Preamble

W b ~ r e a sit is expedieut that tbc laws in force in the Districts of


Tuensang aod Mon in fhe State of Nagdand with respect of the
matters enumerated in list 11 and I11 in the VII Schedule to thc
Constitution, shall be assimilated lo the laws in lorce w i ~ hrespecl
to these matters in the rest of the State of Nagaland in h e manner
hereinalter appeasing ;
It is hereby enacted in the Twcnty-fifth year of the Rcpublic of
India, as follows :-

I. Short title
(i) This Act may be calIed the Tuensang and Mon districts
(assimilation of laws) Act. 1974.
(ii) It extends lo thc distric~sof Tucnwng and Mon in Nagaland,

Extent and Com~nencement


(iii) It shall come into forcc on such date as the Statc Ciovernmen~
may by nolification in ~ I i cNagaland C:rlzctrc appoint.
2. Definition
In this Acr;
(a) "appointed day" means the date oppointcd under sub-section
(3) of section 1 for the coming into force nf this Act.
(h) "Consti:utioo" Illcans the Constitutioa nf India.

(c) Laws mcans so much of any Act, Ordinancc Regulations


Rules, Ordcrsor Bye-laws as relates to any matter enumvrated
in the Statc list and the Concurrent list in the SeventhSchcdule
to tbc Constitulion and passed by a Statc Legislature and
are in force in districts of Tucnsang and Mon.

3. Assimilation of laws
(I) AII laws which before the appninred day extend to or are in
force in thc districts of Tuensang and Mon, shall with effecl
from the aforesaid day cease to extend or be in force in the
districts of M o n and Tuensang except as respect things done
beforq that day;

4. Power t o remove Difficulties
(2) All laws which bcforc the appointed day extcnd to or arc
inforce in the dictricts of Kohima and Mokokchung shall, as

come into force in the dislricts of Tuensang and Mon.


If any difficulty or doubt arises in assimilation from one Iaw ur
group of laws to another laws or groups of laws, the Stale
Government may by order notirled in the Nagaland Gazette, make
such Order as is wnsidered necessary for thc removal of difficulty
or doubt and the Order in such cases shall be finnl.
(2) Every order made under this scction shall be laid as soon as
may be, after i t is made, before thc Nagdand Legislative
Assembly, hercinaftcr called Assembly, while it is in session
for total period of seven days, which may bc comprised in
one session or io ~ w osuccessive sessions and if beforc the
expiry of thc session in which i t is so laid nr [he scssion
following, the Assembly agree in making any modification in
the order or the Asscmbly agree thgt the ordcr should nut
bc made, the order shall thereafter have cffect only in such
modified form or be of no effcct as the m e may be, so
however that any such modification or annulment shalI be
without prejudice to the validity nf anything previously dona
under this Order.
5. Repeal
Tuensang District (AssiiIalion of laws on Statc subject) Act.,
1969 is hereby repealed.

2. Amendment of Sectiun 2.
I n Ulausc (c) of Sec~ion2 ol the Tuensang and MODDistricts
(Assimilalion of Laws) Act, 1974 (hereinafter rcfcrred to as
Principal Acl) lull slop- shall be inserted after the word-.
"Constitulic~n" and the follo$ing words shall bc deletcd,
namely :

3. Amendment of Section 3.
