Introduction
I negate todays resolution.
Resolved: Civil disobedience in a democracy is morally justified.
Definitions
For clarification of todays round, I offer the following counter
definitions:
The phrase civil disobedience is defined by Wordnet as a group's
refusal to obey orders in protest against discrimination.
Democracy is defined by The American Heritage Dictionary of the
English Language as a Government by the people, exercised either
directly or through elected representatives.
Moral is defined by The American Heritage Dictionary of the English
Language as Conforming to standards of what is right or just in
behavior.
Justified is defined by The American Heritage Dictionary of the
English Language as To demonstrate or prove to be just, right, or
valid
Framework
The highest value in todays round is Utilitarianism. Utilitarianism is
defined by the Stanford Encyclopedia of Philosophy as an action is
considered morally right if the action produces the most good. I will
defend a consequentialist framework where the ends justify the
means. This value must be upheld because it is impossible to please
everyone so we will have to please the most amounts of people that we
can.
My criterion is therefore upholding democracy. Upholding democracy
means up holding the idea that the government is by the people and is
exercised either directly and through elected representatives. My
criterion best upholds my value of Utilitarianism because upholding
democracy ensures that the most amount of people are helped. The
voting process is an ethical one as it allows for the majority to rule
and even if some individuals are left out, it is still ethical under a
utilitarian framework. We cant help everyone so we must help the
most that we can to be a just government.
Observation
My only observation is that the rule of law in a democracy best
protects freedom while allowing orderly amendment to the law.
Attorney and Presidential Medal of Freedom winner, Morris Leibman
explains, our greatest accomplishment <is> the fashioning of the law
society [one that operates under the rule of law]. Never in the history
of mankind have so many lived so freely, so rightfully, so humanely.
This open democratic republic is man's highest achievement -not only
for what it has already accomplished, but more importantly because it
affords the greatest opportunity for orderly change and the
realization of man's self-renewing aspirations.
Conclusion
Therefor I stand in negation.
