An Act t o consolidat e and am end t he laws relat ing t o regist rat ion of pract it ioners of
m edicine in Madhya Pradesh and t o m ake provisions for const it ut ion of t he Medical
Council for t he St at e and for m at t ers connect ed t herewit h.
Be it enact ed by t he Madhya Pradesh legislat ure in t he ( Thirt y- Eight h) Year of t he
republic of I ndia as follows: CH APTER- 1 - PRI LI M I N ARY
1 . Shor t t it le e x t e n d a n d com m e n ce m e n t
( 1) This Act m ay be called t he Madhya Pradesh Ayurvigyan Parishad
Adhiniyam , 1987.
( 2) I t ext ends t o t he whole of Madhya Pradesh.
( 3) I t shall com e int o force on such dat e as t he St at e Governm ent m ay,
by not ificat ion, appoint .
2 . D e fin it ion s
I n t his Act , unless t he cont est ot herwise requires, ( a) " Council" m eans t he Madhya Pradesh Ayurvigyan Parishad est ablished
under sect ion- 3;
( b) " I ndian Medical Regist er" m eans t he Regist er m aint ain by t he Medical
Council of I ndia under sect ion- 21 of t he I ndian Medical Council Act , 1956
( No. 102 of 1956) ;
( c) " Medicine" m eans m odern scient ific m edicine in all it s branches and
includes surgery and obst et rics, but does not include vet erinary m edicine
and surgery;
( d) " Recognize m edical qualificat ion" m eans
( i) any of t he m edical qualificat ion for t he t im e being, included in t he
schedules t o t he I ndian Medical Council Act , 1956 ( No.102 of 1956) ;
( ii) any of t he m edical qualificat ions specified in t he schedule;
( e) " regist ered pract it ioners" m eans any person enrolled on t he St at e
Medical Regist er under t he provisions of t his Act ;
( f) " regulat ion" m eans a regulat ion m ade under sect ion- 28;

( g) " St at e Medical Regist er" m eans a regist er m aint ained under sect ion
11;
CH APTER I I - CON STI TUTI ON OF TH E COUN CI L AN D APPOI N TEN T OF
REGI STRAR AN D OTH ER OFFI CERS AN D SERV AN TS.
3 . I n cor por a t ion of St a t e M e dica l Cou n cil.
( 1) The St at e Governm ent shall, as soon as m ay be, est ablish, by
not ificat ion a m edical council for t he st at e w.e.f. Such dat e as m ay be
specified t herein.
( 2) The council shall be a body corporat e by t he nam e of t he Madhya
Pradesh Ayurvigyan Parishad and shall have perpet ual succession and a
com m on seal wit h power t o acquire and hold propert y, bot h m oveable and
im m ovable, and subj ect t o t he provisions of t his Act t o t ransfer any
propert y held by it and t o cont ract and do all ot her t hing necessary for t he
purposes of it s const it ut ions and m ay sue and be sued in it s corporat e
nam e;
Provided t hat t he council shall not t ransfer any propert y held by, it by way
of sell, m ort gage, lease or ot herwise or borrow m oney from any person or
agency wit hout t he previous perm ission of t he St at e Governm ent .
4 . Con st it ut ion of Coun cil.
( 1) The Council shall consist of following m em bers, nam ely: ( a) Five m em bers elect ed from am ongst t hem selves by persons enrolled on
t he St at e Medical Regist er;
( b) Five m em bers t o be nom inat ed by t he St at e Governm ent as follows( i) one represent at ive of t he I ndian Medical Associat ion, Madhya
Pradesh St at e Branch out of t he penal of five persons t o be proposed
by t he St at e Branch of t he said associat ion;
( ii) one m em ber from am ongst t he m em ber of m edical facult ies of
t he Universit ies in t he St at e;
( iii) t wo m em bers from am ongst t he Madhya Pradesh Healt h
Services holding class- I Post out of whom one shall be a Lady
Doct or;
( iv) a Dean of one of t he Governm ent Medical Colleges in t he St at e;
( c) Direct or Medical Services Madhya Pradesh.
( 2) The Direct or of Medical Services shall be t he president of t he Council
and t he Dean shall be t he Vice President of t he Council.
( 3) The nam e of every person elect ed or nom inat ed under sub sect ion ( 1)
shall be published in t he gazet t e and t he m em bers shall ent er and shall, for

t he purposes of t heir t erm , be deem ed t o have ent ered upon t heir


respect ive offices wit h effect from t he dat e of such publicat ion.
( 4) The Vice President shall perform such dut ies and exercise such powers
of t he President as m ay be assigned t o him by t he President .
5 M ode of Ele ct ion .
( 1) An elect ion under clause ( a) of sub sect ion ( 1) of sect ion ( 4) shall be
conduct ed by t he council in accordance wit h such rules as m ay be m ade by
t he St at e Governm ent in t his behalf.
( 2) Where any disput e arises regarding any elect ion t o t he Council, it shall
be referred t o t he St at e Governm ent in such m anner wit hin such period as
m ay be prescribed and t he decision of t he St at e Governm ent t hereon shall
be final and binding.
6 . Re st r ict ion on t h e N om ina t ion or m e m be r sh ip.
No person shall be eligible for elect ion or nom inat ion under sect ion 4, ( i) unless his nam e is born on t he St at e Medical Regist er; and
( ii) for m ore t han t wo consecut ive t erm s.
7 . Te r m s of Office of M e m be r s.
( 1) Subj ect t o t he provisions of t his Act , an elect ed or nom inat ed m em ber
shall hold office for a t erm of five years from t he dat e he ent ers upon his
office as provided in sub sect ion ( 3) of sect ion 4;
Provided t hat an out going m em ber shall cont inue t o hold office t ill his
successors ent ers upon his office.
( 2) An elect ed or nom inat ed m em ber shall be deem ed t o have vacat ed his
seat if, in t he opinion of t he council, he is absent wit hout sufficient excuse
from t hree consecut ive ordinary m eet ings of t he council or, if he ceases t o
be a regist ered pract it ioner.
( 3) A casual vacancy in t he council shall be filled as soon as possible by
elect ion or nom inat ion as t he case m ay be, and t he person elect ed or
nom inat ed t o fill t he vacancy shall hold office for t he unexpired t erm off his
predecessor.
( 4) Where t he said t erm of five years is about t o expire in respect of any
m em ber, a successor m ay be elect ed or nom inat ed at any t im e wit hin t hree
m ont h before t he said t erm expires, but he shall not assum e office unt il t he
said t erm has expired.
8 . M e e t ing of t h e Coun cil.
( 1) The council shall m eet at least t wice in each year at such t im e and place
as m ay be fixed by t he president .

( 2) Unless ot herwise provided by regulat ion, five m em ber of t he council out


of whom at least one shall be a non official m em ber shall form a quorum
and all quest ion brought any m eet ing of t he council shall be decided by
m aj orit y of t he m em bers present an vot ing and in t he case of equalit y of
vot es, t he presiding aut horit y shall have a second or cast ing vot e.
9 . Allow a nce s t o Pr e side n t , Vice Pr e side nt a nd M e m be r s of t h e Coun cil.
The President , The Vice President and Mem bers of t he Council shall be paid
such allowances for at t ending m eet ing as t he council m ay, by regulat ions,
det erm ine.
1 0 . Re gist r a r a n d Ot h e r Office r s.
( 1) The Council shall, wit h t he previous sanct ion of t he St at e governm ent ,
appoint a regist rar who shall Act as secret ary and t reasurer of t he council;
Provided t hat no person shall be eligible for being appoint ed as regist rar
unless he is a Regist ered Pract it ioner;
Provided furt her t hat for t he first four year from t he dat e specified for t he
est ablishm ent of t he council under sub sect ion ( 1) of sect ion- 3, t he regist rar
shall be a person appoint ed by t he St at e Governm ent who shall hold office
during t he pleasure of t he St at e Governm ent .
( 2) The council m ay, wit h t he previous approval of t he St at e Governm ent
creat e as m any post s of officers and servant s as it m ay deem necessary t o
carry out t he provisions of t his Act and m ay appoint officers and servant s
t heret o;
Provided t hat appoint m ent s t o t he post s, t he m inim um pay of which is Rs.
1820.00 or above, shall not be m ade by t he council wit hout obt aining t he
previous approval of t he St at e Governm ent .
( 3) The qualificat ions, t he condit ions of appoint m ent and service and scale
of pay as respect s t he regist rar shall be such as m ay be prescribed and as
regards ot her em ployees shall be such as t he council m ay, by regulat ions,
provide.
( 4) The council shall require and t ake from t he regist rar, or from any ot her
em ployee, such securit y for t he due perform ance of his dut ies as t he
councils deem s necessary.
( 5) The regist rar and ot her em ployees appoint ed by t he council under t his
sect ion shall be deem ed t o be public servant s wit hin t he m eaning of sect ion21 of t he I ndian Penal Code, 1860( 45 of 1860) .
CH APTAR- I I I - Pr e pa r a t ion a n d m a in t e n a n ce of St a t e M e dica l
Re gist e r .
1 1 . Pr e pa r a t ion of Re gist e r .

( 1) The Regist rar shall prepare and m aint ain a


St at e Medical Regist er of Medical Pract it ioners for t he St at e, in accordance
wit h t he provisions of t his Act .
( 2) The St at e Medical Regist er shall be in such form and shall be divided
int o such part s as m ay be prescribed. The regist er shall include t he full
nam e, address and qualificat ions of t he regist ered pract it ioner, t he dat e on
which each qualificat ion was obt ained and such ot her part iculars as m ay be
prescribed.
( 3) Any person who possesses a recognized m edical qualificat ion shall, at
any t im e on an applicat ion m ade in t he prescribed form t o t he Regist rar and
on paym ent of a fee as m ay be prescribed by regulat ion and on
present at ion of his Degree or Diplom a, as t he case m ay be, be ent it le t o
have his nam e ent ered in t he St at e Medical Regist er ordinarily wit hin t hree
m ont hs aft er com plet ion of prescribed form alit ies;
Provided t hat if a person possesses m ore t hen recognize m edical
qualificat ion, he shall m ent ion in t he applicat ion all t he recognize m edical
qualificat ions which he possesses on t he dat e he m akes t he applicat ion;
Provided furt her t hat t he applicant who is enable t o present for sufficient
cause, his degree or diplom a m ay be grant ed a provisional regist rat ion for a
period not exceeding one year if he sat isfies t he council t hat he holds such a
degree or diplom a.
( 4) Not wit hst anding anyt hing cont ent ed in sub sect ion ( 3) t he nam e of
every person which on t he day im m ediat ely presiding t he dat e of
com m encem ent of t his Act st ands ent ered in t he regist er kept by t he
Mahakoshal Medical Council or t he Medical Council, Bhopal shall be ent ered
in t he St at e Medical Regist er prepared under t his Act , wit hout such person
being required t o m ake an applicat ion or t o pay any fee for t his purpose.
( 5) Every regist ered pract it ioner shall be given a cert ificat e of regist rat ion in
t he prescribed form . The regist ered pract it ioner shall display t he cert ificat e
or cert ified t rue copy of t he cert ificat e of regist rat ion at a conspicuous part
in t he place of his pract ice.
1 2 . M a in t e n a n ce of t h e Re gist e r .
( 1) I t shall be t he dut y of t he regist rar of t he council t o keep t he St at e
Medical Regist er in accordance wit h t he provisions of t his Act and of any
orders m ade by t he council and from t im e t o t im e revise t he regist er in t he
m anner prescribed. The regist rar shall get t he m edical regist er published in
t he gazet t e and every change m ade during t he course of a year shall be
published annually in t he gazet t e.
( 2) Such regist er shall be deem ed t o be a public docum ent wit hin t he
m eaning of t he I ndian evidence Act , 1872 ( 1 of 1872) , and m ay be proved
by a copy published in t he gazet t e.
1 3 . Re gist r a t ion of Addit iona l Qu a lifica t ion .
( 1) Every regist ered pract it ioner who aft er t he ent ry of his nam e in t he
St at e Medical Regist er, obt ains any t it le, Degree or Diplom a which is a

recognize m edical qualificat ion shall be bound t o get t he sam e ent ered in
t he St at e Medical Regist er in accordance wit h t he provision of t his Act .
( 2) Every regist ered pract it ioner t o whom sub sect ion ( 1) applies shall, on
obt aining any t it le, Degree or Diplom a which is a recognize m edical
qualificat ion, m ake an applicat ion t o t he council in such form and wit hin
such period as m ay be prescribed t oget her wit h such fee as m ay be
prescribe by regulat ions for each qualificat ions obt ained for ent ering such
t it le, Degree or Diplom a in t he St at e Medical Regist er eit her in subst it ut ion
for, or in addit ion t o, any ent ry previously m ade;
Provided t hat where such t it le, Degree or Diplom a has been obt ained prior
t o t he dat e of com m encem ent of t his Act such applicat ion shall be m ade
wit hin six m ont hs from t he dat e of such com m encem ent .
( 3) On receipt of t he applicat ion under sub sect ion ( 1) , t he council shall
ent er t he Tit le, Degree or Diplom a in t he St at e Medical Regist er ordinarily
wit hin t hree m ont hs aft er com plet ion of prescribed form alit y.
( 4) No regist ered Medical Pract it ioner who has obt ained any addit ional
qualificat ion shall be ent it led t o use such qualificat ion for t he purpose of
pract ice or any ot her purpose what soever or derive any advant age t here
from during t he course of pract ice or for t he purpose of em ploym ent unless
he get s t hat qualificat ion regist ered in t he St at e Medical Regist er in
accordance wit h t he provision of t his sect ion.
1 4 . Pr ivile ge s of Re gist e r e d Pr a ct it ion e r s.
( 1) Subj ect t o t he condit ions and rest rict ions laid down in t his Act or t he
I ndian Medical Council Act , 1956 ( No.102 of 1956) regarding m edical
pract ice by person possessing cert ain recognize m edical qualificat ion, every
person whose nam e is for t he t im e being born on t he St at e Medical Regist er
shall be ent it le, according t o his qualificat ions t o pract ice as a m edical
pract it ioner wit hin t he st at e and t o recover in respect of such pract ice any
expenses, charges in respect of m edicam ent s or ot her appliances or any
fees t o which he m ay be ent it led.
( 2) No cert ificat e required by or under any law t o be given by a m edical
pract it ioner shall be valid unless it is signed by a regist ered pract it ioner and
bears t he seal of his nam e and regist rat ion num ber.
( 3) Every prescript ion issued by a regist ered pract it ioner shall have seal of
t he nam e and regist rat ion num ber of such regist ered pract it ioner.
( 4) No person ot her t han a regist ered pract it ioner shall be eligible t o hold
any appoint m ent as physician, surgeon or m edical officer in any hospit al
asylum , infirm ary, dispensary or any ot her m edical inst it ut ion or m edical
officer of healt h in any ot her allied branch of m edicine.
1 5 . Pow e r of Coun cil t o pr oh ibit e n t r y or t o dir e ct r e m ova l fr om St a t e
M e dica l Re gist e r .
The council m ay, upon reference from t he regist rar or ot herwise prohibit t he
ent ry in, or order t he rem oval from , t he St at e Medical Regist er of t he nam e
of any person, -

( a) Who has been sent enced by a crim inal court t o im prisonm ent for an
offence indicat ing in t he opinion of t he council such a defect in charact er as
would render t he enrollm ent or cont inuance of his nam e in t he St at e
Medical Regist er undesirable; or
( b) Whom t he council aft er enquiry at which opport unit y has been given t o
him t o be heard in person and which m ay at t he discret ion of council be
held in cam era, finds guilt y of infam ous conduct in any profession respect
by a m aj orit y of t wo t hirds of t he m em bers of t he council present and
vot ing at t he m eet ing but such num ber shall not be less t han five.
1 6 . Alt e r a t ion of St a t e M e dica l Re gist e r by coun cil.
( 1) The council m ay aft er giving t he person concern reasonable opport unit y
of being heard and inquiring int o his obj ect ions, if any, order t hat any ent ry
in t he St at e Medical Regist er, which in t he opinion of t he council, has been
fraudulent ly or incorrect ly m ade or bought about be cancelled or am ended.
( 2) The council m ay direct t he rem oval alt oget her or for a specified period
from t he St at e Medical Regist er of t he nam e of any regist ered m edical
pract it ioner for t he sam e reason for which regist rat ion m ay be prohibit ed by
t he council under sect ion- 15.
( 3) The council m ay direct t hat any nam e rem oved under sub sect ion ( 2)
shall be rest ored subj ect t o such condit ion- if any, which t he council m ay
deem ed fit t o im pose.
1 7 . Pr oce du r e in e n qu ir ie s.
For t he purpose of any enquiry under sect ion- 12, 15 or 16 t he council or
any com m it t ee aut horized by rules m ade under sect ion- 29 shall be deem ed
t o be a court wit h in t he m eaning of t he I ndian evidence Act , 1872 ( no.1 of
1872) , and shall exercise all t he powers of a com m issioner appoint ed under
t he public servant ( enquiries) Act , 1850 ( No.37 of 1850) , and such enquiries
shall be conduct ed, as for as m ay be, in accordance wit h t he provisions of
sect ion- 5 and sect ion- 8 t o 20 of t he public servant ( enquiries) Act , 1850 (
No 37 of 1850) .
1 8 . Appe a l a ga in st de cision of cou n cil.
( 1) Any person aggrieved by t he decision of t he council under sect ion- 12,
15 or 16 m ay prefer an appeal t o t he St at e Governm ent .
( 2) An appeal under sect ion- 1 shall be preferred wit hin t hree m ont hs from
t he dat e of receipt by t he part y concern of a copy of such decision and it
shall be accom panied by such fee as m ay be as prescribed by regulat ion.
CH APTER- I V COUN CI L FUN D
1 9 . Cou n cil fu nd
( 1)

The council shall est ablished a fund t o be called t he council fund.

( 2) The following shall form part of, or be paid int o, t he council fund: -

( a) Any cont ribut ion or grant by t he cent ral Governm ent or St at e


Governm ent ;
( b) The incom e of t he council from all sources including incom e from
fees;
( c) Trust s, bequest s, donat ions, indom ent s and ot her grant s if any;
( d) All ot her sum s received by t he council.
2 0 . Obj e ct s t o w h ich cou n cil fun d m a y be a pplie d .
The council fund shall be applicable t o t he following obj ect , nam ely: ( a) To t he repaym ent of debt s incurred by t he council for t he purposes of
t his Act and t he rules and regulat ions m ade t here under;
( b) To t he expenses of any suit or proceedings t o which t he council is t he
part y;
( c) To t he paym ent of t he salaries and allowances of t he em ployees of t he
council;
( d) To t he paym ent of t he allowances t o t he office bearers of t he council;
( e) To t he paym ent of any expenses incurred by t he council in caring out
t he provisions of t his Act and t he rules and t he regulat ions m ade t here
under.
CH APTER- V M I SCELLAN OUS
2 1 . Pr oh ibit ion fr om pr a ct ice e x ce pt a s pr ovide d in t h is Act or ce n t r a l Act
n o.1 0 2 of 1 9 5 6 .
Save as provided in t his Act or t he I ndian Medical Council Act , 1956 ( No.102
of 1956) , no person shall pract ice or hold or him self out , whet her direct ly or
indirect ly as pract ising m edicine wit hin t he st at e.
2 2 . Con t r ol by St a t e Gove r nm e n t .
I f it any t im e it appears t o t he St at e Governm ent t hat t he council has failed
t o exercise or has exceeded or abused any of t he powers conferred upon it
by or under t his Act or has failed t o perform any of t he dut ies im posed upon
it by or under t his Act t he st at e governm ent m ay, if it considers such
failure, excess, or abuse t o be of a serious nat ure not ify t he part iculars
t hereof t o t he council, and if t he council fails t o rem edy such failure, excess
or abuse wit hin such t im e as t he St at e Governm ent m ay fix in t his behalf,
t he St at e Governm ent m ay dissolve t he council for a period of t wo years
which m ay be ext ended by t he St at e Governm ent for a period not exceeding
one year at a t im e but t he period of dissolut ion in t he aggregat e shall not
exceed five years and cause all or any of t he powers and dut ies of t he
council t o be exercised and perform ed by such person and for such
period, as it m ay t hink fit and shall t ake st apes t o bring int o exist ence a
new council.

2 3 . I nfor m a t ion t o be fu r n ish e d by cou n cil a n d publica t ion t h e r e of.


( 1) The council shall furnish such report , copies of it s m inut es, abst ract of
it s account , and ot her inform at ion t o t he St at e Governm ent as t he St at e
Governm ent m ay require.
( 2) The St at e Governm ent m ay publish in such m anner as it m ay t hink fit ,
any report , copy, abst ract or ot her inform at ion furnished t o it under t his
sect ion.
2 4 . Pe na lt y.
I f any person whose nam e is not enrolled on t he St at e Medical Regist er
pract ices as a regist ered m edical pract it ioner, he shall be punishable wit h
rigorous im prisonm ent for a t erm which m ay ext end t wo t hree years and
wit h fine which m ay ext end t o Five Thousand Rupees;
Provided t hat , ( i) t he person possessing bachelor in Ayurvedic wit h Modern Medicine and
Surgery Degree and regist ered wit h t he Madhya Pradesh Board of Ayurvedic
and Unani Syst em s of Medicine and Nat uropat hy shall not be punishable
under t his sect ion for prescribing allopat hic m edicines or pract icing surgery
if his regist rat ion cert ificat e aut horizes him t o do so;
( ii) The m edical pract it ioner ent it led t o privileges of sect ion- 27 of t he I ndian
Medical Council Act , 1956 ( No.102 of 156) shall not be punishable under
t his sect ion for his non- regist rat ion in Madhya Pradesh.
2 5 . Va ca n cy n ot t o inva lida t e pr oce e din g e t c.
No Act or proceeding of t he council shall be invalid m erely by reason of, ( a) any vacancy in, or defect in t he const it ut ion t hereof; or
( b) any defect in t he elect ion or nom inat ion of a person act ing as m em ber
t hereof; or
( c) any irregularit y in it s procedure not affect ing t he m erit s of t he case.
2 6 . Pr ot e ct ion of Act ion t a k e n in good fa it h .
No suit , prosecut ion or ot her legal proceeding shall lie against t he St at e
Governm ent , t he council or any com m it t ee t hereof, or any officer or servant
of t he Governm ent or t he Council for anyt hing which is in good fait h done or
int ended t o be done, under t his Act .
2 7 . Pow e r t o m a k e r ule s by St a t e Gove r nm e n t .
( 1) The St at e Governm ent m ay, by not ificat ion, m ake rules t o carry out t he
purposes of t his Act .

( 2) I n part icular and wit hout prej udice t o t he generalit y of t he foregoing


power, such rules m ay provide for all or any of t he following m at t ers
nam ely: ( a) The qualificat ion, condit ions of appoint m ent and service, t he
scale of pay, t he t anner of office and t he powers and dut ies of t he
regist rar;
( b) Any ot her m at t er which has t o be or m ay be prescribed.
( 3) All rules m ade under t his Act shall be laid on t he t able of legislat ive
assem bly.
2 8 . Pow e r t o m a k e r e gu la t ions by cou n cil.
The council m ay, wit h t he previous sanct ion of t he St at e Governm ent , m ake
regulat ions generally t o carry out t he purposes of t his Act , and, wit hout
prej udice t o t he generalit y of t his power, such regulat ions m ay provide for,
( a) The m anagem ent of t he propert y of t he council and t he m aint enance
and audit of it s account s;
( b) The sum m oning and holding of m eet ings of t he council, t he t im e and
places where such m eet ings are t o be held and t he conduct of business
t hereat ;
( c) The regist rat ion of m em ber of t he council;
( d) The powers and dut ies of t he President and Vice President ;
( e) The m ode of appoint m ent of t he com m it t ee, t he sum m oning and holding
of m eet ings and t he conduct of business of such com m it t ees;
( f) The qualificat ions and condit ions of service of ot her em ployees of t he
council;
( g) The part iculars t o be st at ed and t he proof of qualificat ions t o be given in
t he applicat ion for regist rat ion under t his Act ;
( h) The fee t o be paid on applicat ions and appeals m ade under t his Act ;
( i) The fee t o be paid for ent ering addit ional qualificat ion in t he St at e
Medical Regist er, and
( j ) Any m at t er for which under t his Act provision m ay be m ade by
regulat ions.

2 9 . Tr a n sit iona l Pr ovision s.
( 1) The St at e Governm ent m ay for bringing t he council int o being in
accordance wit h t he provisions of t his Act appoint t he direct or of m edical

services t o be a special officer t o conduct elect ion of council t o be


est ablished for t he first t im e aft er t he com m encem ent of t his Act .
( 2) Till t he council is est ablished under sub sect ion- 1 of sect ion ( 5) t he
special officer appoint ed under sub sect ion ( 1) shall be deem ed t o be
council est ablish under sub sect ion ( 1) of sect ion- 3 for t he purposes of t his
Act and shall exercise t he powers and discharges t he funct ion of t he
council.
3 0 . Ge ne r a l Pr ovision s a pplica ble t o m e dica l pr a ct it ion e r s.
The provisions of t his Act are in addit ion and not in derogat ion of, t he
provisions of t he I ndian Medical Council Act , 1956 ( No. 102 of 1956) ,
cont aining general provisions applicable t o all m edical pract it ioners.
3 1 . Re pe a l a n d ot he r con se qu e nce s.
As from t he dat e of com m encem ent of t his Act , t he follow ing consequences
shall ensue, nam ely: ( a) The cent ral province and berar m edical regist rat ion Act , 1916 ( No. 1 of
1916) and t he Madhya Pradesh st at ut ory bodies ( regional const ruct ion) Act ,
1956 ( XVI I of 1956) , in so for as it relat es t o t he said Act , t he Madhya
Bharat Medical Pract it ioners Regist rat ion Act , 1954 ( No.16 of 1954) and t he
m edical pract it ioners regist rat ion Act , 1935 ( Bhopal Act VI I of 1935) , in so
for as it relat es t o regist ered pract it ioners pract icing m edicine as define in
clause- C of sect ion- 2 shall st and repealed;
( b) The Mahakoshal Medical Council, The Madhya Bharat ( Region) Medical
Council and t he Medical Council est ablished under sect ion- 3 of t he m edical
pract it ioners regist rat ion Act , 1935 ( Bhopal Act VI I of 1935) shall st and
dissolved;
( c) All asset s and liabilit ies of t he councils referred t o in clause- B shall
belong t o and be deem ed t o be t he asset s and liabilit ies of t he council
est ablish or deem ed t o be est ablished under sect ion- 3;
( d) All records and papers belonging t o t he councils referred t o in clause- B
shall vest in and be t ransferred t o t he council est ablished or deem ed t o be
est ablished under sect ion- 3.
