards for Public Officials and Employees", and
in line with the principles of good governance, endorsements from public
..personalities in employment application, promotion and transfer are not
encouraged and no preferential treatment shall be accorded to
applications supported by such endorsements.

Employment and career advancement in the government service
shall be based on merit and fitness in order to -professionalize the
Department and prevent influence peddling, compromise, and lessen the
"utang na loob "effect.' Qualification, track record, work experience and

CRIMINAL CODE COMMITTEE

In the interest of the service and pursuant to the prOVISIons of


existing laws, a Criminal Code Committee (Ccq is hereby created to
undertake the review of the Revised Penal Code, as amended, and all
existing criminal statutes. The Committee shall draft an organic, Filipino
and modem criminal code that consolidates and harmonizes the penal
laws for an effective, efficient and economical administration of criminal
justice.
All offices, agencies under and/or attached to the Department shall
designate their expert principal and alternate representatives who shall
judiciously attend the meetings and activities of the Committee on official
time.
The Criminal Code Committee is expected to commence its work
in April 2011 and for one (1) year thereafter.
The Assistant Secretary for Planning and Management
shall serve as the focal person of the Criminal Code Committee.

Rules and Regulations of Republic Act No. 9470 (National Archives of
the Philippines Act), Title X, Rule 73 on Storage and Protection of Public
Records and given the importance of records management, the Records
Section, this Department, is hereby authorized to utilize the Records
Storage at the 3' Floor, DOJ Agencies Building, NIA Road comer East
Avenue, Quezon City, as the Department's Off-Site Records Facility.
This is in line with the thrust to professionalize records
management and institute a Records Management Program (RMP).
The Chief, Records Section, shall issue the necessary rules for the
transfer, maiI,ltenance and disposition of documents at such facility.

In the interest of the service, the attached Codes of Conduct of the


Prosecution Service consisting of the Code of Conduct for Prosecutors, Code of
Conduct for Members of the Support Staff, and the Rules Creating the Internal
Affairs Units, are hereby adopted and promulgated.
To ensure the uniform distribution and implementation of the Codes of
Conduct of the Prosection Service, the following guidelines shall be observed:
1. The Heads of Office shall give a copy of the Codes of Conduct to all
prosecutors, prosecuting attorneys and support staff who shall sign a
Memorandum Receipt (MIR) signifying receipt thereof.
2. The Technical Working Group designated to draft the Codes shall conduct
orientations/ trainings to the Heads of the Prosecution Service, who shall
echo the same to their subordinates.
3. After the distribution of the Codes of Conduct, the heads of office shall
ensure that all prosecutors, prosecuting attorneys, and support staff sign
the Commitment and Compliance Form in three (3) copies: the first copy
shall be kept by the employee concerned; the second copy shall be kept
by the head of office in the personnel files; and the third copy shall be
forwarded to the Personnel Division of the DOJ Central Office for filing
in the 201 file of the employee concerned.

4. No clearance in relation to his/her retirement! resignation! transfer shall


be issued to a prosecutor, prosecuting attorney arid support staff unless
he/she returns the Codes of Conduct to the head of office concerned.
5. The Heads of Office shall, from time to time, monitor the effective and
efficient implementation of the Codes of Conduct.
All rules, regulations and issuances inconsistent with the provisions of the
Codes of Conduct are deemed revoked, superseded or modified.
The Codes of Conduct shall take effect immediately. The lADs shall take
cognizance of all administrative complaints filed after their creation and
constitution. All administrative cases pending before the constitution of the
lADs shall continue to be handled and be resolved under existing procedures.

Implementation

of a National Greening Program

The President has declared the implementation of a National


Greening Program as a government priority pursuant to Executive Order
No. 26 dated 24 February 2011.
In line with the Department's task provided for in EO No. 26, please
be guided by the following:
The national penitentiary and penal colonies of the Bureau of
Corrections
(BuCor) shall be the
designated
nursery
establishments of the greening program of the Department and its
agencies. The BuCor shall ensure the production of planting
materials to be integrated in its agro-industrial programs;
2. The tree planting activity which is part of the rehabilitation
program for probationers, parolees and pardonees of the Parole
and Probation Administration (PPA) shall be strengthened and
enhanced;
3. The Board of Pardons and Parole (BPP) shall consider including in
its rules the condition that for any inmate to be eligible for parole
or executive clemency, they should have planted at least ten (10)
trees each before the availment thereof;
4. All other agencies including the Department proper shall ensure
that for each year from 2011 to 2016, a greening or tree planting
activity shall be part of their annual activities. In keeping with the

spirit of EO 26, each agency/office shall ensure that at least one


thousand (1,000) trees shall have been planted annually in
designated planting sites identified by the Departments of
Agriculture, Agrarian Reform and Environment and Natural
Resources; and
5. All regional offices of the Department and its agencies shall
likewise undertake a tree planting activity in coordination with
their respective local government unit and/or in partnership with
people's organizations and non-government organizations; and
Strict monitoring of the implementation of this program shall be done
every six (6) months from the effectivity of this Department Circular. A biannual progress report shall be submitted to this Office through the
Planning and Management Service.

It has come to our attention, on several occasions, that contracts,


purchase orders and job orders, for the review and/or approval of the
Department, were submitted with incomplete documents prompting us to
return the same without action, thus, causing unwarranted delay in the
review thereof.
In view of the foregoing and in order to facilitate a more
transparent and comprehensive review, it is hereby directed that all
contracts, purchase orders, and job orders submitted for the review and/or
approval of the Department shall have all its supporting documents
including, but not limited, to documents issued, submitted to or received
by their respective Bids and Awards Committee. Further, there shall be a
certification that records submitted to this Department are the complete
records of the contract/purchase order/job order pursuant to the
requirements provided by the Philippine Government Procurement Act
(R.A. 9184) and other pertinent laws and issuances on the matter.
Failure to comply with this directive shall be a sufficient ground
for the outright disapproval of the contract/purchase order/job order
herein contemplated and submitted to this Department for review and
approval.

laws, the Information Division, this Department shall be renamed the
"Communications Division".
In view of its expanded duties and responsibilities, the Communications
Division shall maximize the use of quad media (TV, Radio, Internet and Print)
to disseminate the Department's advocacies.
To ensure and sustain its operation effectively and efficiently, it is
directed that all requests for any event/activity which require coverage be
submitted to the Communications Division at least five (5) days before the
said event.

Attached is the 47th Regular Course announcement from the National


Defense College of the Philippines (NDCP) for Academic Year 2011-2012
toward a one (1) year full time academic program that will lead to the degree
of Master in National Security Administration (MNSA).
The qualified candidate shall be on scholarship grant, with full
expenses for the course to be borne by the NDCP, except the cost to be
incurred in reporting to and from the College, writing the Master's thesis,
and joining the Regional Security and Development Study (RSDS) abroad,
which shall be shouldered by the sponsor or nominating agency of the
candidate.

Attached is a copy of the invitation from Chairperson Loretta Ann P.


Rosales of the Commission on Human Rights relative to the conduct of a
"SOLIDARITY RUN" on Saturday, 3 December 2011, a kick-off activity
to commemorate the International Human Rights Day and the 63rd
Anniversary of the Universal Declaration of Human Rights, pursuant to
Republic Act 9201, every December 4-10 of each year as "National Human
Rights Consciousness Week" in the Philippines with this year's theme: "End
Impunity! Make Human Rights Our Way of Life".

Invitation to the Foreign Service Institute (FSI)


Language Program

Attached is a letter dated 27 June 2011 from Acting Director Laura Q. Del
Rosario, Foreign Service Institute, Department of Foreign Affairs inviting this
Department to endorse five personnel to the Institute's Foreign Language Program.
FSI Language Program is a one-year trimestral training in major foreign
languages for personnel of the Department of Foreign Affairs and other government
agencies. The first trimester covers the period from 9 January to 20 April 2012
offering courses on Arabic, Bahasa Indonesia, French, German, Mandarin, Nihongo
and Spanish.
Applicants should be college graduates who occupy permanent positions in the
government service and whose works require foreign language proficiency and shall
be endorsed by their respective Heads of Office.
The application period is from 4 July to 19 August 2011. All applicants must
take the Language Aptitude Test (LAT) and undergo the interview which are
scheduled from 12 to 15 September 2011. Those who qualifY for admission wilrlJe
notified on the third week of November 20 II.
Interested applicants may forward their application to the Office of tl'le
Assistant Secretary for Personnel Management and Development, this Office.

DATED 2 JUNE 2011 ON "GUIDELINES
REGARDING THE APPEARANCE IN COURT
AND OTHER GOVERNMENT AGENCIES OF
INMATES UNDER THE CUSTODY OF THE
BUREAU OF CORRECTIONS"

In the interest of the service, and considering that officials of the


Bureau of Corrections have already been directed to strictly monitor the
appearance of inmates in court and other government agencies, and to
closely supervise these inmates under their custody, Department
Circular No. 026 is hereby revoked.
The Director of the Bureau of Corrections or the concerned
Superintendent of Prison shall now authorize said appearance in writing,
under conditions that he or she may impose and deem appropriate.

Bureau of Corrections ("BuCor"), approved amendments to Sections 6(b),
7(a) and 7(b) of Chapter 3, Part II of the Bureau of Corrections (BuCor)
Operating Manual (the "BuCor Manual"), to wit:
"xxx Accordingly, Section 6, par. b and Section 7 pars. a & b,
Chapter 3, Part /I of the BUCOR Operating Manual shall now read
asfollows:
"SEC.6. Colonist. - xxx
"b. Has served imprisonment with good conduct for a period
equivalent to one1ifth (1/5) of the maximum term of his
prison sentence, orfive (5) years (formerly 7 years) in
the case of life sentence and those whose sentence
were computed as definite forty (40) years xxx
"SEC. 7. Privileges of a Colonist - A colonist shall have the
following privileges:
"a. Credit of an additional GCTA of ten (:ro)days for each
calendar month while he retains said classification

of the Revised Penal Code
"b. Automatic reduction of sentence to thirty (30) years for
colonists imposed with the life sentence, or whose
sentence were computed as definite forty (40) years;

is hereby revoked in its entirety, which revocation shall have the effect
of re-instating the provisions to their previous formulation prior to the
issuance of said 2nd Indorsement, to wit:
"Sec. 6. Colonist. - The Director may, upon the "recommendation of
the Classification Board, classify an inmate who has the following
qualifications as a colonist:

"b. has served imprisonment with good conduct for a period
equivalent to one fifth (1/5) of the maximum term of his
prison sentence, or seven (7) years in the case of a life
sentence.
"Sec. 7. Privileges of a colonist. - A colonist shall have the following

This revocation is being effected, upon approval by His Excellency,


President Benigno S. Aquino III, for the reason that the amendments

implementing rules and regulations cannot alter the substance of a law or


go beyond its provisions (People v. Lim, 108 Phil. 1091). Particularly, the
amendments to subparagraphs (a) and (b) of Section 7 resulted in the grant
of privileges beyond those provided by substantive laws, including, the
Revised Penal Code. On the other hand, the amendment made to Section
6(b) is being revoked for policy considerations, specifically, that it is more
consistent with the corrective goal of our penal system if the minimum
qualification for the grant of colonist status to an inmate is kept at the
original seven-year requirement.
The foregoing revocation and the resulting changes to the BuCor
Manual shall take effect after the lapse of fifteen (15) days following
the publication of this Department Circular in a newspaper of
general circulation.
Let copies of this Resolution be likewise sent to the Office of the
President through the Executive Secretary and to the University of the
Philippines Law Center.

Attached is a letter dated 15 June 2011 from the Assistant Secretary,


Office of United Nations and Other International Organizations, Department
of Foreign Affairs, transmitting to this Department the enclosed e-mail dated
25 May 20 II from the Office of the Human Resources Management of the
United Nations announcing job opening for judges in the United Nations
Dispute Tribunal (UNDT) and the United Nations Appeals Tribunal
(UNAT).
Applicants for the UNDT should have at least 10 years of judicial
experience in the field of administrative law, or equivalent, with one or more
national jurisdictions and IS years of experience for the UNA T. Women
applicants are strongly encouraged.
Interested applicants may forward their application directly to the
Department of Foreign Affairs (DF A) not later than 29 July 2011.
